Questions of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan

(as amended of the Order of the Government of the Republic of Kazakhstan from 230.9.2014 g No. 1005)

According to Item 2 of article 24 of the Constitutional law of the Republic of Kazakhstan of December 18, 1995 "About the Government of the Republic of Kazakhstan", Item 2 of the Presidential decree of the Republic of Kazakhstan of October 29, 2012 No. 410 "About approval of the Standard provision of state body of the Republic of Kazakhstan", and also the Presidential decree of the Republic of Kazakhstan of January 16, 2013 "About further enhancement of system of public administration of the Republic of Kazakhstan" the Government of the Republic of Kazakhstan DECIDES: No. 466

1. Form Committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

2. Bring in the order of the Government of the Republic of Kazakhstan of October 29, 2004 No. 1132 "Some questions of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2004, No. 43, the Art. 540) the following changes:

4) of Item 1 and Item 6 to exclude the subitem;

To be reworded as follows the regulations on the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan approved by the specified resolution according to appendix to this resolution.

3. This resolution becomes effective from the date of signing.

Regulations on the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan

1. General provisions

1. The Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (daleeministerstvo) is the state body of the Republic of Kazakhstan performing management in the social and labor sphere.

2. The ministry has departments - Committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan and Committee on control and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

3. The ministry performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The ministry is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

5. The ministry enters the civil relations from own name.

6. The ministry has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

7. The ministry of questions of the competence of the procedure established by the legislation of the Republic of Kazakhstan makes the decisions which are drawn up by orders of the head of the Ministry and other acts, stipulated by the legislation the Republic of Kazakhstan.

8. The structure and limit of the number of staff of the Ministry affirm according to the current legislation of the Republic of Kazakhstan.

9. Ministry location: 010000, city of Astana, left coast, Ulitsa Orynbor, house No. 8, entrance 6, office building "House of the ministries".

10. Full name of state body - public institution "Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan".

11. This Provision is the constituent document of the Ministry.

12. Financing of activities of the Ministry is performed from the republican budget.

13. The ministry is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of the Ministry.

If the Ministry by legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the republican budget.

2. Mission, main objectives, functions, rights and obligations of state body

14. Mission of the Ministry: assistance to increase in level and quality of life of the population through providing the constitutional guarantees and rights of citizens in the field of work, employment and social security.

15. Tasks:

forming and realization of state policy, implementation of cross-industry coordination and public administration in the area:

1) work, including safety and labor protection;

2) employment;

3) social security, including provision of pensions and compulsory social insurance;

4) social protection of disabled people;

5) social support of families with children;

6) public assistance to separate categories of citizens;

7) provisions of special social services;

8) realization within the competence of state policy in population shift;

9) other tasks assigned to the Ministry by the legislation of the Republic of Kazakhstan.

16. Functions:

functions of central office:

1) creates state policy in the field of work, employment, social protection of the population;

2) develops the program of employment of the population;

3) is performed by international cooperation in the field of the activities;

Develops 4), approves regulatory legal acts in the area: work, including safety and labor protection; employment; social security, including provision of pensions and compulsory social insurance; social protection of disabled people, including in the field of medico-social examination; population shifts within the competence; social support of families with children; provisions of the public assistance to separate categories of citizens; special social services; and also concerning appointment and payment: the public social benefits on disability, on the occasion of loss of the supporter and on age; special public welfare payment; the public special welfare payment to persons working at underground and open mining operations, at works with especially harmful and especially severe conditions of work (further - the public special welfare payment); monthly payment after completion of the period of capitalization of payments on indemnification caused to life or health of workers by the legal entities liquidated owing to bankruptcy; immediate monetary compensation to the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, to the victims of political repressions, lump sum payment on burial;

Develops 5) and approves methodical recommendations about questions of work, safety and labor protection;

6) performs coordination and interaction in the field of safety and labor protection with other state bodies, and also with employee representatives and employers;

7) is established by replacement procedure and review of standard regulations and standard rates on work;

8) establishes procedure for representation, consideration and approval of regulations of work in the organizations, on services (goods, works) of which state regulation of rates (the prices, rates of charges) is entered;

9) is established by procedure for representation, consideration and approval of parameters on wages system of employees of the organizations, on services (goods, works) of which state regulation of rates (the prices, rates of charges) is entered;

10) is developed by procedure and regulations of issue to workers of milk, treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, and also procedure for ensuring collective protection with their means, sanitary and household rooms and devices at the expense of means of the employer;

11) is determined by procedure for development, review, approval and application of job evaluation catalogs and characteristics;

12) approves standard qualification characteristics of positions of heads, specialists and other employees of the organizations of different types of economic activity;

13) is established by approval procedure of standard regulations and standard rates on work of the corresponding fields of activity by authorized state bodies;

14) approves the standard regulations and standard rates on work approved by state bodies of the corresponding fields of activity;

15) approves standard regulations and standard rates on work of social and labor field of activity;

16) approves standard qualification characteristics of positions of heads, specialists and other employees of social and labor field of activity;

17) is determined by the list of productions, workshops, professions and positions, the list of hard work, works with harmful (especially harmful) and (or) dangerous working conditions in which work grants the right to the reduced duration of working hours, to additional paid annual labor vacation and to the increased amount of compensation;

18) is approved by procedure for provision of the reduced duration of working hours, additional paid annual labor vacation and the increased amount of compensation for the workers occupied on hard work, works with harmful (especially harmful) and (or) dangerous working conditions;

19) is approved by the Single wage rate book of works and professions of workers, tariff and qualification characteristics of professions of workers, the Job evaluation catalog of positions of heads, specialists and other employees;

20) approves qualification characteristics of separate positions of specialists of public institutions and state companies, general for all fields of activity;

Develops 21) and approves national frame of qualifications together with authorized state body in the field of education;

22) approves industry frame of qualifications of the social and labor sphere;

23) approves structure, procedure for development, review, approbation and application of professional standards;

Develops 24) and approves professional standards of workers of the social and labor sphere;

25) approves professional standards of the organizations of the corresponding fields of activity;

26) approves form of maintaining the Register of professional standards;

27) develops offers on regulation of system of social partnership;

Develops 28) and approves technique of determination of need of industries of economy for personnel by industries, specialties and regions;

Develops 29) and approves forms for submission of data on demanded specialties and vacant workplaces for inclusion in the database of the current vacancies and the predicted workplaces;

30) is developed by the list of professions of workers for benefit of which investors at the expense of own means perform voluntary professional pension contributions;

31) is developed by procedure for annual increase in the sizes of retirement benefits from the State center for pension payment (further - the Center);

32) is developed by the list of works in organizations of forensic medical examination, in pathoanatomical departments of medical institutions for preferential calculation of working life for purpose of pensions from the Center in one-and-a-half size;

33) is developed by the list of seasonal industries in work during which complete season is set off in years of service for award of pension for year of work;

34) is developed by the list No. 1 of productions, works, professions, positions and indicators for calculation of the size of retirement benefits from the Center;

35) develops rules of forming of the database of investors (receivers) on compulsory pension contributions and the single list of the physical persons which signed the pension provision agreement at the expense of compulsory pension contributions;

36) develops rules of settlement according to obligations of the accumulation pension funds which arose in case of transfer of pension savings of investors (receivers);

37) develops rules of appointment and payment of retirement and social benefits from the Center;

38) is developed by procedure for conducting monitoring of the amounts of actually brought compulsory contributions of investors (receivers) taking into account the rate of inflation;

39) develops rules of collection of commission fee by the accumulation pension funds;

40) is developed by procedure and terms of calculation, deduction (charge) and transfer of compulsory pension contributions in the accumulation pension funds;

41) develops rules of transfer of the compulsory pension contributions withheld and socially individual code and (or) registration taxpayer number, and (or) the pension contract with the accumulation pension fund which is not listed by agents from the income of former employees which location is not known, due to the lack as of January 1, 2005;

42) develops rules of determination of the monthly income accepted for calculation of voluntary professional pension contributions;

43) develops rules of implementation of retirement benefits from the pension accruals created at the expense of compulsory pension contributions, voluntary professional pension contributions from the accumulation pension funds and technique of implementation of calculation of the size of retirement benefits for the schedule;

44) develops translation rules of pension accruals from several accumulation pension funds in one in the presence at the investor (receiver) of two and more pension provision agreements at the expense of compulsory pension contributions with the different accumulation pension funds;

45) develops translation rules of pension accruals of the investor (receiver) at the expense of compulsory pension contributions from one accumulation pension fund in another by means of electronic terminals;

46) develops rules of representation by the accumulation pension funds to the Center of information about prisoners and the pension provision agreements which terminated with investors (receivers) at the expense of compulsory pension contributions with use of electronic document management;

47) is developed by procedure and terms of calculation and transfer of social assignments;

48) agrees to appointment of leading employees of the State Social Insurance Fund (further - Fund);

49) exercises internal control of activities of Fund according to the procedure, the established legislation of the Republic of Kazakhstan on the state control and supervision;

50) develops the regulations and limits providing financial stability of Fund;

51) is developed by the list of financial instruments for investment of assets of Fund;

52) is developed by procedure Fund of the activities connected with securities and other financial instruments;

53) is developed annually by the offer on limiting establishment of size of interest rate of the commission fee earned from assets of Fund;

54) develops rules of calculation (determination), recalculation and increase in the amount of social payments from Fund;

55) is developed by the offer on increase in the amount of social payments from Fund on cases of disability and loss of the supporter;

56) develops rules of payment of the amounts of the social payments which are not received timely or the social payments received not completely because of authorized body to destination, the Center and (or) Fund;

57) is developed by the actions plan on social protection and rehabilitation of disabled people;

58) develops standards of rendering special social services;

59) develops qualification requirements to social workers and in coordination with authorized bodies in the field of health care and education approves procedure for certification of social workers;

Develops 60) and approves in coordination with authorized bodies in the field of health care and education evaluation procedure and determinations of need for special social services;

61) establishes the general principles of the organization and implementation of medico-social examination and rehabilitation of disabled people;

62) performs activities coordination (including develops and approves methodical recommendations) about methodical providing system of provision of special social services, including according to degree of risks in the field of provision of special social services and the field of social protection of the population;

63) performs registration of the industry agreements and regional agreements signed at the level of area (the city of republican value, the capital);

64) provides training and certification of the state inspectors of work, will organize advanced training of personnel in the field of medico-social examination;

65) is performed by maintaining the Register of professional standards;

66) will organize monitoring and risks assessment in the field of safety and labor protection;

67) will be organized by carrying out scientific research on problems of safety and labor protection;

68) develops suggestions for improvement of wages system of the employees of public institutions who are not government employees and employees of the state companies; safety and labor protections; employment; social security, including provision of pensions and compulsory social insurance; social support of families with children; provisions of the public assistance to separate categories of citizens; rehabilitations of disabled people and provision of special social services;

69) performs methodical and organizational coordination of work of authorized state bodies, social services concerning work, safety and labor protections, employment, social security, social protection of disabled people, rendering the public assistance and provision of special social services;

Analyzes 70), predicts the demand and supply on labor power on the basis of creation of single information base of the labor market, informs the population and the Government of the Republic of Kazakhstan on work market situation;

71) takes part in consideration of drafts of investment contracts with the purpose of protection of the domestic market of work;

72) distributes quota in the limits and procedure established by the Government of the Republic of Kazakhstan on attraction of foreign labor power for implementation of labor activity in the territory of the Republic of Kazakhstan between areas, the cities of Astana and Almaty;

73) together with the interested bodies is determined by the need for training and their employment;

74) creates single information base of the labor market;

75) performs the analysis, assessment and control of financial stability of Fund;

76) is determined by the extent of poverty line, proceeding from actually developed size of subsistence minimum in regions for rendering the address public assistance;

77) is studied by the level and the reasons of disability of the population;

78) within the competence participates in realization of state policy on providing the equal rights and equal opportunities of men and women;

79) within the competence is performed by interaction with physical persons and legal entities concerning provision of special social services;

80) develops offers on development of types and forms of provision of special social services;

81) realizes within the competence state policy in the field of population shift;

82) within the competence performs interagency coordination of activities of state bodies concerning population shift;

Develops 83) and makes in the Government of the Republic of Kazakhstan offers on forming of quotas of immigration of oralmans, resettlements of internal migrants, to attraction of foreign labor power;

84) distributes quotas of immigration of oralmans, resettlements of internal migrants between areas, the cities of republican value and the capital;

85) represents results of monitoring of migratory processes to authorized body on forming of state policy in the field of population shift;

86) within the competence develops system of measures in the field of regulation and monitoring of migratory processes;

87) is determined by procedure for activities of the centers of adaptation and integration of oralmans, the centers of temporary placement;

88) performs other functions provided by the laws, acts of the President and the Government of the Republic of Kazakhstan.

Functions of departments:

1) realization of state policy in the field of work, including safety and labor protections; employment; social security, including provision of pensions and compulsory social insurance; social protection of disabled people; social support of families with children; provisions of the public assistance to separate categories of citizens, population shifts within the competence;

2) purpose of the state base retirement benefit, the public social benefits on disability, on the occasion of loss of the supporter and on age, retirement and social benefits from the Center and Fund, special public welfare payment, the public special welfare payment, public welfare payment to the families having children, monthly payment after completion of the period of capitalization of payments on indemnification caused to life or health of workers by the legal entities liquidated owing to bankruptcy, immediate monetary compensation to the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, to the victims of political repressions, lump sum payment on burial and ensuring their payments;

3) decision making about appointment or refusal in purpose of retirement and social benefits from the Center and Fund;

4) the organization of data collection about the number of receivers and the amounts of retirement and social benefits from the Center, social payments from Fund;

5) explanation concerning appointment and receipt of retirement and social benefits from the Center and Fund;

6) determination of the list, forms, terms of submission of financial and other reporting by all types of retirement and social benefits from the Center and Fund for ensuring the control and supervising functions;

7) receipt of data on activities of Fund, and also from state bodies and the organizations of the data necessary for implementation of the control and supervising functions;

8) implementation of the analysis of the reasons of industrial traumatism, occupational diseases, professional poisonings and development of offers on their prevention;

9) participation in implementation of monitoring of execution by subsoil users of contract commitments according to local content in personnel, and also on providing conditions and compensations of the Kazakhstan personnel on not discrimination basis;

10) implementation of monitoring of the collective agreements provided by employers;

11) investigation of labor accidents according to the procedure, established by the legislation of the Republic of Kazakhstan;

12) holding examination at the leading employees and persons responsible for safety and labor protections at employers;

13) participation in structure of inspection on acceptance for operation of subjects to production appointment;

14) interaction with plenipotentiaries of workers and employers concerning enhancement of standard rates of safety and labor protection;

15) consideration of addresses of workers, employers and their representatives on safety issues and labor protections;

16) implementation of monitoring of migratory processes;

17) payment of lump-sum allowances and compensations to the oralmans and members of their families who arrived on quota of immigration of oralmans;

18) forming of databases AIS "Centralized Databank of Persons Having Disability", "Labor protection", and also maintenance of AIS "E-social security", "Public assistance: ASP, ODS", "Foreign labor power", "Labor market", "Employment";

19) conducting medico-social examination;

20) determination of group of disability, its reasons, terms, time of approach of disability, extent of disability, category "handicapped child" depending on extent of disorder of functions of organism and restrictions of life activity;

21) creation of individual programs of rehabilitation of disabled people and to control of their realization;

22) implementation of the state control of observance of the labor law of the Republic of Kazakhstan, including requirements for safety and labor protection, legislations on employment of the population, provision of pensions, social protection of disabled people, on compulsory social insurance, special social services, and also legislations of the Republic of Kazakhstan on population shift, within the competence;

23) control of timely and objective conducting investigation of labor accidents according to the procedure, established by the legislation of the Republic of Kazakhstan;

24) control of timeliness and completeness of payment of the state base retirement benefit, retirement benefits; the public social benefits on disability, on the occasion of loss of the supporter and on age; special public welfare payment; public special welfare payment; benefits for the birth and on child care; immediate monetary compensations to the victims of political repressions, citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site; lump sum payments on burial, monthly payment after completion of the period of capitalization of payments on indemnification caused to life or health of workers by the legal entities liquidated owing to bankruptcy from the Center; social payments from Fund;

25) check of reliability of the documents necessary for purpose of retirement and social benefits from the Center and social payments from Fund;

26) inspection within the competence of activities of Fund according to the procedure, established by the legislation of the Republic of Kazakhstan;

27) implementation of others of function, the provided laws, acts of the President and the Government of the Republic of Kazakhstan.

17. Rights of the Ministry:

1) to request and receive in the procedure established by the legislation of the Republic of Kazakhstan from state bodies, the organizations, their officials necessary information and materials;

2) to adopt regulatory legal acts, obligatory for execution, within the competence;

3) to perform other rights provided by the current legislation of the Republic of Kazakhstan.

Obligations of the Ministry:

1) to observe the legislation of the Republic of Kazakhstan, it is right also the interests of physical persons and legal entities protected by the law;

2) to exercise coordination and control of activities of departments, their territorial authorities, and also subordinated organizations of the Ministry;

3) to provide timely and high-quality execution of orders of the Head of state, Administration of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan, and also plans of bill works of the Government of the Republic of Kazakhstan for the corresponding years.

3. Organization of activities of state body

18. Management of the Ministry is performed of the Minister who bears the personal responsibility for accomplishment of the tasks assigned to the Ministry and implementation of the functions by it.

19. The minister is appointed to position and dismissed by the President of the Republic of Kazakhstan.

20. The minister has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

21. Powers of the Minister:

1) creates policy in the field of work, safety and labor protections, employment, social protection of the population, pension and social security, compulsory social insurance;

2) provides cross-industry coordination in limits, stipulated by the legislation the Republic of Kazakhstan;

3) determines competence and order of interaction of departments with other state bodies;

4) appoints to positions and dismisses heads of departments which are under control to it in the activities;

5) within competence of the Ministry adopts regulatory legal acts;

6) is represented by the Ministry in Parliament of the Republic of Kazakhstan, other state bodies and the organizations;

7) performs management of activities of the subordinated organizations;

8) appoints and exempts heads of the subordinated organizations;

9) is determined by the need for personnel in the field of work, employment and social security;

10) takes the measures directed to anti-corruption in the Ministry and bears the personal responsibility for acceptance of improper anti-corruption measures;

11) in the procedure established by the legislation imposes authority punishments and applies encouragement measures on the staff of the Ministry whose questions of employment relationships are carried to its competence;

12) makes decisions on other questions carried to its competence.

Execution of powers of the Minister in the period of its absence is performed by person replacing it according to the current legislation of the Republic of Kazakhstan.

22. The first head determines powers of the deputies according to the current legislation of the Republic of Kazakhstan.

23. The office of the Ministry is headed by the responsible secretary appointed to position and dismissed according to the current legislation of the Republic of Kazakhstan.

4. Property of state body

24. The ministry can have on the right of operational management the isolated property in cases, stipulated by the legislation the Republic of Kazakhstan.

The property of the Ministry is created at the expense of the property given it by the owner and also the property (including cash incomes) acquired as a result of own activities, and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

25. The property assigned to the Ministry belongs to republican property.

26. The ministry has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation of the Republic of Kazakhstan.

5. Reorganization and abolition of state body

27. Reorganization and abolition of the Ministry are performed according to the legislation of the Republic of Kazakhstan.
