About modification of article 46 of the Law of Ukraine "About road transport"

The Verkhovna Rada of Ukraine decides:

1. Article 46 of the Law of Ukraine "About road transport" (Sheets of the Verkhovna Rada of Ukraine, 2006, No. 32, Art. 273; 2009, 137) to state No. 10-11, of the Art. in such edition:

"Article 46. Carrying out tender on transportation of passengers on bus route public

For participation in tender on bus route public the automobile carrier submits for transportation of passengers to competitive committee such documents:

the statement of the applicant of the established sample with indication of bus route public at which the applicant intends to work;

the notarized copy of the license for the right of provision of services on transportation of passengers and the copy of licensed cards on buses which will be used on bus route;

data on additional terms of servicing of route;

the document which confirms introduction of payment for participation in tender.

Executive bodies and local government bodies at least in nine days prior to day of carrying out tender provide informing the relevant divisions of the State traffic inspectorate of the Ministry of Internal Affairs of Ukraine on applicant carriers which submitted documents for tender.

The procedure for informing affirms the central executive body which provides forming and realizes state policy in the field of transport, in coordination with the Ministry of Internal Affairs of Ukraine.

During determination of the winner of tender in case of equal proposals of applicants the benefit is provided to carriers which provided to competitive committee the certificate of conformity of services in transportation of passengers by buses to licensed conditions, and for long-distance and international bus routes - as well the certificate of compliance of the bus to parameters of comfort.

Financing of carrying out tender is performed by executive bodies and local government bodies at the expense of funds deposited by applicants as payment for participation in tender, and also at the expense of own means.
