About approval of the Procedure for accomplishment of customs formalities when implementing transit movements

According to part two of Article 246 of the Customs code of Ukraine and the subitem 64 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 8, 2011 No. 446, I order:

1. Approve the Procedure for accomplishment of customs formalities when implementing transit movements (further - the Procedure) which is applied.

2. Department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine (Chmeruk M. O.) and Department of the organization of customs control and registration of the State Customs Service of Ukraine (Semk S. M.) in accordance with the established procedure to provide:

provision of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. To the State Customs Service of Ukraine (Kaletnik I. G.) within 55 days from the date of official publication of this order to finish program and information complexes of the Single automated information system of State Customs Service of Ukraine taking into account requirements of the Procedure.

4. Recognize invalid orders of the State Customs Service of Ukraine and the Ministry of Finance of Ukraine according to the list which is attached.

5. This order becomes effective from the date of its official publication, except Items 1 and 4 of this order which become effective in 60 days from the date of its official publication.

6. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.

Procedure for accomplishment of customs formalities when implementing transit movements

I. General provisions

1.1. This Procedure regulates actions of officials of customs authorities, carriers, customs applicants or persons authorized by them in case of control of movement of goods and/or vehicles of commercial appointment which are under customs control, between two customs authorities of Ukraine or within zone of activities of one customs authority by legal entities and physical persons irrespective of mode of transport, except goods which move stationary means of transportation (pipelines and power lines) without application of actions of guaranteeing, in

1) cargo departures;

2) the accompanied baggage;

3) unaccompanied baggage;

4) hand luggage.

1.2. In this Procedure terms are used in the following values:

the control coupon - the statement from the automated system of customs clearance which is transferred by customs authority to carrier in the check point for delivery together with goods in customs of appointment when implementing transit movements of goods, vehicles of commercial appointment with use of the preliminary customs declaration;

customs of departure - any customs authority of Ukraine with which begins the movement of all goods quantity or their part which are under customs control;

customs of appointment - any customs authority of Ukraine in which comes to an end the movements of all goods quantity or their part which are under customs control;

the carrier - person transporting goods through customs border of Ukraine and/or between customs authorities in the territory of Ukraine or is responsible for such transportations;

the previous electronic information on transaction using the book of the international road delivery (further - MDP-EPD) - information which is provided in electronic form by International union of road transport (further - MSAT) to State Customs Service of Ukraine.

Other terms are used in the values determined by the Customs code of Ukraine and other regulatory legal acts concerning customs affairs.

1.3. For ensuring identification of goods, vehicles of commercial appointment, are located under customs regime of transit, the means provided by parts two and third Article 326 of the Customs code of Ukraine can be applied.

1.4. Means for identification are imposed directly on cargo section of the vehicle (cargo piece) or container, the tank, other devices in which directly transported goods if:

they are imposed by easy and reliable way;

it is impossible to withdraw goods or to make goods in the visible traces of opening or damage of seal (utility) which are sealed up parts of the vehicle without leaving;

places in which there can be goods are easily available to check by officials of customs authorities.

1.5. Accomplishment of customs formalities in case of control for transit to transportations of goods, vehicles of commercial appointment is performed based on documents of control of movement of goods (further - DKPT).

When giving to customs authority of DKPT in electronic form (further - EDKPT) accomplishment of customs formalities is performed according to this Procedure except for for the provisions concerning paper copies of DKPT.

1.6. Control of movement of goods, vehicles of commercial appointment which are transported in customs regime of transit to customs of appointment is made by customs of departure.

1.7. For control of movement of goods, vehicles of commercial appointment and identification of the facts of their nondelivery in customs of appointment is used the Single automated information system of customs authorities of Ukraine (further - EAIS).

1.8. In case of identification of violations of the law at any stage of control of movement of goods, vehicles of commercial appointment the official of customs authority shall take necessary measures, stipulated by the legislation.

In case of creation of the protocol on customs offense information (date, number, Article and content of offense) about the protocol on customs offense within a day of date of creation is constituted it is introduced in EAIS by the official of customs authority, directly constituted the protocol on customs offense.

1.9. The official of structural division of customs authority, where the omission of goods and vehicles of commercial appointment through customs border of Ukraine to which job responsibilities control of movement of goods, by results of work of each change belongs is performed:

verifies data about passed goods, vehicles of commercial appointment deposited in EAIS, available in structural division of customs authority documents which were the basis for the omission of goods and vehicles of commercial appointment through customs border of Ukraine, and also with the data specified in the corresponding module of the Automated system of customs clearance (further - ASMO)

in the absence of disagreements based on the data which are available in EAIS and the ASMO corresponding module creates the register of DKPT on the vehicles of commercial appointment passed for change with goods;

witnesses the printed-out register the signature and print of personal number seal (further - LNP);

leaves registers with the available documents for storage in cases of structural division of the check point of customs authority at least within 365 days from the date of the omission of goods, vehicles of commercial appointment through customs border of Ukraine. Aggregate term of storage of registers in customs authority at least 1095 days from the date of the omission of goods, vehicles of commercial appointment through customs border of Ukraine;

in case of identification of discrepancies instantly in writing informs the head of the structural unit for the purpose of conducting check.

1.10. Goods concerning which the legislation of Ukraine determines need of provision to customs authorities of providing customs payment are allowed to transit transportation in the quantity which is not exceeding goods quantities on which providing customs payment is provided.

1.11. In case of accomplishment of customs formalities data on numbers of vehicles are entered by officials of customs in EAIS capital Latin letters and in the Arab figures without gaps and other punctuation marks in the middle of number. Numbers of different vehicles are divided by virgule "/".

1.12. Entering of information into EAIS is performed by officials of customs authorities behind number DKPT of exclusively personal electronic computer placed in structural division of customs authority.

II. Features of adherence to deadlines of transit transportations

2.1. When sending goods, vehicles of commercial appointment the term of transit transportation to customs of appointment is surely established.
