About the state social order in the field of social servicing

Based on paragraphs of the fourth or seventh 8, of article 26 of the Law of the Republic of Belarus of May 22, 2000 No. 395-Z "About social servicing" the Council of Ministers of the Republic of Belarus DECIDES: Article parts three

1. Determine that forming of the state social order in the field of social servicing (further if other is not established, – the state social order) * is made by the state customer by preparation of the relevant activities of the state programs providing rendering social services and (or) implementation of social projects.

At the same time state customer:

monitoring of social and demographic situation in the region is performed;

the analysis of the problems revealed during monitoring in the field of social servicing with determination of the categories of the population needing rendering social services, creation of conditions for the solution of social problems, the list of social services which provision citizens, and their amount, social projects which implementation will allow to create conditions for the solution of social problems need is carried out;

the possibility of the solution of the revealed problems by means of the state social order on rendering social services and implementation of social projects is estimated;

potential contractors of the state social order are determined;

ways of financing of the state social order are determined;

the amounts of financing necessary for rendering social services and implementation of social projects by means of the state social order are determined.

Forming of the state social order is performed concerning the citizens who are in difficult life situation, including being receivers of social services of public institutions of social servicing and (or) the medical care provided by the individual entrepreneurs performing medical activities, the non-state organizations of health care, non-state non-profit organizations within implementation of the state social order in the field of health care.

2. Approve:

The regulations on procedure for carrying out tender on accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services and implementation of social projects (are applied);

The regulations on conditions and procedure for provision to non-state non-profit organizations of subsidies for rendering social services and implementation of social projects (are applied).

2-1. Establish:

standard form of the contract for accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services according to appendix 1;

standard form of the contract for accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for implementation of social projects according to appendix 2.

3. To the Ministry of Labour and Social Protection, regional executive committees and the Minsk Gorispolkom to take measures for implementation of this resolution.

5. This resolution becomes effective since January 1, 2013.

Regulations on procedure for carrying out tender on accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services and implementation of social projects

Chapter 1. General provisions

1. This Provision determines procedure for carrying out tender on accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services and implementation of social projects (further - tender).

2. The Item is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 17.09.2020 No. 538

3. Tender is open, represents the public and competitive choice of contractors of the state social order from among non-state non-profit organizations.

4. Carrying out tender is performed by the state customer who determines terms of acceptance of competitive offers, openings of envelopes with competitive offers and carrying out tender.

5. The non-state non-profit organizations registered in accordance with the established procedure and performing activities in the territory of the Republic of Belarus, except for non-state non-profit organizations are allowed to participation in tender:

which property it is seized;

being in process of liquidation, reorganization (except for legal entities whom other legal entities join) or declared in accordance with the established procedure bankrupt;

which representatives are included in structure of the tender committee created by the state customer for assessment of offers (requests, projects) represented for participation in tender;

being political parties;

provided unreliable information about the organization;

which activities are suspended.

6. The notice on carrying out tender on accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services or implementation of social projects in form according to appendix 1 or appendix 1-1 (further – the notice on carrying out tender) is posted in open access on the official site of the state customer on the global computer Internet (further – the official site of the state customer).

The information message about carrying out tender is published in mass media with indication of date and the e-mail address of the page of placement of the notice on carrying out tender on the official site of the state customer.

Submission due date of competitive offers shall constitute at least 30 calendar days from the date of placement of the notice on carrying out tender on the official site of the state customer, except for the circumstances specified in Item part two 22 this provision.

7. For participation in tender non-state non-profit organizations represent to the state customer in sealed envelope on paper the competitive offers including:

the statement on participation in tender on accomplishment of the state social order financed by provision to non-state non-profit organizations of subsidies for rendering social services and implementation of social projects in form according to appendix 2;

data on non-state non-profit organization according to appendix 3;
