About approval of Industrial safety rules on road transport

According to article 28 of the Law of Ukraine "About labor protection", the subitem 41 of the item 4 the Provision the Ministry of emergency situations of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 402, I ORDER:

1. Approve Industrial safety rules on road transport which are applied.

2. To public service of mountain supervision and industrial safety of Ukraine (Hokhotva O. I.) in accordance with the established procedure:

2.1. Provide provision of this order on state registration in the Ministry of Justice of Ukraine.

2.2. Enter the order in the State register of regulatory legal acts concerning labor protection.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the Chairman of Public service of mountain supervision and industrial safety of Ukraine Hokhotva O. I.

Industrial safety rules on road transport

I. General provisions

1.1. Requirements of Rules extend to subjects of managing who will organize or carry out works on road transport (daleepredpriyaty).

1.2. At each company instructions for labor protection according to requirements of the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of January 29, 1998 No. 9, registered in the Ministry of Justice of Ukraine on April 7, 1998 for No. 226/2666 are developed (NPAOP 0.00-4.15-98).

1.3. Training and examination concerning labor protection of employees of the companies are carried out according to requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 231/10511 (NPAOP 0.00-4.12-05), and concerning fire safety - according to the List of positions, in case of appointment to which faces shall undergo training and examination concerning fire safety, and the procedure for their organization approved by the order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash against September 29, 2003 No. 368, registered in the Ministry of Justice of Ukraine on December 11, 2003 for No. 1147/8468 (NAPB B.06.001-2003), and Standard regulations on instructing, special training and examination concerning fire safety at the companies, in organizations and the organizations of Ukraine, the approved order of the Ministry of Ukraine concerning emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash against September 29, 2003 No. 368, registered in the Ministry of Justice of Ukraine on December 11, 2003 for No. 1148/8469 (NAPB B.02.005-2003).

It is forbidden to allow to work of workers who did not undergo training and examination concerning labor protection and fire safety.

1.4. Preliminary (during employment) and periodic (during labor activity) medical examinations of workers shall be performed at the scheduled time according to the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

1.5. Minor workers (18 years are younger) are allowed to the works which are not prohibited for them by the List of hard work and works with harmful and dangerous working conditions on which application of work of minors, by the approved order of the Ministry of Health of Ukraine of March 31, 1994 is forbidden to No. 46, registered in the Ministry of Justice of Ukraine on July 28, 1994 for No. 176/385.

1.6. It is not allowed to women to perform the works specified in the List of hard work and works with harmful and dangerous working conditions on which application of work of women is forbidden, No. approved by the order of the Ministry of Health of Ukraine of December 29, 1993 256, registered in the Ministry of Justice of Ukraine on March 30, 1994 for No. 51/260, and also to lift and move loads according to Limit rates of raising and movement of heavy things by the women approved by the order of the Ministry of Health of Ukraine of December 10, 1993 No. 241, registered in the Ministry of Justice of Ukraine on December 22, 1993 for No. 194.

1.7. Investigation and accounting of accidents, occupational diseases and accidents on production are performed according to the Procedure for investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 for No. 1232.

1.8. Terms which are used in these rules have such value:

road transport - the area of transport providing requirements satisfaction of the population and social production in transportations of passengers and loads by automotive vehicles;

the automotive vehicle - the wheel vehicle (the bus, cargo and automobile cars, trail car, semitrailer truck) which is used for transportation of passengers, loads or accomplishment of special working functions (daleetransportny means).

ІІ. General requirements of safety

2.1. According to article 13 of the Law of Ukraine "About labor protection" the employer shall create on each workplace in each structural division of working condition according to requirements of the current legislation, and also provide observance of requirements concerning the rights of workers in the field of labor protection.

For this purpose the employer provides development and functioning of management system with labor protection.

2.2. According to article 5 of the Law of Ukraine "About labor protection" all workers shall be informed by employer under the signature on working conditions at the company, availability on workplace where they will work, dangerous and harmful production factors which are not eliminated yet, possible effects of their influence on health and about the rights of workers to privileges and compensations for work in such conditions according to the current legislation and the collective agreement.

2.3. For the organization of accomplishment of the legal, organizational and technical, sanitary and hygienic, social and economic and treatment-and-prophylactic actions directed to prevention of accidents, occupational diseases and accidents in the course of work, the employer creates security service of work according to requirements of the Standard regulations on security service of the work approved by the order of the State committee of Ukraine on supervision of labor protection of November 15, 2004 No. 255, registered in the Ministry of Justice of Ukraine on December 1, 2004 for No. 1526/10125 (NPAOP 0.00-4.21-04).

2.4. Passing at the company of pretrip medical examination for transport drivers is performed according to the Regulations on medical examination of candidates for drivers and transport drivers approved by the order of the Ministry of Health of Ukraine, the Ministry of Internal Affairs of Ukraine of June 5, 2000 No. 124/345, registered in the Ministry of Justice of Ukraine on July 18, 2000 for No. 435/4656.

2.5. Providing workers with special clothes, special footwear and other individual protection equipment (further - SIZ) is performed according to requirements of the Regulations on procedure for the providing workers with special clothes, special footwear and other individual protection equipment approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of March 24, 2008 No. 53, registered in the Ministry of Justice of Ukraine on May 21, 2008 for No. 446/15137 (NPAOP 0.00-4.01-08).

2.6. Issue of special clothes, special footwear and other SIZ to workers is performed according to requirements of Standard Regulations of free issue of special clothes, special footwear and other individual protection equipment, to workers of road transport approved by the order of Committee on supervision of labor protection of Ukraine of October 20, 1998 No. 207, registered in the Ministry of Justice of Ukraine on January 4, 1999 for No. 1/3294, and Regulations of free issue of special clothes, special footwear and other individual protection equipment to workers of general professions of the different fields of the industry approved by the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of April 16, 2009 No. 62, registered in the Ministry of Justice of Ukraine on May 12, 2009 for No. 424/16440.

2.7. The employer shall provide the workers occupied at works with heavy and harmful working conditions, free treatment-and-prophylactic food, milk or equivalent foodstuff according to Procedure for free issue of milk or others equivalent to it foodstuff to the workers and employees occupied at works with harmful working conditions, approved by Goskomtrud's resolution of the USSR and Presidium of the All-Union Central Council of Trade Unions of December 16, 1987 No. 731/P-13.

2.8. According to the List of works with the increased danger approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 232/10512 (NPAOP 0.00-8.24-05), taking into account specifics of production by the employer the corresponding lists of works with the increased danger for which carrying out special training and annual examination concerning labor protection are necessary are developed and affirm.

2.9. For performance of works with the increased danger the employer the order determines the group of people by the company, responsible for their safe carrying out.

2.10. For works with the increased danger process charts are developed and hung out on workplaces and their accomplishment is provided.

2.11. Each worker prior to work shall be convinced of safe condition of the workplace, check operability of the safety devices, tools, mechanisms necessary for performance of work.

In case of identification by the worker of violations of safe condition of workplace which he cannot liquidate, he, without beginning work, shall report about them to the official in whose obligation vozhlozheno control of safe performance of works.

2.12. The employer shall provide workers with regulatory legal acts and acts of the company for labor protection which observance of requirements in operating time provides accident-free and safe working conditions.

2.13. Employees of the companies shall know and fulfill the requirements of these Rules, instructions for labor protection corresponding steered addresses with vehicles, the cars, mechanisms, the equipment and other means of production, to use means of collective and individual protection, to fulfill the obligations concerning labor protection provided by the collective agreement (agreement) and employment policies and procedures of the company.

2.14. Operation of acetylene generators is performed according to requirements of GOST 12.2.054 "SSBT. Installations acetylene. Safety requirements".

ІІІ. Requirements to the territory, production and auxiliary rooms, constructions

1. General requirements

1.1. The territory, production and auxiliary rooms, platforms and rooms for storage of vehicles, constructions shall correspond to BCH 01-89 "Departmental construction regulations. The companies for servicing of cars" (further - BCH 01-89), ONTP 01-91 "All-union regulations of process design of the companies of road transport" (further - ONTP 01-91), to the existing construction, sanitary and fire protection regulations and rules, and also these Rules.

1.2. The arrangement of factory and auxiliary buildings, constructions shall correspond to engineering procedure of servicing and repair of vehicles.

1.3. Production and auxiliary rooms and constructions are used only according to the destination, provided by the project.

Operation of buildings, constructions, objects of the company, shall be performed according to requirements of the Regulations on safe and reliable operation, the construction of buildings and constructions approved by the order of the State committee of construction, architecture and housing policies of Ukraine, the State committee of Ukraine on supervision of labor protection of November 27, 1997 No. 32/288, registered in the Ministry of Justice of Ukraine on July 6, 1998 for No. 424/2864 (NPAOP 45.2-4.01-98).

1.4. On all buildings and constructions there shall be documentation (passports, acts, technical journals, projects and so forth) which maintaining is provided by the Rules of inspections, assessment of technical condition and certification of factory buildings and constructions approved by the order of the State committee of construction, architecture and housing policies of Ukraine, the State committee of Ukraine on supervision of labor protection of November 27, 1997 No. 32/288, registered in the Ministry of Justice of Ukraine on July 6, 1998 for No. 423/2863 (NPAOP 45.2-1.01-98).

1.5. According to ONTP 01-91 vehicles depending on overall dimensions divide into four categories. Categories of vehicles depending on their overall dimensions are given in appendix 1 to these Rules.

1.6. On platforms and in rooms of storage, maintenance and repair, diagnostics and adjusting works of vehicles which engines use the liquefied oil gas arrangement of underground constructions, cellars, calorifer cameras for open parking of cars, priyamk, survey ditches, tunnels, wells is forbidden (except for priyamk on sites of car wash).

1.7. Vehicles and aggregates which are subject to write-off or repair in case of their storage out of rooms shall be placed on separate equal hard-standing spaces. For the prevention of fall of aggregates, unauthorized movement of vehicles and fall of their hung-out parts it is necessary to establish special supports, emphasis.

1.8. In production rooms and in the territory of storage of details, nodes, aggregates and different metal it shall be organized in certain places on racks.

1.9. Production waste, garbage, unsuitable details, nodes and aggregates shall clean up and accumulate timely on specially allotted platforms.

1.10. The distance from the platforms intended for storage and expectation of repair of vehicles to buildings and constructions is accepted according to requirements of BCH 01-89.

1.11. Danger areas and sites and in production rooms on which stay and performance of works is connected with danger to workers shall be reflected in alarm flowers and signs of safety, route signs according to the Technical regulation of signs of safety and protection of health of workers approved by the resolution of the Cabinet of Ministers of Ukraine of November 25, 2009 No. 1262, GOST 12.4.026-76 * "Colors alarm and signs of safety" in the territory (далееГОСТ 12.4.026-76) Traffic regulations approved by the resolution of the Cabinet of Ministers of Ukraine of October 10, 2001 No. 1306 (further - Traffic regulations), and the existing industry regulating documents.

1.12. Floor in rooms of any appointment shall be equal, with hard surface, impervious for ground waters, without ledges and hollows.

Materials which are applied to floor covering shall have the smooth and nonslipping surface convenient for cleaning, meet operational requirements of this room.

Where acids are used, alkalis and oil products, floors shall be resistant to effect of these substances and not absorb them.

Floors in rooms of painting sites, departments of preparation of paint in rooms where anticorrosive works are carried out, in gas-generating, and also warehouses for storage of pozharovzryvoopasny materials (liquids), cylinders with combustible gas shall be made of materials which do not give spark in case of blow by metal subject.

Workplaces in rooms with cold floor shall be equipped with strong wooden figurative lattices.

1.13. Outside in case of entrance to production and auxiliary rooms metal lattices or other devices for cleaning of footwear of dirt shall be established.

1.14. In the territory and in production premises of the companies it is not allowed:

encumber roads, passes, entrances, to fire hydrants, the locations of the firefighter to stock and the equipment;

place on the open areas vehicles in quantity which exceeds regulation, and also break established procedure of their arrangement;

smoke outside places specially allotted for this purpose;

use naked flame in the places which are not provided for this purpose without acceptance of the relevant fire-proof activities;

fill up reserve gate both from within, and outside, approach and entrance to them always shall be free;

to place and store disorderly (to privalivat, opirat) materials, aggregates, spare parts and so forth to elements of houses, constructions, the equipment and barrier.

2. Requirements to the territory

2.1. The territory of the company shall be protected, lit at night, to be kept constantly clean and procedure.

2.2. In barrier of the territory of the company where 10 and more posts of maintenance and repair or storage of 50 and more cars are provided, it is necessary to provide at least two gate for entrance (departure).

2.3. The territory of the company shall be equipped with drainage systems and drains. Hatches of drains and other underground constructions shall be in closed position.

2.4. During execution of repair, earth and other work in the territory of the company hatches are open, trenches and holes shall be protected. In places of transition through trenches transitional bridges by width of at least 1,0 of m with handrail m 0,9 height are established.

2.5. In the territory of the company there shall be drives for movement of cars and walking paths which have hard surface. In the summer they need to be cleared of dirt, and in the winter - of snow and ice, in case of ice to strew with antiskid mixes.

2.6. Width of drives in the territory of the company shall be at least 6 m in case of two-way traffic and at least 3 m - in case of unilateral.

Width of walking path shall be at least 1 m.

For pass of workers on the territory of the company the checkpoint shall be arranged.

Pass of workers through gate is forbidden.

2.7. In places of crossing of sidings by ditches, trenches, railway tracks and so forth floorings or bridges for moving shall be established.

2.8. For the parking of own transport it is necessary to provide the place on certain platforms outside the territory of the company. The Rukh of the individual transport on the territory of the company is forbidden.

3. Requirements to the room and storage area of cars

3.1. Rooms for storage of cars shall not unite with other production and auxiliary rooms where people reside directly. If necessary such connection shall be performed through the platform lock.

3.2. Rooms for storage of vehicles shall have direct departure through gate which open outside.

Floor in rooms for storage of cars shall have bias at least 1% sideways of ladders and trays.

3.3. Rooms and the open areas for storage of vehicles along walls and barrier of the territory where cars are established, shall have kolesootboyny devices.

Height of kolesootboyny devices shall constitute for vehicles:

The I categories - m 0,12; II and III categories - m 0,3;

The IV categories - m 0,4.

In case of installation of vehicles parallel to wall the distance from wall to edge of the kolesootboyny device shall be at least for:

The I categories - m 0,4;

The II categories - m 0,5;

III and IV categories - m 0,7.

In case of installation of vehicles perpendicular to wall, the distance from wall to edge of the kolesootboyny device shall be for all categories 0,5 m more than back or front droop of cars depending on the scheme of their arrangement.

3.4. Storage areas of vehicles shall have hard, equal surface and biases in the longitudinal direction of axis of the car no more than 1% and cross no more than 4%.

3.5. Platforms and floor in rooms for storage of vehicles shall have marking which is executed by indelible paint or otherwise and determines installation sites of cars and drives. When drawing marking it is necessary to consider that the distance between two vehicles which stand in parallel shall be sufficient for free otvoreniye of doors of cabin.

3.6. Storage areas of vehicles which transport the poisonous and infected substances, fecal liquids and garbage shall be located at distance at least 10 m one from another and from storage areas of other vehicles.

3.7. Storage areas of vehicles which transport petrols, oil, lubricants shall be located at distance at least 12 m one from another and from storage areas of other vehicles.

3.8. For simplification of start of the engine during the cold period of year (in case of air temperature below - 15 °C) platforms for outdoor storage of cars shall be equipped with means (gazo-, electro-or water - and so forth) for their warming up.

The equipment which facilitates start of the engine during the cold period of year shall ensure safety of service personnel and drivers.

3.9. In case of the equipment means of warming up of storage areas of vehicles which engines use the natural and fluidised oil gas compressed the design of the warming-up devices shall exclude possibility of heating of gas cylinders.

3.10. For storage of electric lift trucks, electric trucks and electrocars, the special room shall be provided. Their storage in production and auxiliary rooms is allowed, by way of exception, on specially allotted places and provided that electric lift trucks, electric trucks and electrocars will not encumber drives.

4. Requirements to the room for maintenance and repair of vehicles.

4.1. Rooms for maintenance and repair of vehicles shall provide safe accomplishment of all technological transactions.

4.2. Air of the working area, noise, vibration, lighting, and so forth on workplaces of production rooms shall meet the requirements of the existing regulations.

4.3. In case of placement in the general production room of sites (workplaces) for whom according to engineering procedure hazardous substances are allocated (gases, dust, aerosols, and so forth) warmly, noise is created, they shall be located in the certain rooms isolated from others by walls to ceiling.

4.4. Height of production rooms of posts of maintenance and repair of vehicles shall be such that distance from top of the car which is on the elevator or from top of the lifted body of the car dump truck which costs on floor, to bottom of designs of covering or overlapping, or to bottom of parts of weight lifting equipment which acts, there was at least 0,2 of m.

The smallest height of these rooms shall be at least 3,0 of m.

4.5. Floor in production rooms shall meet requirements of Item 1.12 of Chapter 1 of this Section.

4.6. In rooms of painting, kraskoprigotovitelny and accumulator sites, accomplishment of anticorrosive works and repair of the fuel equipment, and also acetylene generators, floor shall be made of materials which do not give spark in case of blow on them.

4.7. For regulation of devices of gas system of food directly on the car the room, certain of others, is allocated.

4.8. Sites, posts, platforms of sink of vehicles, shall have bias at least 2% sideways of reception wells and trays which arrangement excludes hit of stock water (from car wash) on the territory (to the room) the companies.

4.9. Posts of sink of vehicles separate from other rooms (posts) deaf walls with vapor barrier and waterproof covering.

4.10. Interfloor openings in production rooms shall be protected. Height of handrail shall be at least 0, m in case of one intermediate horizontal element, the bottom of handrail shall have onboard covering height from floor of at least 0,1 of m.

4.11. Entrances to the room of accomplishment of accumulator works and repair of the fuel equipment need to be separated other adjacent rooms, corridors and staircases, vestibule locks. Doors of these rooms shall open outside.

4.12. For performance of works with acid and alkaline accumulators it is necessary to provide certain rooms, in each of which there shall be three departments connected among themselves, isolated from other productions: one - for repair, the second - for charging, third - for storage of acid (alkali) and preparation of electrolyte.

4.13. For accomplishment of painting works it is necessary to provide two rooms: one - for paint preparation, the second - for posts of coloring and drying.

If coloring is performed out of painting cameras or in cameras with open opening, then apertures of gate to the painting room (from adjacent) shall be equipped with vestibule lock length equal to half of width of gate increased by m 0,2.

4.14. The room for installation of the acetylene generator shall be one-storey, isolated from others, to have removable roof and direct exit through doors which open outside.

5. Requirements to viewing ditches and platforms

5.1. The arrangement of viewing ditches and platforms in the territory of the company or in rooms shall provide safe arrival and congress of vehicles from them.

5.2. The sizes of viewing ditches and platforms are determined depending on type of vehicles, processing equipment which is used.

5.3. Length of the working area of viewing ditch and platform shall be at least dimensional length of vehicles.

Length of the working area of deadlock viewing ditch shall be such that the vehicle could be established completely on ditch, without closing entrance ladder and emergency exit.

5.4. Width of viewing ditch and platform shall be established, proceeding from the vehicle track sizes taking into account the equipment of external or internal flanges.

5.5. Depth of survey ditches and height of platforms shall provide open entry to the details, nodes and aggregates located from below to vehicles and to constitute:

for cars and buses of especially small class - m 1,3-1,5;

for cargo vehicles and buses - m 1,1-1,2;

for large-capacity (off-road) cars dump trucks - m 0,5-0,7.

5.6. In case of parallel arrangement of deadlock viewing ditches they unite trenches.

Width of trench is accepted by equal 1,2 of m without placement in it of the equipment and 2,0-2,2 of m in case of placement of the equipment.

5.7. In case of parallel arrangement of travel viewing ditches the entrance and exit from them are performed through tunnel. Application of portable ladder with the platform which is at the same time and the transitional bridge is allowed.

Height to tunnel from floor to bottom of overlapping shall constitute at least 2 m, and width, to tunnel - at least 1 m.

5.8. Viewing ditches for entrance to them and exit are equipped with ladder width of at least 0,7 of m in quantity:

for the deadlock viewing ditches combined by trenches - it is at least of one on three ditches; for the individual travel survey ditches combined by tunnels - it is at least of one on four ditches;

for travel viewing ditches of the current lines - at least two to each current line, located from counter parties (the distance to the next exit shall be no more than 25 m);

for the deadlock viewing ditches which are not combined by trenches - one on each ditch.

5.9. Trenches and exits from them and tunnels, the ladder and platforms of platforms shall have barrier metal handrail height of at least 0,9 of m.

5.10. Entrances (exits) of viewing ditches, trenches and tunnels, shall not be located under cars and on the ways of their movement.

5.11. Exit (entrance) from odinpostovy deadlock survey ditch to the room on step ladder shall be from outside, opposite arrival of the car.

5.12. In the presence of one exit the ditch is in addition equipped with the brackets fixed in its wall for emergency exit.

5.13. For safe exit of the driver from the vehicle and landing of platform at it shall be equipped with platforms width equal to width of doors of vehicles, plus m 0,3, but m 1,2 suffices.

The Perilny barrier on deadlock platforms is equipped from three parties, and on direct-flow - from two, with height of at least 0,9 of m.

For lifting on platform and sinking from it it is necessary to equip ladder.

5.14. Viewing ditches, trenches, tunnels, ladder, shall be protected from moisture and ground waters, be kept clean, not be encumbered with details and different objects. At the bottom (floor) of ditch needs to conclude strong wooden lattices (ladders).

5.15. Walls of viewing ditches, trenches and tunnels, shall revet with ceramic tile of light tones. Floors in ditches, trenches and tunnels, shall have bias of 2% of the main entrance for water drain down.

5.16. Viewing ditches and platforms, except for the ditches equipped with belt conveyers shall have the directing flanges at all their length for the prevention of fall of the car ditch or from platform during its movement.

Height flange shall constitute: for vehicles I of category m 0,1 suffices, and for vehicles II and III of categories m 0,15 suffices.

5.17. On entrance part of viewing ditch it is necessary to provide rassekatel m 0,15-0,20 height.

5.18. Deadlock viewing ditches shall be equipped with stationary kolesootboyny devices for vehicle wheels according to Item 3.3 of Chapter 3 of this Section.

5.19. In places of transition viewing ditches and trenches shall have removable transitional bridges width of at least 0,8 of m.

The number of transitional bridges shall be one less from the number of places for establishment on ditch of vehicles.

6. Requirements to control and technical Items

6.1. The control and technical Item (further - KTP) shall have:

the room for the controller (mechanic) of technical condition of vehicles;

the room (canopy) and survey ditches or platforms for the overview of vehicles.

6.2. Viewing ditches and platforms shall be executed according to requirements of Chapter 5 of this Section.

The entrance to viewing ditch and exit from it shall be located sideways from drives.

6.3. The bias in case of arrival and congress from KTP shall not exceed 5%.

6.4. On entrance to KTP route signs shall be hung out: "Journey is without stopping prohibited", "Maximum speed limit - 10 km/h".

7. Requirements to entrances and departures

7.1. Gate of the main entrance on the territory of the company it is necessary to have at distance at least greatest length of vehicles which are operated at the company, including avtopoyezda, from the main journey of the street, the road.

7.2. Width of entrance gate on the territory of the company needs to be accepted behind the greatest width of vehicles which are used, plus m 1,5, but m 4,5 suffices.
