About introduction of amendments to the Federal law "About Development of Small and Medium Entrepreneurship in the Russian Federation" and article 46 of the Federal law "About Technical Regulation"

Article 1

Bring in the Federal Law of July 24, 2007 No. 209-FZ "About development of small and medium entrepreneurship in the Russian Federation" (The Russian Federation Code, 2007, No. 31, Art. 4006; 2008, No. 30, Art. 3615; 2009, No. 31, Art. 3923; 2011, No. 50, Art. 7343) following changes:

Item 1 of part 1 of Article 4 to state 1) in the following edition:

"1) for legal entities - total share of the Russian Federation, subjects of the Russian Federation, municipalities, foreign legal entities, the public and religious organizations (associations), charity and other foundations in the authorized (share) capital (share fund) of the specified legal entities shall not exceed twenty five percent (except for assets of joint-stock investment funds and closed-end investment funds), the share belonging to one or several legal entities who are not subjects of small and medium entrepreneurship shall not exceed twenty five percent. The last restriction does not extend to economic societies, economic partnership which activities consist in practical application (implementation) of results of intellectual activities (programs for electronic computers, databases, inventions, useful models, industrial designs, selection achievements, topology of integral chips, know-how (know-how) on which exclusive rights belong to founders (participants) according to such economic societies, economic partnership - to budget, autonomous scientific institutions or the educational organizations of the higher education which are budgetary institutions, autonomous organizations, and also on legal entities, founders (participants) of which are the legal entities included in the list of legal entities approved by the Government of the Russian Federation providing state support of innovative activities in the forms established by the Federal Law of August 23, 1996 No. 127-FZ "About science and the state scientific and technical policy". Legal entities are included in the specified list according to the procedure, established by the Government of the Russian Federation, on condition of compliance to one of the following criteria:

a) legal entities are open joint stock companies which at least fifty percent of shares is in property of the Russian Federation, or economic societies in which these open joint stock companies have the right directly and (or) to dispose indirectly more than fifty percent of votes, falling on voting shares (shares) constituting the authorized capital of such economic societies or have opportunity to appoint sole executive body and (or) more than a half of structure of collegiate executive body, and also opportunity to determine election more than a half of structure of the board of directors (supervisory board);

b) legal entities are the state corporations founded according to the Federal Law of January 12, 1996 No. 7-FZ "About non-profit organizations";";

Part 4 of Article 18 to add 2) with the words "and (or) on the official sites of information support of subjects of small and medium entrepreneurship";

3) in Article 19:

a) 1 after words of "municipal information systems" to add part with words ", the official sites of information support of subjects of small and medium entrepreneurship in Internet network;

b) state part 2 in the following edition:

"2. Information systems, the official sites of information support of subjects of small and medium entrepreneurship in Internet network and information and telecommunication networks are created for the purpose of the ensuring subjects of small and medium entrepreneurship and the organizations forming infrastructure of support of subjects of small and medium entrepreneurship, information:

1) about implementation of federal development programs of subjects of small and medium entrepreneurship, regional development programs of subjects of small and medium entrepreneurship and municipal development programs of subjects of small and medium entrepreneurship;

2) about the number of subjects of small and medium entrepreneurship and about their classification by types of economic activity;

3) about number of the replaced workplaces in subjects of small and medium entrepreneurship according to their classification by types of economic activity;

4) about turnover of goods (works, services) made by subjects of small and medium entrepreneurship according to their classification by types of economic activity;

5) about financial and economic condition of subjects of small and medium entrepreneurship;

6) about the organizations forming infrastructure of support of subjects of small and medium entrepreneurship, conditions and about procedure for rendering by such organizations of support to subjects of small and medium entrepreneurship;

7) about the state-owned and municipal property included in the lists specified regarding the 4th article 18 of this Federal Law;

8) about the announced competitions on providing financial support to subjects of small and medium entrepreneurship and to the organizations forming infrastructure of support of subjects of small and medium entrepreneurship;

9) other information, necessary for development of subjects of small and medium entrepreneurship (economic, legal, statistical, production and technological information, information in the field of marketing).";

c) add part 3 with words ", and (or) the official sites of information support of subjects of small and medium entrepreneurship in Internet network created by the specified bodies;

d) add with part 4 following of content:

"4. Requirements to information which is posted online "Internet" according to parts 2 and 3 of this Article are established by the federal executive body authorized by the Government of the Russian Federation.".

Article 2

Article 46 of the Federal Law of December 27, 2002 No. 184-FZ "About technical regulation" (The Russian Federation Code, 2002, No. 52, Art. 5140; 2007, No. 19, Art. 2293; 2009, No. 48, Art. 5711; 2010, No. 1, Art. 6; 2011, No. 30, Art. 4603; 49, the Art. 7025) to add No. with Item 12 of the following content:

"12. Before adoption of the Federal Law governing the relations on recognition and the subsequent assessment of conformity of test laboratories (centers) to the principles of proper laboratory practice, the corresponding principles of proper laboratory practice of Organization for Economic Cooperation and Development, the specified recognition and assessment of conformity are performed at the initiative of test laboratories (centers) by national authority on accreditation according to the procedure, established by the Government of the Russian Federation.

By such procedure collection from the applicant of payment for holding procedures of recognition and assessment of conformity of test laboratory (center) to the principles of proper laboratory practice specified in paragraph one of this Item can be provided.

The list of documents in the field of standardization which observance of requirements by test laboratories (centers) when carrying out researches by them provides compliance of these test laboratories (centers) to the principles of proper laboratory practice specified in paragraph one of this Item is determined by the Government of the Russian Federation.".

Article 3

1. This Federal Law becomes effective from the date of its official publication, except for article 1 of this Federal Law.

2. Article 1 of this Federal Law becomes effective since October 1, 2013.
