This Procedure establishes procedure for issue of the conclusion by the Ministry of Health of the Azerbaijan Republic (further - "Ministry") for broadcasting of advertizing of the medicines provided without recipe of the doctor (further "drugs"), stipulated in Item 3 articles 17 of the Law of the Azerbaijan Republic "About advertizing".

2. The legal entity wishing to receive the decisions on advertizing of drugs (further "Applicant"), files in the Ministry petition in the form specified in appendix to this Procedure (Appendix No. 1). The companies which are engaged in production or wholesale pharmaceutical activities can act as the applicant.

3. The application is signed by the authorized person acting on behalf of the applicant and certified by seal.

4. The following documents are enclosed to the application:

4.1. the copy of the certificate on state registration of the applicant (the statement from the state register) and the charter, certified of notarial procedure;

4.2. copies of the documents confirming the personality and the powers of the authorized person certified of notarial procedure;

4.3. copy of the registration certificate of medicine;

4.4. data on advertizing of drugs (time, place, form and procedure for broadcasting, text, photo, video materials, etc.).

5. The statement which arrived in the Ministry is registered, considered, compliance of advertizing of medicine to the legislation is checked, in case of lack of shortcomings of the submitted documents or the bases for refusal the decision on issue of the conclusion no later than 10 working days since day of registration is made.
