About approval of the Regulations on procedure for development and approval of lists of the international and regional standards, and in case of their absence - national (state) standards of the state members of the Customs union providing observance of requirements of the technical regulation of the Customs union and necessary for implementation of assessment (confirmation) of compliance
According to article 3 of the Agreement on the Eurasian economic commission of November 18, 2011 the Board of the Eurasian economic commission solved:
1. Approve the enclosed Regulations on procedure for development and approval of lists of the international and regional standards, and in case of their absence - national (state) standards of the state members of the Customs union providing observance of requirements of the technical regulation of the Customs union and necessary for implementation of assessment (confirmation) of compliance.
2. Recognize to invalid:
The decision of the Commission of the Customs union of April 7, 2011 N 629 "About Regulations on procedure for forming of lists of the international and regional (interstate) standards, and in case of their absence - the national (state) standards providing observance of requirements of the technical regulation of the Customs union and necessary for implementation of assessment (confirmation) of compliance";
The decision of Board of the Eurasian economic commission of May 31, 2012 N 57 "About modification of the Regulations on procedure for forming of lists of the international and regional (interstate) standards, and in case of their absence - the national (state) standards providing observance of requirements of the technical regulation of the Customs union and necessary for implementation of assessment (confirmation) of compliance".
3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

1. This Provision is developed for the purpose of implementation of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 (further - the Agreement), according to the Agreement on the Eurasian economic commission of November 18, 2011 and the Regulations of work of the Eurasian economic commission approved by the Supreme Eurasian economic council of November 18, 2011 N 1, and determines procedure for development and approval of lists of the international and regional standards, and in case of their absence - national (state) standards of the state members of the Customs union (further - state members) providing observance of requirements of the technical regulation of the Customs union (further - the technical regulation) and necessary for implementation of assessment (confirmation) of compliance.
For the purposes of assessment (confirmation) of compliance to the technical regulation the international, regional standards, and in case of their absence (before adoption of regional standards) - national (state) standards of state members can be applied.
2. Participants of the procedures provided by this Provision are:
a) authorized bodies on technical regulation of state members;
b) authorized bodies on standardization of state members;
c) authorized bodies in the field of ensuring unity of measurements of gosudarstvchlen;
d) developer of the draft of the technical regulation (further - developer) as which the body of state member or structural division of the Eurasian economic commission responsible for development of the technical regulation can act;
e) the bodies participating in project development of the technical regulation;
e) The Eurasian economic commission (further - the Commission);
g) Board of the Commission;
h) interested persons of state members, including technical committees on standardization, representatives of business community.
3. Drafts of lists of the standards providing observance of requirements of the technical regulation and necessary for implementation of assessment (confirmation) of compliance, the Agreements provided by Items 2 and 3 of Article 6 (further - drafts of lists), are developed on the basis of the offers prepared by developer along with the first edition of the draft of the technical regulation.
The developer together with authorized bodies on standardization of gosudarstvchlen starts project development of lists after completion of completion of the draft of the technical regulation following the results of public discussion and metrological examination according to Items 6 - 12 Regulations on procedure for development, acceptances, modification and cancellation of the technical regulation of the Customs union approved by the Decision of Council of the Eurasian economic commission of June 20, 2012 N 48.
The developer taking into account offers of the bodies participating in project development of the technical regulation, and authorized bodies on standardization of gosudarstvchlen if necessary creates the working group on project development of lists with inclusion of representatives of authorized bodies in it on standardization and interested persons of state members (further - working group). Information on forming and structure of the working group goes developer to the governments of state members and to the Commission.
4. Forming of drafts of lists is performed by inclusion of standards in them taking into account the following priorities:
a) the interstate standards accepted on the basis of the international and (or) regional standards;
b) the national (state) standards of state members accepted on the basis of the international and (or) regional standards;
c) the international and (or) regional standards (except for interstate standards) (in case of lack of the interstate and national standards accepted on the basis of the international and (or) regional standards);
d) the interstate and national (state) standards of gosudarstvchlen developed not on the basis of the international and (or) regional standards.
5. Exceptions of procedure for forming of drafts of lists constitute cases when standards do not answer the purpose of adoption of the technical regulation, including owing to climatic or geographical factors, technological and other features.
6. Drafts of lists are developed in forms according to the appendix N 1.
7. In case of project development of lists developer:
a) carries out the analysis of requirements of the technical regulation and constitutes the exhaustive list of objects of technical regulation which get to scope of the technical regulation;
b) carries out the analysis of standards for determination of possibility of providing as a result of their application of observance of requirements of the technical regulation and implementation of assessment (confirmation) of compliance taking into account the priorities determined in item 4 of this provision;
c) chooses for objects of technical regulation standards as a result of which application on voluntary basis observance of requirements of the technical regulation can be provided;
d) chooses for objects of technical regulation the standards containing rules and methods of researches (testing) and measurements, including rules of sampling which can be used for application and execution of requirements of the technical regulation and implementation of assessment (confirmation) of compliance.
8. Inclusion in drafts of lists of the standards specified in item 4 of this provision is performed with observance of the following conditions:
a) accomplishment of relevant requirements of the technical regulation shall be provided with application on voluntary basis of one or several standards, Sections, Items, subitems of the standard.
If there are no standards specified in subitems "an" - "in" item 4 of this provision, in coordination with authorized bodies on standardization of state members and the bodies participating in project development of the technical regulation from national (state) standards of gosudarstvchlen choose one national (state) standard which is most answering the purpose of the technical regulation;
b) observance of requirements of the technical regulation shall be provided with rules and methods of researches (testing) and measurements, including rules of sampling;
c) inclusion of standards in drafts of lists is performed on the basis of the carried-out analysis of standards which scope extends to objects of technical regulation of the draft of the technical regulation, and also standards on which references in the chosen standards, for determination of possibility of providing as a result of their application of observance of requirements of the technical regulation and implementation of assessment (confirmation) of compliance are had;
d) the standard providing observance of requirements of the technical regulation shall be provided with methods of researches (testing) and measurements.
9. The standards containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of requirements of the technical regulation and implementation of assessment (confirmation) of compliance join in the draft of the list according to Item 8 of this provision with observance of the following requirements:
a) the draft of the list joins the standards containing rules and methods of researches (testing) and measurements which shall provide possibility of application and execution of requirements of the technical regulation, and also evaluating (confirmations) compliance to the requirements established in it;
b) application of techniques of accomplishment of measurements, the certified state members, (validirovanny) according to the legislation, in the field of ensuring unity of measurements shall be provided in the standards containing rules or methods of researches (testing) and measurements;
c) the methods of researches (testing) and measurements containing in standards shall provide the necessary accuracy of measurements and reliability of results of measurements.
10. Financing of project development of lists is performed responsible for project development of the technical regulation as which the state member or the Commission acts.
11. After completion of project development of lists taking into account opinion of authorized bodies on standardization of state members the developer sends them to the Commission with the explanatory note and the notification on development in form according to the appendix N 2 (in electronic form and on paper).
12. The explanatory note to drafts of lists contains:
a) the short characteristic of the standards included in drafts of lists;
b) information on compliance of the standards included in drafts of lists, to the international and regional standards;
c) reasons for inclusion in drafts of lists of national (state) standards of state members;
d) information on requirements and objects of technical regulation of the technical regulation for which there are no standards providing observance of requirements of the technical regulation and containing rules and methods of researches (testing) and measurements, including rules of sampling;
e) offers on development of interstate standards;
e) the offers on updating of drafts of lists prepared based on results of monitoring by authorized bodies on standardization of gosudarstvchlen of development of the corresponding interstate standards, on form according to the appendix N 3;
g) summary information on methods of researches (testing) and measurements of the mandatory requirements established by the technical regulation of the Customs union on form according to the appendix N 4;
h) offers on updating of methods of measurements (testing) for assessment of conformity to the sanitary and epidemiologic and hygienic requirements provided by the draft of the technical regulation.
13. The commission provides placement of drafts of lists (with the explanatory note) on the official site of the Commission for public discussion within 30 calendar days. The term of public discussion can be prolonged according to the offer of the Commission or the governments of state members.
14. Notes (offers, responses) according to drafts of lists of interested persons of state members and the third countries go to the Commission which provides their placement on the official site of the Commission on the Internet in process of their receipt.
Notes (offers, responses) according to drafts of lists in process of their receipt, but no later than 10 working days after completion of public discussion, are transferred by the Commission to developer for completion of drafts of lists.
15. The developer within 15 working days from the date of receipt from the Commission of notes (offers, responses) together with authorized bodies on standardization of state members finishes drafts of lists and the explanatory note to them and represents them to the Commission together with the reference containing information on completion of drafts of lists following the results of public discussion.
16. The lists of standards approved in accordance with the established procedure by Board of the Commission are published on the official site of the Commission in the Internet.
17. Modification of the approved lists of standards based on offers of state members or the Commission is performed according to the procedure, provided for project development of lists.
18. The authorized body on standardization of state member which national (state) standards are included in the list of standards shall provide authorized bodies on standardization of other state members with official copies of these national (state) standards in Russian in electronic form.
19. Along with the publication of lists of standards on the official site of the Commission authorized bodies on standardization of gosudarstvchlen carry out work on development of interstate standards on the basis of national (state) standards of the state members included in lists of standards to the Internet.
20. The governments of state members provide preparation and submission to the Commission at least 1 time a year from the date of entry into force of the technical regulation of reasonable offers on updating of lists of standards based on results of monitoring of acceptance, application, updating and cancellation of the corresponding standards.
If the Commission is responsible for development of the corresponding technical regulation, the Board of the Commission based on offers of the governments of state members on updating of lists of standards provides preparation and approval of the staticized edition of lists of standards.
If the state member is responsible for development of the technical regulation, the Commission sends the offers on updating of lists of standards which arrived from the governments of state members to authorized body on standardization of this state member which provides preparation of the staticized edition of lists of standards.
The authorized body on standardization directs the staticized edition of lists of standards to the Commission which provides its approval in accordance with the established procedure.
If instead of the standards containing in lists of standards the developed and recently accepted interstate standards for the purpose of which application the transition period during which can be applied as the standards replaced, and replacing them is necessary join, the specified information is given in appendices to the staticized edition of lists of standards and drawn up in the form provided by the appendix N 3.
The staticized editions of lists of standards approved in accordance with the established procedure by Board of the Commission are published on the official site of the Commission in the Internet.
