About approval of the Regulations on clinical bases of the medical organizations of education

1. Approve the enclosed Regulations on clinical bases of the medical organizations of education (further - the Provision).

2. To heads of the medical organizations of education, chiefs of managements of health care of areas, cities of Astana, Almaty (under approval) to carry out work on the organization of clinical bases according to the enclosed Provision.

3. To department of science and human resources of the Ministry of Health of the Republic of Kazakhstan (to Teleuov M. K.) provide in the established legislative procedure state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

4. To department of legal service of the Ministry of Health of the Republic of Kazakhstan (Danayeva Zh. Zh.) provide official publication of this order in mass media after its state registration.

5. To strategic development department of the Ministry of Health of the Republic of Kazakhstan (to Tokezhanov B. T.) provide placement of this order on the Internet resources.

6. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Bayzhunusov E. A.

7. This order becomes effective from the date of its first official publication.

Regulations on clinical bases of the organizations of medical education

1. General provisions

1. This Provision is developed according to the Law of the Republic of Kazakhstan "About education" of July 27, 2007, the Code of the Republic of Kazakhstan "About health of the people and health care system" of September 18, 2009 and regulates activities and legal status of clinical bases of the organizations of medical education.

2. Clinical bases - clinical divisions (clinics) of the organizations of medical education, and also the organizations of health care providing the corresponding conditions for preparation of medical and pharmaceutical personnel under contracts with the organizations of medical education.

3. Relations between the organization of medical education and the organization of health care which is clinical base are regulated by this Provision and the cooperation agreement signed between them according to the Standard agreement about joint activities (Appendix to this Order).

4. The organization of health care which is clinical base in the activities is guided by the current legislation of the Republic of Kazakhstan, this Provision, articles of organization of health care and cooperation agreements signed with the organizations of medical education.

5. Clinic of the organization of medical education - the structural division of the organization of medical education performing clinical training of students and rendering medical services on the basis of modern methods of organizatsionnometodichesky, educational, medical and diagnostic and research work.

6. The clinic of the organization of medical education in the activities is guided by the current legislation of the Republic of Kazakhstan, this Provision, the charter and internal organizational and administrative acts of the organization of medical education.

7. The structure, profile, capacity of departments and the number of staff of clinic of the organization of medical education affirm the rector of the organization of medical education taking into account requirement of educational process.

2. Main objectives and functions of clinical bases

8. The main objectives of clinical bases are:

1) rendering medical services according to profile of clinical base;

2) creation of conditions for preparation, retraining and advanced training of employees of clinical base and learning organizations of medical education with use of modern forms and training methods, achievements of medical science and practical health care;

3) quality assurance of clinical preparation of learning organizations of medical education;

4) implementation of research activities in the field of health care together with operating units of the organizations of medical education;

5) creation of necessary conditions for implementation of results of research activities in practical health care, and also in process of clinical training of students.

9. For the solution of objectives clinical bases perform the following functions:

1) the organization of joint operation of clinical departments, laboratories and other auxiliary divisions of clinical base with profile departments / rates / modules of the organizations of medical education;

2) organization and ensuring retraining and advanced training of health workers of clinical base;

3) provision of medical services to patients;

4) accomplishment of research works together with operating units of the organizations of medical education;

5) ensuring developments and carrying out in accordance with the established procedure clinical testing, new effective methods of diagnostics, treatment, rehabilitation of patients;

6) holding clinical, scientific and practical and pathoanatomical conferences, seminars, master classes, consultations, clinical analyses and other actions;

7) publication of joint scientific and technical works and scientific and medical developments, benefits;

8) the organization of work on joint use of medical equipment and the products of medical purpose of clinical base and the medical organization of education used in medical, educational or scientific activities in the territory of clinical base;

9) creation of necessary conditions for carrying out educational process and nauchnoissledovatelsky works by operating units of the medical organizations of education, including:

- provision to the medical organizations of education educational, lecture and auxiliary (locker room for students, laboratorian rooms) rooms;

- providing the admission of research and educational personnel and students to patients and in specialized departments of clinical base, including the operational block, intensive care unit and intensive therapy, according to requirements of educational process and the procedure established by internal organizational and administrative documents of clinical base, except as specified when the admission of students is not allowed to medical process by the current legislation and/or requirements of patients;

- provision of the right of maintaining medical documentation by scientific and pedagogical employees (teachers) of the medical organization of education in case of accomplishment of medical and diagnostic work by them, and also opportunities the student to carry out entries in medical documentation under control and under responsibility of teachers, for the purpose of forming and development in the studying competences of practical (clinical) work oriented to high quality of the rendered medical services and individual approach to each patient;

- provision of the medical organization of formation of access to medical documentation, statistical data and archive documents, with observance of the confidentiality terms provided by the current legislation concerning information on physical persons (patients);

- material logistics of industrial practice process and joint research operations;

- providing to workers and students of the medical organizations of formation of healthy and safe working conditions according to the current legislation in case of accomplishment of any kinds of work in the territory of clinical base;

- holding organizational and technical actions for safety and labor protection;

- provision to scientific and pedagogical workers and students of the medical organizations of formation of the individual protection equipment necessary for work in specialized departments of clinical base;

- acquaintance of health and scientific and pedagogical workers with the job descriptions and regulations and other internal organizatsionnorasporyaditelny acts of clinical base concerning procedure of medical activities.

3. Management of clinical bases

10. The common directorship and control of clinic of the organization of medical education is exercised of its governing bodies and the head of clinic within the powers conferred by the current legislation, the charter and internal organizatsionnorasporyaditelny acts of the organization of medical education.

11. Head of clinical base:

1) is guided in the work as regulatory legal acts of the Republic of Kazakhstan in the field of protection of public health and education, the charter of the medical organization of education, this Provision and the job description;

2) can be the employee of the organization of medical education in combination;

3) is part of Clinical council and the Academic council of the medical organizations of education;

4) coordinates operation of departments/rates/modules concerning medical and diagnostic activities together with heads of departments/rates/modules;

5) is controlled together with the vice rector for clinical work by amount of the performed medical and advisory work as workers of departments/rates/module;

6) makes offers and informs on condition of medical work of clinical bases at meetings of clinical council of the medical organization of education;

7) performs administrative functions.

12. The head of clinical base, managers of departments, the doctors and other skilled workers of clinical base having the highest or first qualification category can hold paid established posts of professorskoprepodavatelsky structure in the medical organizations of education assigned to clinical base on the terms of regular combining jobs (no more 0,5 of rate) or for the period of accomplishment of certain work.

13. Manager of the department / rate/module:

1) performs management of pedagogical, organizational and methodical, nauchnoissledovatelsky and medical and diagnostic activities of the department / rate/module;

2) interacts with the head of clinical base and his deputies for questions of rendering the medical and diagnostic, advisory help and the organization of educational process;

3) carries out planned bypasses of departments, advises patients, draws up the plan of their inspection and treatment;

4) distributes medical loading and pedagogical loading between workers of the department/rate/module;

5) carries out organizational and methodical work on increase in professional level of doctors of clinical base (clinical scientific and practical seminars, pathoanatomical conferences and discussion of reports).

14. The manager of the department/rate/module together with the head of clinical base:

1) exercise control of accomplishment of medical work of employees of department and the department/rate/module, approve sheets of accounting of working hours of scientific and pedagogical workers;

2) provide participation of doctors and scientific and pedagogical workers in scientific research;

3) submit the joint activities report of clinical base in higher bodies.

4. Financing of clinic of the organization of medical education

15. Activities of clinic shall be based on the principles of self-financing and self-sufficiency due to the medical services rendered at the expense of budgetary funds within the guaranteed amount of free medical care, employees involvement of clinic in research projects of the medical organization of education, expansion of types and forms of international cooperation and also due to expansion of range of paid medical services of clinical bases according to opportunities of the clinical organization, and also according to the procedure and with observance of requirements of the current legislation.

The clinical base of the organization of medical education bears responsibility for timely and high-quality rendering paid medical services to citizens from the moment of their address according to the procedure, established by the laws of the Republic of Kazakhstan.

16. Financing of clinic of the organization of medical education is performed by the medical organization of education from the following sources:

1) the income from rendering medical services within the guaranteed amount of free medical care to the population;

2) budget financing of the state educational order within the standard rates approved by authorized body in the field of health care;

3) financings of scientific and (or) scientific and technical activities from the government budget in forms, stipulated by the legislation about science;

4) the income from rendering the paid educational services and other income of the organization of medical education which is not prohibited by the legislation of the Republic of Kazakhstan;

5) income from rendering paid medical services by clinic;

6) the income arriving from the sponsor's and charitable help including from foreign partners within international cooperation;

7) the income arriving from other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

5. Standard rate of medical loading and mode of working hours of scientific and pedagogical employees of clinical bases

17. The standard rate of medical and diagnostic and advisory work of scientific and pedagogical employees of the medical organizations of education on clinical bases constitutes:

- 50% of load of the doctor of the corresponding specialty, - for associate professors and assistants to departments / rates/modules;

- no more than 30 hours in month of advisory work, - for managers of departments/rates/modules and professors.

18. The standard rate of medical and diagnostic and advisory work determines amount of the medical loading which is carried out by scientific and pedagogical workers in departments of clinical base without fail for the purpose of ensuring educational process with payment from the salary fund of the medical organization of education (in the form of surcharge to official pay rate of the scientific and pedagogical worker).

19. Over above the specified standard rate of medical and diagnostic and advisory work, scientific and pedagogical employees of the medical organizations of education are allowed to accomplishment of medical and diagnostic and advisory work in departments of clinical base on condition of execution of an employment agreement about part-time job between clinical base and the worker according to the procedure, established by the existing labor law, with salary payment from the salary fund of clinical base.

20. The mode of working hours of scientific and pedagogical employees of the organization of medical education is set according to the working schedule of the relevant department / rate / module approved by the head of the department/rate/module and the head of the relevant department of clinical base.

21. For the purpose of optimization of manpower ceiling, improvement of quality of scientific, educational and clinical work of the organizations of health care which are clinical bases and the medical organizations of education, heads of departments/rates/modules of the medical organizations of education at the same time can hold paid established posts of heads the relevant departments of the organizations of health care which are clinical bases on working conditions in combination, with the corresponding reduction of amount of pedagogical and medical loading.

22. For the purpose of optimization of manpower ceiling, improvement of quality of scientific, educational and clinical work, in clinics of the organizations of medical education the integrated positions providing simultaneous accomplishment of functions can be entered:

- head of the department/rate/module and head of the relevant department;

- associate professor, assistant to the department / rate/module and doctor of department.

23. The amount of medical and pedagogical load of the workers holding the integrated positions is established taking into account the approved standard rates and with observance of the working schedule of the department/rate/module and duration of working hours established by the existing labor law and internal organizational and administrative acts of the medical organization of education and the medical organization.
