About some questions of ensuring information exchange of the body performing maintaining the State land cadastre, and body of state registration of the rights

According to article 9 of the Law of Ukraine "About state registration of the material rights to real estate and their burdenings" and Item 9 of the Procedure for provision of information on the registered parcels of land of body of state registration of the rights and on the registered material rights to the parcels of land of the body performing maintaining the State land cadastre approved by the resolution of the Cabinet of Ministers of Ukraine of February 22, 2012 No. 118 it is ORDERED:

1. Approve applied:

Regulations of provision of information on the registered parcels of land to body of state registration of the rights and about the registered rights to the parcels of land to the body performing maintaining the State land cadastre;

Regulations of provision on requests of the state registrar of the rights to real estate of information on the parcels of land.

2. Determine that information files which are used for provision of information specified in Item 1 of this order are created and transferred in format of XML files.

3. Subjects of information exchange according to this order are Goszemagentstvo of Ukraine and Ukrgosreestr.

4. To the state company "Center of the State Land Cadastre" (Tarnopolsky A. V.) and to the state company "Information center" of the Ministry of Justice of Ukraine (Dobzhansky V. B.):

perform technical support of information exchange between Goszemagentstv of Ukraine and Ukrgosreestr;

before entry into force of the Law of Ukraine "About the State land cadastre" and the Law of Ukraine "About state registration of the material rights to real estate and their burdenings" to provide technical and technological capability of provision of information on the registered parcels of land and about the registered rights to them according to this order.

5. To subjects of information exchange, the state company "Center of the State Land Cadastre", the state company "Information center" of the Ministry of Justice of Ukraine to carry out trial operation of information exchange between Goszemagentstv of Ukraine and Ukrgosreestr within two months from the date of entry into force of this order.

6. To department of interaction with authorities of the Ministry of Justice of Ukraine (Zerkal O. V.) to submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

7. To impose control over the implementation of this order on the deputy minister of justice of Ukraine - D.M.'s Crow and the deputy minister of agrarian policy and food of Ukraine - Senya O. V.

8. This order becomes effective since January 1, 2013, except Item 5, becoming effective from the date of its official publication.

Regulations of provision of information on the registered parcels of land to body of state registration of the rights and about the registered rights to the parcels of land to the body performing maintaining the State land cadastre

1. These Regulations determine procedure and the procedure of information exchange by provision by Ukrgosreestr of information on the registered material rights to the parcels of land Goszemagentstva of Ukraine and provision by Goszemagentstv of Ukraine in Ukrgosreestr of information on the registered parcels of land (further - information exchange), forms of registers of the transferred and received information files.

2. In these Regulations terms are used in the values given in the Laws of Ukraine "About the State land cadastre" and "About state registration of the material rights to real estate and their burdenings" other regulatory legal acts adopted according to them.

3. Information exchange is performed by telecommunication channels public using cryptographic information security and with use of the digital signature.

4. Information files about the registered parcels of land are created by means of the software of the State land cadastre on the structure determined in appendix 1 to these Regulations. Information files about the registered material rights to the parcel of land are created by means of the software of the State register of the material rights to real estate (further - the State register is right) on the structure determined in appendix 2 to these Regulations.

5. Information files / files of error messages when forming are checked according to the XSD scheme. In case of verification of such files subjects of information exchange shall use the single version of the XSD scheme.

6. The information file about the registered parcels of land containing data on the parcels of land registered for day the changes/corrections made to records is provided to Ukrgosreestr no later than the next working day from the date of state registration of the parcel of land.

The information file about the registered material rights to the parcel of land which contains data on the records about state registration of the material rights to the parcels of land, the changes/corrections made to records entered for day in the State register of the rights is provided Goszemagentstva no later than the next working day.

7. The information file is processed if:

the general structure of the XML file is broken;

the file is resent;

there was mistake in case of razarkhivation or disaggregation of the file;

error of verification of the digital signature of the file.

On such file the error message on the structure determined in appendix 3 or 4 to these Regulations is created.

If part of data from the information file does not conform to the requirements established by these Regulations (there are no obligatory fields or data do not correspond to restrictions on content of fields), of such file the error message on the structure determined in appendix 3 or 4 to these Regulations with indication of codes of mistakes for data which were not processed is created (in the Mistakes in Sheets element).

8. Provision of information files, files of error messages happens via the exchange server - the file server working under control of the Microsoft Windows XP operating system or above. The server of exchange is deployed by Goszemagentstv of Ukraine to whom access through telecommunication networks public is provided.

Access to the server of exchange happens to use of the ftps-protocol (FileZilla Server).

9. Subjects of information exchange perform maintaining online magazines of accounting of the transferred and received information files in the form determined in appendix 5 to these Regulations.

10. Subjects of information exchange for identification of the user and confirmation of integrity of data electronically use the digital signature compatible to the software of the State register of the rights which action of open key attested strengthened certificate of open key.

11. In case of the questions which are not determined by these Regulations, subjects of information exchange solve them the relevant joint decisions which are drawn up by separate protocols.
