1. Approve enclosed:

Regulations on licensing of lottery activities;

Regulations on licensing of the activities connected with precious metals and gemstones.

Regulations on licensing of auditor activities

1. This Provision is developed according to the Decree of the President of the Republic of Belarus of July 14, 2003 No. 17 "About licensing of separate types of activity" (The national register of legal acts of the Republic of Belarus, 2003, No. 79, 1/4779) (further the Decree) and the Law of the Republic of Belarus of November 8, 1994 "About auditor activities" (Vyarkho¸naga Savet's Vedamastsi of Respubliki Belarus, 1994, No. 35, of the Art. 573) (further - the Law).

2. Issue of special permissions (licenses) for auditor activities (further - licenses), their duplicates, modification and (or) amendments in licenses, suspension, renewal, prolongation of effective period of licenses, the termination of their action, control of observance by licensees of the legislation on implementation of auditor activities (further - the licensed activities) is performed by the Ministry of Finance (further - the Ministry of Finance) according to the Decree and this Provision.

3. In this Provision the main terms and determinations in the values established by the Decree and the Law are used.

4. The licensed activities are performed by legal entities (their separate divisions (branches), individual entrepreneurs, the foreign organizations (their representations) (further - licensees).

5. Licenses act on all territory of the Republic of Belarus.

6. The license is granted for a period of 5 years. The license validity after its termination can be extended according to the statement of the licensee for 5 years.

7. Licensed requirements and conditions:

7.1. the licensed requirements and conditions shown to the license applicant in case of its issue are:

to the individual entrepreneur:

availability of the competence certificate of the auditor;

length of service at least two years from the last five before the request for receipt of the license as the auditor in auditing organization or at the auditor - the individual entrepreneur or the auditoromindividualny entrepreneur;

to the legal entity:

availability in staff of the legal entity (its separate division (branch), the foreign organization (its representation) of at least three auditors, including the head for which this organization is principle place of employment. The auditor having length of service at least two years as the auditor in auditing organization or at the auditor - the individual entrepreneur or the auditor - the individual entrepreneur can be the head of auditing organization. The citizens of the Republic of Belarus who are constantly living in the territory of the Republic of Belarus and if the head of auditing organization is the foreign citizen, - at least 75 percent shall constitute at least 50 percent of employees of auditing organization;

7.2. the licensed requirements and conditions shown to the licensee when implementing of auditor activities by it are:

advanced training according to the procedure, established by the legislation of the Republic of Belarus;

observance of the requirements and conditions established by the legal acts of the Republic of Belarus regulating auditor activities;

7.3. special requirements and conditions when implementing auditor activities are:

carrying out statutory audit by the licensee after liability insurance for agreement breach of rendering auditor services;

rendering auditor services only the workers who are on the staff of the licensee.

7-1. Or the established requirements and conditions of implementation of the licensed type of activity treat gross violations by the licensee of the legislation on licensing:

absence in staff of auditing organization of the head and (or) the number of auditors established by the legislation more than three months in a row;
