About approval of Industrial safety rules for workers of cotton production

According to article 28 of the Law of Ukraine "About labor protection", the subitem 41 of item 4 of the Regulations on the Ministry of emergency situations of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 402, I ORDER:

1. Approve Industrial safety rules for workers of cotton production who are applied.

2. Declare invalid the order of the State committee of Ukraine on industrial safety, labor protection and mountain supervision of June 19, 2007 No. 135 "About approval of Industrial safety rules for workers of cotton production", registered in the Ministry of Justice of Ukraine on July 6, 2007 for No. 776/14043.

3. To public service of mountain supervision and industrial safety of Ukraine (Hokhotva O. I.):

3.1. In accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

3.2. In accordance with the established procedure to enter the order in the State register of normative legal acts concerning labor protection.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the Chairman of Public service of mountain supervision and industrial safety of Ukraine Hokhotva O. I.

Industrial safety rules for workers of cotton production

I. General provisions

1.1. These rules extend to all subjects of managing irrespective of patterns of ownership and legal form which according to the current legislation use wage labor and perform the activities connected with production of cotton yarn, cotton fabrics, products from textiles and other cotton products.

Requirements of these rules are obligatory for accomplishment by employers and workers of cotton production.

These rules regulate requirements to safe performance of works in engineering procedures of cotton production.

1.2. For prevention of injury rate, occupational diseases and accidents on production the employer shall according to the Law of Ukraine "About labor protection" create in each structural division, on each workplace of working condition according to regulations of the current legislation, and also provide observance of requirements of the legislation concerning the rights of workers in labor protection industry.

1.3. The employer shall develop and approve instructions for labor protection which act on the company, according to requirements of the Regulations on development of instructions for labor protection approved by the order of Committee on supervision of labor protection of the Ministry of Labour and Social Policy of Ukraine of January 29, 1998 No. 9, registered in the Ministry of Justice of Ukraine on April 7, 1998 for No. 226/2666 (NPAOP 0.00-4.15-98).

1.4. Training and examination concerning labor protection of workers of cotton production are carried out according to requirements of the Standard regulations on procedure for carrying out training and examination concerning labor protection and the List of the works with the increased danger approved by the order of the State committee of Ukraine on supervision of labor protection of January 26, 2005 No. 15, registered in the Ministry of Justice of Ukraine on February 15, 2005 for No. 231/10511.

1.5. Preliminary (during acceptance for work) and periodic (during labor activity) medical examinations of workers are performed according to the Law of Ukraine "About labor protection" and the Procedure for performing medical examinations of workers of certain categories approved by the order of the Ministry of Health of Ukraine of May 21, 2007 No. 246, registered in the Ministry of Justice of Ukraine on July 23, 2007 for No. 846/14113.

1.6. Investigation and accounting of accidents, occupational diseases and accidents are performed according to the Procedure for conducting investigation and accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of November 30, 2011 No. 1232.

1.7. For the purpose of the organization of accomplishment of the legal, organizational and technical, social and economic and treatment-and-prophylactic actions directed to prevention of accidents, occupational diseases, accidents in the course of work and taking into account specifics of production the employer creates at the company security service of work according to requirements of the Law of Ukraine "About labor protection" and Standard regulations on security service of the work approved by the order of the State committee of Ukraine on supervision of labor protection of November 15, 2004 No. 255, registered in the Ministry of Justice of Ukraine on December 1, 2004 for No. 1526/10125.

1.8. During execution of an employment agreement according to requirements of the Law of Ukraine "About labor protection" the employer shall inform the worker on receipt on working conditions and on availability on its workplace of dangerous and harmful production factors which are not eliminated yet, possible effects of their impact on health and about the worker's rights to privileges and compensations for work in such conditions according to the legislation and the collective agreement.

II. General production requirements for labor protection

1. Requirements to the territory, factory buildings and rooms of the subject of managing

1.1. The territory of the subject of managing and buildings located on it shall meet the requirements of the Fire safety regulations in Ukraine approved by the order of the Ministry of emergency situations of Ukraine of October 19, 2004 No. 126, registered in the Ministry of Justice of Ukraine on November 4, 2004 for No. 1410/10009 (further - NAPB A.01.001-2004).

1.2. The territory of the subject of managing is protected, arranged and contains in due sanitary condition. 1.5. Before entrance on the territory of the subject of managing information (schemes, plans) on arrangement of production divisions, roads, fire hydrants, reservoirs, traffic speed, etc. is placed.

1.6. In the territory of the subject of managing roads with hard surface (asphalt, concrete, etc.) for traffic circulation, the equipment and walking paths and sidewalks are arranged. Roads and walking paths need to be cleared systematically of dirt and snow, and in night-time - to light.

1.7. Reservoirs, tanks and other reservoirs for storage fuel and lubricants it is necessary to have on specially allotted places (sites).
