About approval of some regulations on identification and traceability of animals

Based on part (2) Articles 5, parts (3) article 13 of the Law No. 231-XVI of July 20, 2006 on identification and registration of animals (The official monitor of the Republic of Moldova, 2006, Art. No. 126-130, 623), with subsequent changes, DECIDES: the Government

1. Approve:

in the new edition, according to appendix No. 1, the Regulations on the procedures and documents concerning System of identification and traceability of animals, approved by the Order of the Government No. 1093 of October 8, 2007. (Official monitor of the Republic of Moldova, 2007, No. 165-167, of the Art. 1152);

the size of rates for the services and works on identification of animals rendered to owners of animals according to appendix No. 2.

2. To impose control of execution of this Resolution on the Ministry of Agriculture and the food industry.

Regulations on the procedures and documents concerning System of identification and traceability of animals

Requirements of the Regulations on the procedures and documents concerning System of identification and traceability of animals (further - the Provision) are brought into accord with regulations of Article 48.4 of Regulations of Parliament of the European Council No. 882/2004 on the official kontrolyakh which are carried out for the purpose of check of compliance to the fodder and food legislation, including the rules concerning health of animals and wellbeing of animals, and also Regulations of the European Parliament and Council No. 1760/2000 of July 17, 2000 about organization of system on identifications and registration of cattle touching labeling of beef and veal and products from beef and veal, and the canceling Regulations of the European Parliament and Council No. 820/97 (JO, L 204, on August 11, 2000, the Art. 1), changed by Regulations No. 1791/2006 of Council of November 20, 2006 (JO, L 363, of p. 1, of December 20, 2006), partially transfer provisions of Regulations (EU) No. 1082/2003 of the Commission of June 23, 2003 about establishment of rules on application of Regulations (EU) No. 1760/2000 of the European Parliament and Council of rather minimum level of control which shall be carried out within system of identification and registration of cattle (JO, L 156, on June 25, 2003, the Art. 9), No. 1034/2010 of the Commission changed last time by Regulations (EU) of November 15, 2010 (JO, L 298, of p. 7, of November 16, 2010), and also Regulations (EU) No. 1505/2006 of the Commission of October 11, 2006 on application of Regulations (EU) No. 21/2004 of Council of rather minimum control which shall be carried out within system of identification and registration of sheep and goats (JO, L 280, on October 12, 2006, p. 3), No. 1033/2010 of the Commission changed by Regulations (EU) of November 15, 2010 (JO, L 298, of p. 5, on November 16, 2010).

Chapter I General provisions

Part of 1 Concept

1. In this Provision the concepts given in the Law No. 231-XVI of July 20, 2006 on identification and registration of animals, and also the following concepts are used:

the territorial auditor - the employee who works at territorial office of the National operator, fulfilling part of the duties delegated at the district/municipal level;

the database - the national integrated system of information and applications which management and administration are delegated, according to the law, one operator;

the statement on identification - the application submitted by the owner to the National operator for identification and registration of animals or objects to SIPZh according to the sample given in appendix No. 1 to this Provision;

the statement on movement - the application submitted by the owner to competent authority for registration to SIPZh about movement of animal according to the sample given in appendix No. 2 to this Provision;

the registration application of event - the application submitted by the owner to the National operator for registration to SIPZh of events, such as: traditional slaughter, death, disappearance of animal, loss of label, the passport or card of object, finding of animal, change of the owner owing to his death, the Section of property, etc., according to the sample given in appendix No. 3 to this Provision;

object for slaughter - any equipped and technically the equipped company or the structure intended for slaughter of animals;

means of identification - the label, the transponder used for identification of animal which specifications affirm the Ministry of Agriculture and the food industry which manages and which are issued only by the National operator;

The state register of objects (further - the register of objects) - component of System of identification and traceability of animals, the data set in electronic format including information on identification of each object in the Republic of Moldova;

the operator of SIPZh (further - the National operator) - the State company "Centrul Informational Agricol" to which it is delegated, according to the law, the activities connected with data recording, design, creation, implementation, work and content of SIPZh, the representative as the single national administrator and the supplier of means of identification;

territorial office of the National operator (further - territorial office) - the offices of the National operator placed at the district/municipal level in buildings of district/municipal authorities of veterinary sanitation and safety of animal products (further - R/MUVS and BPZhP), or in other places by means of which the National operator performs activities for data recording, the animals touching registration and objects, including events, related;

the vehicle - all vehicles: road, railway, water and air, received veterinary and sanitary authorization for transportation of animals;

the identification form (F 1) - the official document issued by the National operator, confirming official registration in SIPZh of animals and objects, component of the Register of objects according to the sample given in appendix No. 4 to this Provision;

the form of movement (F 2) - the veterinary clean bill of health the zhivotnogoofitsialny document issued by competent authority, allowing movement of all animals and accompanying them during movement on the territory of the Republic of Moldova to the destination (fairs, exhibitions, summer the camp, slaughter, farm for karantinirovaniye or other objects or in case of alienation), published by the National operator, confirming official registration in event SIPZh about movement of animal, component of the register of objects according to the sample given in appendix No. 5 to this Provision;
