About approval of Instructions for use electrical energy
For the purpose of establishment of procedure for use of electrical energy and determination of relations of the electrosupplying organization with consumers the Government of the Kyrgyz Republic decides:
1. Approve Instructions for use by electrical energy according to appendix.
2. This resolution becomes effective after 15 days from the date of official publication.

These rules of use of electrical energy (further - Rules) are developed according to the Civil code of the Kyrgyz Republic, the laws of the Kyrgyz Republic "About power", "About power industry", "About consumer protection" and determine relations of the consumers of electrical energy electrosupplying and the electrotransferring organizations.
These rules act on all territory of the Kyrgyz Republic and are obligatory for the legal entities and physical persons performing activities for development, transfer, distribution, sale or consumption of electrical energy, and also designing and installation of means of accounting of electrical energy irrespective of legal form and pattern of ownership.
1. In these rules the following terms, determinations and reducings are used:
Emergency armor - the smallest connected capacity or the expense of electrical energy ensuring in case of partial or complete stop of the company safety of people, safety of the equipment, work of emergency and security lighting, ventilation, water outflow, the sewerage, circulation pulsers of systems of heating and means of fire safety.
Emergency unloading of power system - operating mode of power system in case of which reduction of capacity of power consumption is made for the prevention of violation of stability of work of the National power system of the Kyrgyz Republic and damage of the electric equipment.
The automated system of commercial accounting of electrical energy (further - ASKUE) - the system consisting of complex of the specialized, metrological certified technical means, software, means of communication allowing to make commercial accounting of electrical energy, data transmission of commercial accounting, their processing in the automated mode including reliability assessment, possibility of data exchange. ASKUE can be added with system of documentation, including use of the digital signature.
The block station - the power plant of the consumer included directly or through power networks of other consumers to power networks of the National power system of the Kyrgyz Republic and submitting to its dispatching management.
The household subscriber (consumer) - the citizen using energy under the agreement of power supply for own domestic needs.
Border of property or balance sheet accessory - the line of the Section of utility power system between owners (users).
Limit of operational responsibility - the line of the Section of utility power system between owners (users) responsible for ensuring proper technical condition and safety of its elements established according to the legislation of the Kyrgyz Republic and reflected in the agreement.
Zone of operational responsibility - the part of utility power system located between property border (balance sheet accessory) and limit of operational responsibility.
The agreement (Contract) - the agreement on the electric utility service, delivery, sale or transfer of electrical energy determining the rights, obligations and responsibility between the subjects who imprisoned him.
Additional terms are applied only after the decision of authorized state body of the Kyrgyz Republic in the field of power.
Contractual capacity - the capacity permitted to consumption on the conditions specified in the Agreement (Contract).
Measuring system - the set definitely the measuring instruments (transformers of tension and transformers of current) connected among themselves and other technical devices (the components of system forming the measuring channel) realizing process of measurements with the normalized accuracy and providing results of the measurements expressed in legalized units of physical quantities.
The integrated organizations - the organizations performing more than one the licensed activities in the field of power industry.
Control means of commercial accounting of electrical energy and capacity (control means of commercial accounting) - set of metrological certified measuring devices and metering devices of electrical energy and capacity entered in the register of gages of the Kyrgyz Republic based on which indications in point of accounting the expense of electrical energy and the power consumption used for control of means of commercial accounting is determined.
Control means of commercial accounting can replace means of commercial accounting, in case of their exit out of operation.
The class of accuracy of the applied means of accounting shall conform to requirements imposed to means of commercial accounting.
The licensee of electrical power activities (further - the licensee) - the physical person or legal entity performing activities for export, import of electrical energy, and also production, transfer, distribution or sale of electrical energy based on the license obtained on the corresponding type of activity according to the legislation of the Kyrgyz Republic.
Maximum of loading of the National power system of the Kyrgyz Republic - periods of time of the greatest value of active loading.
National power grid - system of transmission media of electrical energy of high voltage.
National power system of the Kyrgyz Republic - the existing complex of power plants, power networks, including, the National power grid, connected by community of operating mode and having the centralized operational management exercised of dispatching service.
The independent supplier - the physical person or legal entity having power networks and (or) stations in the property, management and (or) economic maintaining, and (or) guaranteeing execution of the obligations by introduction of the deposit on the settlement account of authorized bank in the amount of fee on transfer of electrical energy to settlement period, and performing delivery (sale) of electrical energy at the non-regulated price to free consumers through power networks of the electrotransferring and (or) electrosupplying organization, and having license for the corresponding type of activity according to the legislation of the Kyrgyz Republic.
Non-regulated rate - contract price on the electric power delivered on the market by the independent supplier, which amounts and minimum price on which are established by authorized state body of the Kyrgyz Republic in the field of power.
Final settlement - calculation for the consumed energy and capacity, and (or) services in transfer of electrical energy after the settlement period determined by terms of the contract (Contract).
The wholesale buyer seller - the physical person or legal entity having power networks in the property, performing wholesale purchase of electrical energy, its distribution, transfer and sale and having the license for the corresponding type of activity according to the legislation of the Kyrgyz Republic.
The main consumer - the buyer of electrical energy and capacity from power network of high voltage it is direct at the developing company.
Having rummaged in giving of electrical energy - interruption in supply of electrical energy in connection point, except for the break caused by successful operation of automatic devices or shutdown of the line (lines) of electricity transmission, not leading to restriction of consumption of electrical energy and the capacity established by the Agreement (Contract).
The payment document - the invoice, the payment order, the account based on which financial calculations between agreement parties (Contract) are made.
The supplier (seller) of electrical energy - the physical person or legal entity performing delivery (sale) of the developed and (or) purchased electrical energy to the electrosupplying organizations, consumers resellers and wholesale buyers sellers on regulated rate and having the license for the corresponding type of activity, according to the legislation of the Kyrgyz Republic.
The consumer (further - the consumer) - the physical person or legal entity, power networks or receivers of electrical energy of which are directly attached to power networks of the electrosupplying organization, and the Agreement (Contract) for the electric utility service having with it.
The consumer reseller - the physical person or legal entity having power networks in the property, performing purchase of electrical energy and capacity from the electrosupplying organizations and (or) suppliers for own consumption and for sale on regulated rate and having the license for the corresponding type of activity according to the legislation of the Kyrgyz Republic.
Advance payment - advance payment for the electric power and (or) the capacity and (or) services in transfer of electrical energy determined by terms of the contract (Contract).
The metering device of electrical energy (counter) - metrological certified device for measurement of quantity of the electrical energy moved on element of power network and, as a rule, the registering half-hour value of capacity.
The receiver of electrical energy - installation or the device intended for acceptance, transformation and use of electrical energy.
Intermediate calculation - payment of the consumed electrical energy and capacity and (or) service in transfer of electrical energy during the settlement period based on indications of means of the commercial accounting of electrical energy determined by terms of the contract (Contract).
The permitted capacity - capacity which permitted size is specified in specifications connection.
The settlement period is period of time for which the consumed electrical energy and capacity and (or) service in transfer of electrical energy for payment shall be considered.
Regulated rate - the rate for electrical energy and capacity and (or) rendering services in transfer of electrical energy on any power networks established by authorized state body of the Kyrgyz Republic in the field of power with the consent of Jogorku Kenesh of the Kyrgyz Republic.
The free consumer - the physical person or legal entity buying electrical energy and capacity from the independent supplier.
Means of commercial accounting of electrical energy and capacity (means of commercial accounting) set of the metrological certified measuring devices and metering devices of electrical energy and capacity entered in the State register of measuring instruments of the Kyrgyz Republic based on which indications in point of accounting it is determined the expense of electrical energy and capacity which are subject to payment.
Means of accounting of electrical energy - set of measuring devices and metering devices of electrical energy.
The term of limitation period - limitation period is recognized term for protection of the right in the claim of person which rights are violated. Aggregate term of limitation period is established according to the legislation of the Kyrgyz Republic.
The subconsumer (subsubscriber) - physical person or legal entity which power networks are directly connected to power networks of the main consumer and having Contract (Contract) for electric utility service with the electrosupplying organization or the supplier.
Rate for electrical energy and capacity - system of rates at which make calculation for the consumed electrical energy and capacity.
Technological armor of electric utility service - the smallest power consumption and (or) expense of electrical energy and duration of time necessary for completion of engineering procedure, production cycle then the corresponding receivers of electrical energy can be switched-off.
Connection point - the approved point of physical connection of power networks and (or) the distributing device of the power plants belonging to different owners.
Consumption point - the point of connection of the receiver of electrical energy of the consumer to electric posting of apartment houses established on sockets or electric cartridges of lighting lamps (it is applied only to household subscribers).
Point of accounting of expense of electrical energy (delivery point) - connection point, as a rule, in which by commercial accounting the maximum value of capacity and quantity of the consumed electrical energy used in case of commercial calculations are determined. The accounting point, as a rule, shall be on border of property and be specified in the Agreement (Contract).
Specifications (further - TU) - the document regulating amount of execution by the receiver of the technical requirements obligatory for connection to power networks and distributing devices of power plants.
Installed capacity of electric receivers of the consumer of electrical energy (further - installed capacity) - the amount of passport values of the electric receivers established at the consumer and connected to power networks.
Force majeur circumstances - the events caused by circumstances extraordinary and insuperable in this situation which action cannot be anticipated by means of practice of highly professional personnel.
The electrotransferring organization - the physical person or legal entity performing activities for transfer of electrical energy for power networks and (or) distributing devices of power plants which are in its property, for regulated rates and having the license for the corresponding type of activity, according to the legislation of the Kyrgyz Republic.
The electrosupplying organization - the physical person or legal entity performing activities for distribution and (or) sale of electrical energy and capacity for regulated rate, owning power networks or which are in its management or complete economic maintaining, and having the license for the corresponding type of activity, according to the legislation of the Kyrgyz Republic.
Electric utility service - sale of electrical energy and capacity to the consumer electrosupplying with the organization.
2. The legal entities and physical persons wishing to make electrical energy for own use in limits to 1000 kW do not need the license for production. In case of capacity more than 1000 kW they shall obtain the license of authorized state body of the Kyrgyz Republic in the field of power.
The legal entities and physical persons making electrical energy for own needs are forbidden to perform connection to National energy network of the Kyrgyz Republic, and also sale of electrical energy to the third parties without the corresponding permission.
3. Use of electrical energy is performed based on the Agreement (Contract) which is signed between the electrosupplying organization and the consumer of electrical energy (The Standard agreement on electric power supply to residential customers) - (appendix 2), (The contract for electric power supply to not residential customers) - (appendix 1).
Appendices to the Agreement and the Contract are its integral parts.
The changes which are not contradicting these rules and the legislation of the Kyrgyz Republic can be made to appendix to the Contract, in the consent of the parties.
4. The agreement (Contract) contains data about other subconsumers (the name, capacity, power consumption, settlement electric meters, rates and other data) attached to networks of the consumer.
5. The conclusion, change, termination or treaty extension (Contract) for electric power supply are performed only according to requirements of the legislation of the Kyrgyz Republic and these rules.
6. Consumers who give electrical energy to subconsumers or release the electric power from the power plants (block stations), sign with the electrosupplying organization the Agreement (Contract) for the total (total) quantity of energy necessary for own consumption, taking into account leave of electrical energy to the subconsumer (subsubscriber).
Relations between consumers and subconsumers are regulated by the Agreements (Contracts) for electric power supply signed between them. In case of receipt by the consumer of the license for the right of implementation of business activity on transfer of electrical energy, further relations are regulated by conditions and rules of this license, agreements (contracts) for transfer of electrical energy and the Contract (Contract) between the subconsumer and the consumer for delivery of electrical energy. At the same time the consumer addresses the subconsumer as the electrosupplying organization.
6-1. Consumers whose power networks are technically not expected transmission of electricity over the contractual capacity having no right to transfer the electric power to other consumers on the networks.
The electrotransferring and electrosupplying organizations have no right to transfer the electric power to consumers on the power networks which technically are not expected accession of electroinstallations of consumers over contractual capacity.
7. Not resolved matters of argument between the consumer and the electrosupplying organization are solved according to the terms and procedures established by the legislation of the Kyrgyz Republic.
8. The state control and supervision of electroinstallations, irrespective of their form of business and patterns of ownership, is performed by authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy.
9. Authorized state body of the Kyrgyz Republic in the field of power regarding regulation of activities of licensees and authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy, and also their authorized representatives have right of access to the territory, to objects, and also documents of the Licensee for check of its licensed activities. At the same time, the Licensee shall give them necessary assistance for timely implementation of control activities.

22. All again entered or reconstructed electrical units shall be executed according to regulating documents on construction and the device of electrical units, are provided with the project documentation coordinated in accordance with the established procedure and technical acceptance documentation.
23. Before launch of electrical units in operation the new and reconstructed electrical units shall pass acceptance tests and to be accepted by the owner from the mounting and adjustment organization for the act. After that the owner with the assistance of the prime contractor provides to authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy necessary project and technical acceptance documentation, documentation on results of testing and measurements, and also possibility of technical inspection of the electrical unit. Survey of electrical units is drawn up by the act and in the absence of violations permission to the admission to operation which is drawn up in the form of the job specification on connection is issued.
24. Permission to the admission in operation of electric equipment is issued by authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy in the presence at the customer of person responsible for electric economy, and, if necessary, the corresponding electrotechnical personnel or the Service agreement of electrical units of the owner the specialized organization having the right to it.
25. The job specification on connection of again entered (reconstructed) electrical units is issued by authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy after the conclusion of the Contract with the organization to which power networks connection is made.
26. In the course of construction of the cable line, the customer shall show to the control and supervision inspector of authorized state body of the Kyrgyz Republic of production, transfer, distribution and consumption of electrical energy allowing documents for laying of cable and to get permission on:
1) acceptance of trench in expansion;
2) acceptance of the laid cable before filling.
27. Licensees and business entities which charters provide carrying out testing of electric equipment by electrotechnical laboratories for control of own equipment or for carrying out such works at other owners shall get permission in authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy for the admission of personnel to such works.
28. In case of identification in electroinstallations of consumers and licensees of shortcomings of installation, departures from the issued TU, variations from the project documentation, regulating documents on construction and the device of electroinstallations or in the absence of the prepared personnel for servicing of these installations, the admission of electroinstallations in operation before elimination of the found shortcomings is forbidden.
The admission in operation of autonomous sources of electric utility service which scheme of connection does not provide the automatic or manual device (cross over knife switch) excluding giving of tension in external network is forbidden.
29. The procedure for the admission in operation extends to again entered and reconstructed electroinstallations on all consumers and licensees tension to and it is higher than 1000 Century.
30. Electroinstallations of the consumer with temporality of work, after their shutdown are entered into work on the job specification on connection. The consumer shows to the representative of authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy test reports, measurements and electroinstallation for survey.
31. Connection of electroinstallation shall be executed by personnel of the organization to which power networks connection based on the job specification on connection, within 5 days from the date of its issue is made.
32. The authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy does not bear responsibility for damage of electroinstallations during their operation by the consumer.
33. The property border between the consumer and the licensee to which the consumer is connected is drawn up by the act of border of balance sheet accessory of power networks and operational responsibility of the parties between the consumer and the licensee which is the annex to the Agreement.
34. The property border between the residential customer and the licensee to which it is connected is established:
1) for apartment apartment houses in case of air input - on the insulators established on the building in case of underground input - on isolation centers or the bolt connection of the cable connected to the introduction device which is established in the house or in its isolated part;
2) for houses of individual building, and also gardening partnerships, building, garage and construction and country cooperatives, separate garages (boxes, other rooms) individually based on the act of the differentiation of property signed by the owner of the house or board of gardening partnership, building, garage and construction and country cooperatives and the licensee.
The act of differentiation of property is integral part of the Agreement.
35. The limit of responsibility between the licensee and the residential customer is established in point of consumption of electrical energy.
36. The property border in electroinstallations of 1000 V and is established above:
1) on connector of the insulator through passage of air-line from outer side of the closed distributing devices and at the wire exit from tension clip of portal ottyazhny garland of insulators of open distributing devices;
2) on tips of cable inputs of the feeding or departing lines.
Responsibility for technical condition of the above-stated connections is born by the organization in which property there is substation, the distributing device and power line.
37. The limit of responsibility for condition and servicing of power lines of 1000 V and above, having branches (deafs or via disconnectors) which belong to the different organizations, is established on support of the main line where tap is executed. Responsibility for condition of clips which attach tap is born by the organization, being the owner of the main line.
38. The consumer bears responsibility and ensures safety of means of accounting, the devices of automatic frequency unloading and other means of system automatic equipment established on its substations or distributing devices.
39. In case of operation of electroinstallations the consumer shall pay the cost of the services rendered by the licensee in the terms determined by these rules.
40. For the purpose of ensuring reliable, economic and safe operation of electric equipment the consumer shall:
1) to provide operation of the electrotechnical equipment according to requirements of manufacturing plants of the equipment and other normative and technical documents;
2) to enhance the scheme of electric utility service with removal of responsible loads of the feeding lines reserved external providing giving of tension for covering of technological and emergency armor when carrying out emergency unloadings in the National power supply system;
3) to provide independent reserve food for electric receivers of the first category;
4) to fulfill requirements of the licensee concerning characteristics and devices of relay protection and automatic equipment on electrotechnical consumer equipment;
To approve 5) with the licensee application of the scheme of automatic inclusion of reserve;
6) to observe operational discipline;
To make 7) according to the Agreement continuous, periodic or incidental control of indicators of quality of electrical energy on border of property of the parties, in cases when electroinstallations of the consumer influence quality of electrical energy;
8) to perform actions for improvement of quality of electrical energy in the networks;
9) to provide necessary accounting of electrical energy and capacity according to regulating documents on the device of electroinstallations, the Contract (Contract) and applicable fares for electrical energy;
10) to perform antiemergency, fire-proof actions and to observe safe engineering;
11) to make check of condition, preventive testing and repair of the electroinstallations and protective equipment belonging to it, and also repair of rooms of distributing devices and transformers in necessary amounts and in the corresponding terms;
12) not to allow non-accounting consumption of electrical energy;
13) to provide easy access according to their official IDs of representatives:
- authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy for control of rational use of electrical energy and supervision of the organization of technical operation and condition of the electrotechnical machinery and equipment of safety, condition and the organization of means of commercial accounting of electrical energy;
- authorized state body of the Kyrgyz Republic in the field of power behind observance of the licensed activities;
- the licensee with which there is Contract for electric utility service, delivery and (or) transfer of electrical energy, to point of consumption of electrical energy, and also to means of commercial accounting of electrical energy and capacity or ASKUE.
By results of check (visit) the above-stated representatives shall draw up the statement, acquaint with its content and to hand one copy of the act to the consumer, or its authorized person.
41. The consumer shall report immediately:
1) to the licensee about all violations in means of commercial accounting of electrical energy, about the accidents connected with shutdown of the feeding lines about all found defects of the electric equipment belonging to the licensee and being in the room or in the territory of the consumer;
2) in authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy about the accidents connected with damage of the capital equipment about defeats by electric current of people and animals, about the fires caused by defect of electroinstallations and also about the facts of contradictions of actions of personnel of the licensee to these rules;
3) in authorized state body of the Kyrgyz Republic in the field of power about violations by the licensee of conditions and rules of implementation of the licensed activities.
42. The consumer shall provide access of the licensee to personnel for accomplishment of operational switchings, to servicing of means of commercial accounting of electrical energy and antiemergency system automatic equipment, to performance of works, connected with construction (construction) and repair of the power networks of the licensee located in its territory or in electroinstallations of the consumer.
The organization performing works after their completion shall condition at own expense the room and the territory in which works were performed.
43. The consumer according to the legislation of the Kyrgyz Republic:
1) indemnifies material damage:
- caused by operation of the electrotechnical equipment which affected quality of electrical energy and led to failure to carry out by the licensee of terms of the contract with other consumers;
- arisen because of development of the emergency shutdowns which happened in networks of the licensee because of the consumer of electrical energy (failure of the device of relay protection and automatic equipment, switching equipment and other actions);
2) recovers power networks of third parties in case of their damage through his fault;
3) makes recovery, repair and replacement of means of commercial accounting of electrical energy in case of their damage through his fault.
44. In the presence of special conditions of production and the operation of electric equipment (underground, explosive productions, electrodraft) which is not considered by the relevant regulating documents on technical operation of electroinstallations of consumers and safe engineering in case of operation of electroinstallations of consumers, the Consumer shall have special maintenance instructions and to safe servicing of this equipment.
45. Conclusion in repair, and also inclusion after repair of power lines, distribution points and transformer substations of the electrotransferring organization through which power networks transmits electrical energy to other consumers en route is performed only with the permission of the organization performing transfer and (or) delivery of electrical energy according to the signed Agreement (Contract).
46. The licensee shall:
1) within 6 months to compensate to the consumer material costs on acquisition of materials, installation and repair of electric equipment which is in property of the licensee;
2) to provide regular electric utility service of the consumers having categorized electric receivers which external schemes of electric utility service meet the requirements of normative and technical documents;
3) to exercise control of indicators of quality of electrical energy in the and to perform actions for improvement of quality of electrical energy in power networks;
4) to provide accounting of electrical energy and capacity according to these rules and the signed Agreement (Contract);
5) to perform antiemergency, fire-proof actions and actions for safe engineering;
6) quickly to notify consumers on the violations connected with breaks in electric utility service, their reasons and terms of recovery of the normal mode of electric utility service about all defects of the equipment, devices of relay protection and automatic equipment feeding and the distribution lines of the consumer which are in the room or in the territory of the licensee;
To approve 7) with the consumer procedure for application of the schedule and amounts of restriction of consumption of electrical energy and capacity;
8) to coordinate with the consumer terms and duration of planned shutdowns;
To establish 9) in the Agreement (Contract) reasonable quantity and duration of breaks in giving of electrical energy as a result of emergency and planned shutdowns of the feeding power lines or other equipment if it leads to restrictions in operation of processing equipment of the consumer or to breaks in electric utility service;
10) to provide easy access according to official IDs of representatives:
- authorized state body of the Kyrgyz Republic on control and supervision of production, transfer, distribution and consumption of electrical energy - for control of rational use of electrical energy, supervision of the organization of technical operation and condition of the electrotechnical machinery and equipment of safety, condition of means of commercial accounting of electrical energy;
- authorized state body of the Kyrgyz Republic in the field of power - for control of observance of conditions of the licensed activities;
- the consumer with whom there is Agreement (Contract) for electric utility service and (or) transfer of electrical energy - to the means of commercial accounting of electrical energy and capacity or ASKUE belonging to the consumer.
The checking party shall be registered in the magazine of visit of the licensee, and to draw up results of check (visit) the act which one copy to hand to the licensee.
47. The licensee for residential customers ensures proper technical condition and safety of the power networks or common house property which are in property of the residential customer of electrical energy from border of property of the parties to consumption point.
Responsibility for condition of contact connections on border of property of power network in the houses belonging to the housing organizations, organizations and other non-productive consumers bears the licensee.
48. The licensee provides access for personnel of the consumer to servicing and repair of its electric equipment located in the territory of the licensee.
The personnel of the organization performing works after their completion shall condition at own expense the room and the territory in which works were performed.
49. The licensee bears responsibility and provides the quality of electrical energy on property border meeting the requirements of regulating documents to quality of electrical energy and according to the Agreement (Contract).
50. The licensee indemnifies to the consumer caused material damage for breaks in electric utility service through his fault.
Time of break is determined generally by documentation of the consumer and licensee from the moment of the termination or restriction of giving of electrical energy before establishment of necessary level of tension and frequency according to the Agreement (Contract).
51. 3) the conditions of restriction or interruption in supply of electrical energy to consumers provided in Chapter 10 of these rules and stipulated in the Agreement (Contract);
4) damage to machinery of the consumer which entailed shutdown of the feeding line;
5) violation by the consumer of the modes of consumption of electrical energy and the capacity specified in the Agreement (Contract).
