Approve the enclosed Regulations on licensing of production of civil and office weapon and cartridges to it, developed RAV, Rosboyepripasa and the Ministry of Internal Affairs of Russia and approved with Gosstandart of Russia and the Ministry of Culture of the Russian Federation.

Regulations on licensing of production of civil and office weapon and cartridges to it

I. General provisions

1.1. This Regulations on licensing of production of civil and office weapon and cartridges to it (further - the Provision) establish organization-legal bases and rules of licensing of production of civil and office weapon and cartridges to it (further - weapon) in the territory of the Russian Federation, and also the main licensed requirements imposed to production of weapon.

1.2. The provision is developed according to the Federal Law of December 13, 1996 N150-FZ "About Weapon" (The Russian Federation Code, 1996, N 51, the Art. 5681) and the order of the Government of the Russian Federation of July 21, 1998 N814 "About Measures for Regulation of Turnover of Civil and Office Weapon and Cartridges to It in the Territory of the Russian Federation". 1.3. Licensing of production of weapon includes the actions connected with issue of licenses, renewal of the documents confirming availability of licenses, suspension and cancellation of licenses and supervision of licensing authorities of observance by licensees of the requirements and conditions established by regulatory legal acts which accomplishment is obligatory in case of accomplishment of the licensed type of activity.

1.4. Licensing of production of weapon is directed on:

a) control of production of weapon in the territory of the Russian Federation;

b) creation by the manufacturer of weapon of the conditions of production providing:

high-quality production of weapon, safe in the course of its operation;

control and safety of production process of weapon;

safety and accounting of weapon in the course of production, storage and realization.

1.5. Subjects of licensing are legal entities, irrespective of their form of business (except for the state paramilitary organizations), performing or having intention to perform production of civil and (or) office weapon, the main parts to firearms, cartridges and (or) their components (sleeves, caps, gunpowder, bullets, fraction and case-shot).

1.6. Issue, renewal and prolongation of effective period of the license are performed by the Russian Agency for Conventional Armaments (RAV) or the Russian Munitions Agency (Rosboyepripasa) within their competence (further - the agencies) in coordination with the Ministry of Internal Affairs of Russia based on the written application of the head of the organization - the license applicant (appendix 1).

The documents confirming the right to the license are enclosed to the application:

a) copies of constituent documents and copy of the certificate on state registration;

b) the certificate of registration in tax authority;

c) the explanatory note about structure and nature of the organized production;

d) the copy of the lease agreement on the property necessary for realization of the corresponding type of activity (in case of absence or lack of own production capacities);

e) the conclusion of local authorities of the state sanitary and fire inspection about possibility of implementation of the declared type of activity;

e) the conclusions of the specialized expert organizations for the production of weapon and cartridges requiring observance of special conditions (production of firearms, cartridges, caps, gunpowder, electroconvulsive devices);
