1. Approve the enclosed Rules of conducting military accounting of persons liable for call-up and recruits.

2. To the central executive and other state bodies to bring earlier adopted regulatory legal acts into accord with this resolution.

3. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

4. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of conducting military accounting of persons liable for call-up and recruits

1. General provisions

1. Rules of conducting military accounting of persons liable for call-up and recruits (further - Rules) determine procedure for conducting military accounting of persons liable for call-up and recruits in the Republic of Kazakhstan.

2. Military accounting of citizens of the Republic of Kazakhstan will be organized according to the laws of the Republic of Kazakhstan of June 16, 1997 "About mobilization preparation and mobilization in the Republic of Kazakhstan", of January 7, 2005 "About defense and Armed Forces of the Republic of Kazakhstan", of February 16, 2012 "About military service and the status of the military personnel", of February 13, 2012 "About special state bodies" and these rules.

3. Military accounting is performed constantly and covers citizens of the Republic of Kazakhstan, except for:

1) the women who do not have military specialty;

2) persons exempted from execution of conscription according to the Law of the Republic of Kazakhstan "About military service and the status of the military personnel";

3) persons serving custodial sanction;

4) persons who are constantly living outside the Republic of Kazakhstan.

4. The purpose of military accounting is determination of availability of draft and mobilization human resources for the benefit of their effective use for ensuring defense and safety of the state.

5. The main objectives of military accounting are:

1) determination of quantitative and high-quality structure of the resources of recruits and persons liable for call-up which are available in the Republic, for ensuring organized carrying out appeal of citizens on military service and actions for carrying out mobilization in the Republic of Kazakhstan;

2) preparation and accumulating of military specialists from among persons liable for call-up and recruits for ensuring completing and mobilization expansion of Armed Forces;

3) control over accomplishment by citizens of the Law of the Republic of Kazakhstan "About military service and the status of the military personnel" and these rules.

6. Duration of finding of citizens on military accounting is determined according to the Law of the Republic of Kazakhstan "About military service and the status of the military personnel".

On age persons liable for call-up are divided into categories of accounting:

1) in the first category consist:

reserve officers - up to 50 years inclusive;

sergeants (foremen), soldiers (sailors) of inventory - up to 40 years inclusive;

2) in the second category consist:

reserve officers - from 51 to 60 years inclusive;

sergeants (foremen), soldiers (sailors) of inventory - from 41 to 50 years inclusive.

Persons liable for call-up of the woman stay on the military registry in the second category:

reserve officers - up to 45 years inclusive;

sergeants (foremen), soldiers (sailors) of inventory - up to 35 years inclusive.

7. Military accounting is subdivided into general and special.

Citizens who are not reserved for legal entities during mobilization, warlike situation and in wartime stay on the general military registry.

Citizens who are reserved for legal entities, according to the procedure, established by Rules of booking of persons liable for call-up stay on the special military registry.

Military accounting of the citizens of the Republic of Kazakhstan who are temporarily living outside the Republic of Kazakhstan is performed according to the procedure, established by these rules.

8. Military accounting of persons liable for call-up and recruits is performed in the place of their residence or temporary stay (for the term of over three months) by local authorities of military management (further - MOVA) areas (the cities of regional value). In settlements where are absent MOVA, military accounting is provided by akims of settlements, auls (villages), aulny (rural) districts (further - akims).

The organization and ensuring military accounting of citizens are performed by local executive bodies of areas (the cities of regional value).

Legal entities in the presence at them the working (studying) persons liable for call-up and recruits keep military account of citizens according to these rules. The common directorship and control over conducting military accounting by legal entities perform area MOVA (the city of regional value).

9. For conducting military accounting by local executive bodies of areas (the cities of regional value) the exempted accounting workers from calculation are allocated:

1) in area MOVA (the city of regional value) - one accounting worker on 2500 persons liable for call-up and recruits;

2) in settlements where are absent MOVA, - one accounting worker on 500 persons liable for call-up and recruits.

Content of the exempted accounting workers is made from means of the local budget.

10. Initial statement of male citizens on military accounting in area MOVA (the city of regional value) is performed annually from January to March by the commission on addition of citizens to the draft site, and the citizens who obtained citizenship of the Republic of Kazakhstan - during all calendar year.

Statement on military accounting of women is performed after achievement, them 18 years and receipts of specialty according to the list of military specialties determined by the Ministry of Defence of the Republic of Kazakhstan.

10-1. Heads of the organizations within seven working days provide the documents confirming the quantitative and high-quality list of persons liable for call-up, recruits and youths of premilitary age in MOVA of areas (the cities of regional value).

10-2. Bodies of civil registration within seven working days report in area MOVA (the city of regional value) about change by persons liable for call-up and recruits of surname, name and middle name (in case of its availability), birth dates and birth places, and also about cases of registration of death of the person liable for call-up or recruit.

10-3. Social security authorities of the population within seven working days report in area MOVA (the city of regional value) about all persons liable for call-up and recruits who are recognized as disabled people.

2. Addition of citizens to draft sites

11. Citizens of the Republic of Kazakhstan which in year of addition performs 17 years annually from January to March are attributed to draft sites.

The addition will be organized and carried out by the relevant local executive bodies together with area MOVA (the city of regional value) for the purpose of acceptance of citizens on military accounting, determination of their quantity, validity degree to military service, establishments of the education level, the profession and level of physical fitness.

On the basis of data on addition of citizens to draft sites area MOVA (the city of regional value) carry out preliminary distribution of draft resources by types and types of military forces of Armed Forces, other troops and military forming of the Republic of Kazakhstan, preliminary candidate screen for training in military and technical and other military specialties in the specialized organizations of the Ministry of Defence of the Republic of Kazakhstan and reveal persons wishing to arrive in military educational institutions.

2) is requested by December 1 from legal entities of the area (city) by lists of the citizens who are subject to addition to draft sites according to appendix 1 to these rules (daleespisk of citizens);

3) is checked by documents on accounting for compliance to the provided lists of the citizens who are subject to addition to the draft sites received from legal entities;

4) is verified by the lists of the citizens who are subject to addition, constituted on residence of citizens with the similar lists of citizens received from legal entities on place of employment or studies;

5) constitute till December 25 based on the verified lists the summary list of the citizens who are subject to addition to the draft site according to appendix 2 to these rules;

6) are requested on the citizens who are subject to addition:

from the medical organizations - medical records of outpatients, certificates of inoculations, lists of persons staying on the registry concerning psychological, narcological, dermatovenereal, infectious diseases, tuberculosis, HIV infections (AIDS), trachomas, chronic diseases of internals, diseases of surgical profile, the statement from clinical records, the data of medical inspection and dispensary observation characterizing the state of health of citizens;

from social security authorities of the population - the information about persons recognized as disabled people;

from auxiliary schools and the special organizations of education for children and teenagers with deviant behavior - medico-pedagogical characteristics;

from law-enforcement bodies, prosecutor's office and court - lists of the persons brought to trial, who are under examination, the offenders staying on the registry in law-enforcement bodies;

from bodies of health care - lists of the medical organizations to which the citizens of preinduction and military age needing stationary (out-patient) inspection and treatment will be attached on inspection and treatment.

13. On carrying out addition of citizens to draft sites the following work is carried out:

1) area MOVA (city of republican value and capital):

develop the work plan and organizational and methodical instructions for area MOVA (the city of regional value) about procedure and terms of carrying out addition of citizens to draft sites;

one-day instructor and methodical classes in the organization and carrying out addition of citizens to draft sites carry out with chiefs area MOVA (the city of regional value);

determine together with regional (the cities of republican value and the capital) departments (managements) of health care procedure for involvement of specialists doctors of the medical organizations for medical examination of citizens;

issue the order of the chief area MOVA (the city of republican value and the capital) about procedure and terms of carrying out addition to draft sites.

2) area MOVA (city of regional value):

annually no later than December 25 issue the order of the chief area MOVA (the city of regional value) about carrying out addition of citizens to the draft site according to appendix 3 to these rules;

develop the plan of preparation and carrying out addition of citizens for the draft site in which are provided:

procedure for the notification and terms of challenge of citizens for addition to the draft site;

the term of creation of lists and calculations of appearance of citizens on addition to the draft site on days (no more than 50 people a day);

holding actions of educational and social and legal work;

providing recruiting stations with the necessary equipment of rooms;

selection of specialists doctors for medical examination of attributed;

calculation on allocation of necessary number of technical workers, service personnel and transport for ensuring organized and high-quality carrying out addition of citizens to the draft site;

the term of briefing of persons involved for carrying out addition.

14. Area MOVA (the city of regional value) in compliance the Budget code of the Republic of Kazakhstan is represented to the relevant akimats (local executive bodies) (administrators of programs) of the request for the necessary expenses connected with conducting military accounting of persons liable for call-up and recruits.

Financial expenses on carrying out addition of citizens to draft sites are performed by akimats of areas (the cities of regional value).

To draft sites area MOVA (the city of regional value) annually till November 15 inform the corresponding akims on the planned actions, offers on ensuring timely and high-quality carrying out addition of citizens.

The notification of citizens about their appearance on addition is made by the agenda according to appendix 4 to these rules (further - the agenda) which delivery to citizens is made by local executive bodies and legal entities in five working days prior to the appointed appearance term on addition. In the agenda area MOVA (the city of regional value) is established by specific terms of appearance of citizens on draft sites for passing of addition.

In settlements where are absent MOVA, delivery of citizens to draft sites is provided by akims of settlements, auls (villages), aulny (rural) districts.

The citizens having serious illness, deprived of possibility of independent movement that is confirmed by references of the relevant treatment and prevention facilities are exempted from appearance on addition.

In necessary cases of the agenda can be handed to citizens directly to their home addresses.

15. Reasonable excuses of absence of citizens on draft sites in terms, the established area MOVA (the city of regional value) are recognized:

1) the disease (injury) connected with disability;

2) death or serious illness of the close relative;

3) the obstacles of spontaneous nature which deprived of the citizen of opportunity personally to arrive.

The reasons of non-arrival shall be supported by the relevant documents.

16. All citizens, the caused area MOVA (the city of regional value) for passing of addition, arrive to draft sites to terms and with the documents specified in the agenda.

17. The person on duty on recruiting station brings to the citizens arriving for passing of addition, procedure for passing of addition explains them their rights and obligations established by the laws of the Republic of Kazakhstan.

18. Authorized persons area MOVA (the city of regional value) have talk with citizens, check availability and completeness of the documents submitted by them, give instructions to the technical workers involved to work on recruiting station about filling on the recruit attributed accounting card according to appendix 5 to these rules (further - accounting card of the recruit), the personal record according to appendix 6 to these rules (further - the personal record), keep daily account of the citizens who were on addition according to the list.

On each recruit are filed in the personal record:

1) accounting card of the recruit;

2) copy of the certificate of birth;

3) copy of the marriage certficate;

4) copy of the certificate of birth of children;

5) copy of the education document;

6) reference or studies;

7) the characteristic from place of employment or study;

8) certificate of family composition;

9) leaf of studying of the recruit;

10) leaf of conversation with parents;

11) results of radiological research of bodies of thorax;

12) documents on the state of health;

13) references from law-enforcement bodies, bodies of inquiry and pretrial investigation;

14) messages from judicial authorities on criminal prosecution;

15) messages from the organizations of civil registration (further - bodies of RAGS) about change of surname, name, middle name, birth date and birth place, about death.

19. To all citizens who are subject to addition to draft sites medical examination according to Rules of conducting military-medical examination in Armed Forces, other troops and military forming is carried out.

20. In the book of protocols of the commission on addition, according to appendix 7 to these rules (further - the book of protocols), all citizens who are subject to addition to the draft site according to summary lists including persons having serious illness which because of disease was deprived of opportunity personally to be on addition are brought.

On the citizens directed to additional physical examination in the book of protocols of the commission on addition the following record is made: "Direct to additional inspection (where). Be on addition repeatedly" ___" ___________ 20 __ years".

The final decision on the specified citizens by the commission on addition is made after carrying out additional inspections and registers in the book of protocols of the commission repeatedly. If before creation of the closing statement on addition of citizens to the draft site additional inspection of individuals is not finished, then specified persons in the report on addition are shown as needing treatment (medical observation) according to the list 1 (temporarily unusable to military service).

21. At the end of each working day members of the commission on addition check correctness of the records made in the book of protocols of the commission on addition. The protocol is signed by the chairman and members of the commission on addition.

22. The commission on addition based on studying of documents and personal meeting with the recruit, taking into account sort of its occupations, specialty, education, common development and results of medical examination, accepts one of the following decisions which is included in the book of protocols of the commission on addition:

1) "It is suitable for military service";

2) "It is suitable for military service, but needs additional treatment";

3) "Needs treatment (medical observation)";

4) "It is unusable to military service in peace time, restrictedly it is suitable in wartime";

5) "It is unusable to military service with exception from military accounting".

The commission on addition makes also the decision:

1) about the organization of search of the citizens who did not be on addition;

2) about adjournment of terms of addition to persons serving sentence according to the court verdict.

23. The decision on need of treatment is made on persons with the revealed diseases which can be cured to validity degree to military service. These persons are subject to treatment in the treatment-and-prophylactic organizations. The issue of their validity to military service is resolved by the draft commission in case of appeal.

24. To persons recognized in case of addition "unusable to military service with exception from military accounting" and "unusable to military service in peace time it is limited suitable in wartime", after passing of medical examination in case of the next appeal based on the decision of the regional draft commission area MOVA (the city of republican value and the capital) the military ID, according to appendix 8 to these rules in which the corresponding records are made is in accordance with the established procedure written out.

The written-out military ID goes to area MOVA (the city of regional value) for issue to the owner through service center of the population in case of receipt of the statement for its issue.

After receipt of the military ID by the recruit the certificate of addition withdrawn in service center of the population is transferred to area MOVA (the city of regional value) for destruction by established procedure.

About issue of the military ID the mark in accounting card of the recruit with indication of series and number of the military ID is made, signed by the official area MOVA (the city of regional value) and certified by official stamp. The accounting card together with supporting documents is filed in separate case and transferred to archive to storage.

25. To citizens, the being disabled people of I and II groups, when passing addition to draft sites based on the decision of the regional draft commission and the documents confirming disability, area MOVA (the city of republican value and the capital) submitted notarized copies in accordance with the established procedure write out the military ID with the mark "not person liable for call-up". The written-out military ID goes to area MOVA (the city of regional value) for issue to the owner or his close relatives through service center of the population in case of receipt of the statement for its issue.

26. The recruits needing treatment or medical observation are considered in area MOVA (the city of regional value), and the information about them within 10 working days after the termination of addition is reported to the authorities of health care for carrying out lechebnoozdorovitelny work on the list 1 (temporarily unusable to military service) or according to the list 2 (suitable for military service with insignificant restrictions).

On the end of treatment of recruits medical institutions represent to area MOVA (the city of regional value) of the data on the held medical and improving events.

27. Area MOVA (the city of regional value) in the course of addition of citizens to the draft site reveal recruits:

1) needing treatment (medical observation), attached to the lechebnoprofilaktichesky organizations according to the plan of treatment, having issued them the directions according to appendix 9 to these rules (further - the direction);

2) suitable for health reasons and to other data for training in the specialized organizations of the Ministry of Defence about what record in accounting card of the recruit is made;

3) persons interested to arrive in military educational institutions with indication of about it in accounting card and leaf of studying of the recruit.

28. At the end of each working day the chief personally checks area MOVA (the city of regional value) whether everything citizens were on addition in the day appointed for them. Concerning the citizens who did not arrive to addition in due time the reasons of absence are established and measures to their repeated challenge are at the same time taken.

29. To the citizens attributed to draft sites, area MOVA (the city of regional value) the certificate of addition to the draft site, according to appendix 10 to these rules (further - the certificate of addition) which is issued to the owner is written out. Primary certification about addition is performed in area MOVA (the city of regional value). In accounting card of the recruit and the certificate of addition the mark by stamp about acceptance on military accounting according to appendix 11 to these rules is put down.

In case of delivery of the certificate of addition their obligations on observance of rules of military accounting, and persons on whom the decision on the direction on treatment (medical observation) - is made on need of regular visit of the relevant treatment-and-prophylactic organizations are explained to recruits.

30. In case of loss by the recruit of the certificate of addition, to it the duplicate is written out. Issue of the duplicate of the certificate of addition is made according to the decision of the chief area MOVA (the city of regional value) through service center of the population according to the written application of the recruit, according to appendix 12 to these rules in which circumstances of loss are specified.
