The government of the Russian Federation decides:

1. Approve enclosed:

Instructions for use gas regarding safety during the using and content of the intra house and intra room gas equipment by provision of utility on gas supply;

changes which are made to acts of the Government of the Russian Federation concerning safety during the using and content of the intra house and intra room gas equipment.

2. To the Ministry of Regional Development of the Russian Federation:

bring the acts adopted in pursuance of item 4 of the order of the Government of the Russian Federation of July 21, 2008 N 549 "About procedure for supply of gas for ensuring household needs of citizens" into compliance with this resolution;

in coordination with the Ministry of Energy of the Russian Federation to approve within 6 months the instruction for safe use of gas in case of satisfaction of household needs.

3. To Federal Tariff Service:

a) approve methodical recommendations of rules of calculation of cost of maintenance and repair of the intra house and intra room gas equipment;

b) provide within 3 months to the Government of the Russian Federation the draft of the act of modification of Basic provisions of forming and state regulation of gas prices and rates for the services in its transportation in the territory of the Russian Federation approved by the order of the Government of the Russian Federation of December 29, 2000 N 1021, of the gas-distributing organizations for gas transportation providing inclusion of payment for emergency and dispatching providing the intra house and intra room gas equipment in rate for services.

4. To Federal Service for Environmental, Technological and Nuclear Supervision to approve within 6 months of the rule of carrying out technical diagnosing of the intra house and intra room gas equipment.

5. Recommend to public authorities of subjects of the Russian Federation to be guided by the methodical recommendations specified in the subitem "an" of Item 3 of this resolution.

6. This resolution is effective till September 1, 2029.

Instructions for use gas regarding safety during the using and content of the intra house and intra room gas equipment by provision of utility on gas supply

I. General provisions

1. These rules establish procedure for use of gas regarding ensuring safe use and content of the intra house and intra room gas equipment by provision of utility on gas supply, including requirements to the specialized organization, procedure and conditions of the conclusion, change and agreement cancelation about maintenance and repair of the intra house gas equipment in the apartment house, agreements on maintenance of the intra room gas equipment in the apartment house, agreements on maintenance of the intra house gas equipment in the apartment house (household).

In the subject of the Russian Federation - the federal city of Moscow features of the organization of maintenance and repair of the intra house gas equipment in the apartment house and maintenance of the intra room gas equipment in the apartment house can be established.

2. The concepts used in these rules mean the following:

"emergency and dispatching providing" - package of measures for the prevention and localization of the accidents arising in the course of use of the intra house and intra room gas equipment, directed to elimination of direct threat of life or to health of citizens, property torts of physical persons or legal entities, to the state-owned or municipal property, the environment, life or health of animals and plants;

"the household gas-using equipment" - the equipment, held for use gas in fuel quality for domestic needs of consumers of gas (gas stoves, automatic gas flowing and capacity water heaters, gas convectors, etc.);

"the intra house gas equipment":

in the apartment house - the gas pipelines which are common property of owners of rooms laid from gas source (when using of the liquefied hydrocarbon gas) or places of connection of the specified gas pipelines to network of gas distribution to the shutoff valves (crane) inclusive located on branches (opuska) to the intra room gas equipment, the reservoir and (or) group balloon installations of the liquefied hydrocarbon gases intended for supply of gas to one apartment house, the gas-using equipment (except for the household gas-using equipment which is part of the intra room gas equipment), technical devices on gas pipelines, including the regulating and safety fittings, control systems of gas contamination of rooms, collective (all-house) metering devices of gas, and also the gas metering devices fixing gas amount used in case of production of utility on heating and (or) hot water supply;

in households - being in limits of the parcel of land on which household, the gas pipelines laid from gas source (is located when using of the liquefied hydrocarbon gases) or places of connection of the specified gas pipelines to network of gas distribution to the household gas-using equipment, the reservoir and (or) group balloon installations of the liquefied hydrocarbon gases intended for supply of gas in one household, individual balloon installations of the liquefied hydrocarbon gases, the household gas-using equipment, technical devices on gas pipelines including the shutoff regulating and safety valves, control systems of gas contamination of rooms and metering devices of gas;

"the intra room gas equipment" - the gas pipelines of the apartment house laid after the shutoff valves (crane) located on branches (opuska) to the intra room gas equipment to the household gas-using equipment placed indoors, the household gas-using equipment and technical devices on gas pipelines including the regulating and safety fittings, control systems of gas contamination of rooms, the individual or general (room) metering device of gas;

"the gas-using equipment" - the equipment in which gas is used in fuel quality;

"household" - the apartment house (part of the apartment house) and the outdoor constructions adjoining it and (or) separate on general with the apartment house (part of the apartment house) the parcel of land (garage, bath (sauna, the pool), the greenhouse (winter garden), rooms for content of livestock and bird and other objects);

"customer" - the legal entity (including management company, condominium or the housing cooperative or other specialized consumer cooperative created for the purpose of requirements satisfaction of citizens in housing (further respectively - partnership, cooperative), the individual entrepreneur exercising control of the apartment house, owners of rooms in the apartment house (in case of direct method of management of the apartment house) or the physical person (citizen) who is the owner of the room or the employer of premises under the agreement of social hiring, the employment contract of premises of housing stock of social use in the apartment house or the owner of the apartment house (household), acting as the agreement party about maintenance and repair of the intra house gas equipment in the apartment house, agreements on maintenance of the intra room gas equipment in the apartment house or agreements on maintenance of the intra house gas equipment in the apartment house (household), ordering performance of works (rendering services) in such agreement, obliged to accept and pay the performed works (the rendered services);

"contractor" - the specialized organization which based on the agreement on maintenance and repair of the intra house gas equipment in the apartment house or agreements on maintenance of the intra room gas equipment in the apartment house, or the agreements on maintenance of the intra house gas equipment in the apartment house (household) which are the mixed agreements containing elements of the works agreement and services agreement assumed liabilities on performance of works (rendering the services) provided by the agreement on maintenance and repair of the intra house gas equipment in the apartment house or the agreement on maintenance of the intra room gas equipment in the apartment house, or the agreement on maintenance of the intra house gas equipment in the apartment house (household);

"the supplier of gas" - the gas supplying organization which is the agreement party, the gas providing delivery as the utility resource necessary for provision of utility on gas supply;

"gas supply suspension" - set of operations of technical nature (including overlapping of shutoff valves) which are performed by the contractor in the cases provided by these rules and of which interruption in supply of gas to the intra house and (or) intra room gas equipment is result;

"repair of the intra house and (or) intra room gas equipment" - works on recovery of operability of the intra house and (or) intra room gas equipment or its components;

"the specialized organization" - to conforming requirements established by these rules, the gas-distributing organization performing gas transportation to junction of network of gas distribution with the gas pipeline which is part of the intra house gas equipment and also the performing activities for maintenance and repair of the intra house gas equipment in the apartment house, to maintenance of the intra room gas equipment in the apartment house and to maintenance of the intra house gas equipment in the apartment house (household) with observance of the requirements established by the legislation on gas supply in the Russian Federation;

"maintenance of the intra house and (or) intra room gas equipment" - works and services in maintenance of the intra house and (or) intra room gas equipment in the technical condition conforming to the normative requirements imposed to it;

"technical diagnosing of the intra house and (or) intra room gas equipment" - determination of technical condition of the intra house and (or) intra room gas equipment or their components, search and determination of defects of the specified equipment, and also determination of possibility of its further use.

3. Explosion safety, mechanical, fire, thermal, chemical, ecological and electric safety, and also operability of the intra house and intra room gas equipment in the course of their use and content are reached by the maintenance and repair of the specified equipment which are carried out based on the agreement signed between the customer and the contractor and also observance by the specified agreement parties of other requirements provided by these rules and the instruction for safe use of gas in case of satisfaction of household needs.
