1. Approve the enclosed Regulations on licensing of the activities connected with attraction to the Republic of Belarus of foreign labor power and employment of citizens of the Republic of Belarus abroad.

2. To the Ministry of Labour and Social Protection to bring the regulatory legal acts into accord with this resolution.

3. This resolution becomes effective since November 1, 2003.

Regulations on licensing of the activities connected with attraction to the Republic of Belarus of foreign labor power and employment of citizens of the Republic of Belarus abroad

This Provision is developed according to the Decree of the President of the Republic of Belarus of July 14, 2003 No. 17 "About licensing of separate types of activity" (The national register of legal acts of the Republic of Belarus, 2003, No. 79, 1/4779), the Law of the Republic of Belarus of June 17, 1998 "About external labor migration" (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1998, Art. No. 25-26, 430).

The terms and determinations used in this Provision are used in the values determined in Regulations on the licensing of separate types of activity approved by the Decree of the President of the Republic of Belarus of July 14, 2003 No. 17 and in the Law of the Republic of Belarus of June 17, 1998 "About external labor migration".

2. This Provision is obligatory for all legal entities and individual entrepreneurs who are performing or having intention to perform the activities connected with attraction to the Republic of Belarus of foreign labor power and employment of citizens of the Republic of Belarus abroad.

3. The activities connected with attraction to the Republic of Belarus of foreign labor power and employment of citizens of the Republic of Belarus abroad have the constituting works and services:

attraction to the Republic of Belarus foreign labor power;

employment of citizens of the Republic of Belarus abroad.

4. The activities connected with attraction of foreign labor power are understood as employment of the foreign citizens and stateless persons who are constantly living outside the Republic of Belarus (further - foreigners), for performance of work in the Republic of Belarus, providing the conclusion with these foreigners of the employment contract (contract), except for attraction of categories of the foreign citizens and stateless persons specified in part two of article 1 of the Law of the Republic of Belarus "About external labor migration".

5. The activities connected with employment of citizens of the Republic of Belarus abroad are understood as any actions, including single, providing departure of citizens the Republic of Belarus for work abroad including rendering services to these citizens about assistance in employment at the foreign employer outside the Republic of Belarus, receipt of the work permit in foreign state, execution of an employment agreement with the foreign employer.

6. License applicants on implementation of the activities connected with employment of citizens of the Republic of Belarus abroad are only legal entities of the Republic of Belarus and individual entrepreneurs registered in accordance with the established procedure and performing the activities in the territory of the Republic of Belarus.

On implementation of the activities connected with attraction to the Republic of Belarus of foreign labor power legal entities of the Republic of Belarus and individual entrepreneurs, and also the foreign legal entities fully or partially performing the activities in the territory of the Republic of Belarus, except for the foreign legal entities sending to the Republic of Belarus the workers for installation (supervision of erection) of the equipment delivered by them can be license applicants.

7. The following licensed requirements and conditions are imposed to license applicants on implementation of the activities connected with employment of citizens of the Republic of Belarus abroad:
