Rules of determination of constructed fare, limiting approval and individual rates, approved by the specified resolution to add with Item 25-1 of the following content:
"25-1. In case of non-execution by the power making organization of the investment obligations provided by the agreement, the power making organization shall return to subjects of the wholesale market the received means provided by the agreement for accomplishment of investment obligations and not used on their realization by decrease in selling price on electrical energy the next calendar year with placement of this information in mass media.
The obligation provided by part one of this Item does not extend to the power making organizations which accepted in case of agreement signature the next calendar year additional investment obligations on the non-execution amount taking into account refunding rate of National Bank of the Republic of Kazakhstan on the date of agreement signature.
In case of non-execution next calendar year by the power making organization of the additional investment obligations provided by the agreement, these obligations cannot be assumed by the power making organization the next years and are subject to return to subjects of the wholesale market according to part one of this Item.
