About approval of the List of questions for implementation of planned actions of the state supervision (control) in the field of land management and the Unified form of the inspection statement which is constituted by results of the relevant activities

According to article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity", article 61-1 of the Law of Ukraine "About land management", Item 8 of the Regulations on the Ministry of Agricultural Policy and Food of Ukraine approved by the Presidential decree of Ukraine of April 23, 2011 No. 500, and on accomplishment of the order of the Cabinet of Ministers of Ukraine of September 15, 2010 "About ensuring implementation of the state supervision (control) in the field of economic activity" I ORDER to No. 1850-r:

1. Approve the List of questions for implementation of planned actions of the state supervision (control) in the field of land management and the Unified form of the inspection statement which is constituted by results of the relevant activities which are applied.

2. To department of agriculture (Demidov O. A.) provide submission of this order on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the First Deputy Minister Bisyuk I. Yu.

The list of questions for implementation of planned actions of the state supervision (control) in the field of land management

1. When implementing of land resources of Ukraine by the State agency and its territorial authorities of planned actions of the state supervision (control) of observance by subjects of managing of requirements of the current legislation in the field of land management are checked:

1.1. Availability as a part of subject of managing which to the introduction in operation of the Law of Ukraine of October 02, 2012 No. 5394-VІ "About modification of some legal acts of Ukraine concerning deregulation of economic activity on work on land management and zemleotsenochny works" in the procedure established by the law obtained the license for work on land management, one certified engineer land surveyor who is included in the State register of the certified engineers land surveyors.

1.2. Availability as a part of subject of managing which owns necessary technical and technological support (for legal entities), at least two certified engineers of land surveyors.

1.4. Works which are performed by the land surveyor certified by the engineer, answer the work types specified in the qualification certificate issued by Goszemagentstv of Ukraine according to the law.

1.5. Works which are performed by the land surveyor certified by the engineer, answer the work types specified in the qualification certificate issued by the relevant educational institution according to the decision of the Qualification commission.

1.6. Observance by developers (contractors) of documentation on land management and the certified engineers land surveyors of the legislation of Ukraine which governs land relations, and also state standards, regulations and rules when implementing land management.

1.7. Compliance of documentation on land management to provisions of normative and technical documents, state standards, regulations and rules in the field of land management makes sure of paper form the signature and personal seal of the certified engineer of the land surveyor who is responsible for quality of works on land management.

1.8. Availability of documents (acts of acceptance transfer) which confirm free transfer by developers (contractors) of documentation on land management of one copy of developed documentation on land management in the State fund of documentation on land management.

1.9. Availability at the subject of managing of the magazine of designer's service of project implementation of land management according to the established form.

1.10. Observance by developers (contractors) of documentation on land management of conditions and terms of development agreements of projects of land management concerning assignment of the parcels of land.

1.11. Absence at the certified engineer land surveyor who works as a part of developers of documentation on land management or is personally developer (contractor) of documentation on land management, unspent conviction for crimes for profit.

1.12. Developers (contractors) of documentation on land management have proper technical supply in case of performance of works on land management according to the established requirements.

1.13. Observance by developers (contractors) of documentation on land management of production requirements in case of performance of works on land management according to the established requirements.

1.14. Timely advanced training of the certified engineer land surveyor who works as a part of developers of documentation on land management or is personally developer (contractor) of documentation on land management.

1.15. The certified engineer land surveyor who works as a part of developers of documentation on land management or is personally developer (contractor) of documentation on land management has the personal seal which is drawn up according to the order of the Ministry of Agricultural Policy and Food of Ukraine of December 26, 2012 No. 829 "About approval of samples and descriptions of seals of the state cadastral registrars" registered in the Ministry of Justice of Ukraine on January 15, 2013 for No. 125/22657.
