1. Approve enclosed:

Rules of development, approval, approval and adjustment of investing programs of the organizations performing hot water supply, cold water supply and (or) water disposal;

Rules of development, approval and adjustment of production programs of the organizations performing hot water supply, cold water supply and (or) water disposal.

Rules of development, approval, approval and adjustment of investing programs of the organizations performing hot water supply, cold water supply and (or) water disposal

I. General provisions

1. These rules determine procedure for development, approval, approval and adjustment of investing programs of the organizations performing hot water supply, cold water supply and (or) water disposal with use of centralized systems (except for the organizations performing hot water supply with use of open hot water supply) (further respectively - investing program, the regulated organizations), including actions plans by reduction of quality of drinking water in compliance with the established requirements, actions plans on reduction of quality of hot water in compliance with the established requirements, requirements to structure of investing programs, procedure for consideration of disagreements in case of approval of investing programs and procedure of control of their accomplishment.

2. The project of investing program is developed by the regulated organization, the investing program affirms authorized body of the executive authority of the subject of the Russian Federation or authorized body of local self-government of the settlement (the city district) if the law of the subject of the Russian Federation to it delegates powers according to investing program (further - authorized body of local self-government of the settlement (the city district), in coordination with executive bodies of subjects of the Russian Federation in the field of state regulation of rates (in case of approval of investing programs by local government bodies or executive bodies of subjects of the Russian Federation into which power establishment of regulated prices (rates) is not included.

3. If the investing program affirms authorized body of the executive authority of the subject of the Russian Federation, the project of investing program is subject to approval of local government bodies of settlements (city districts) in the territory of which objects of centralized system of cold water supply are located, of centralized system of hot water supply (further - centralized systems of water supply) and (or) water disposals and capital construction projects of subscribers which pumps water and at which sewage with use of these systems (further - local government bodies of settlements (city districts) is accepted, and with executive bodies of subjects of the Russian Federation in the field of state regulation of rates (in case of approval of investing programs by executive bodies of subjects of the Russian Federation, into which power establishment of regulated prices (rates) according to Items 12 - 15 these rules is not included.

4. Approval of investing program in the absence of the scheme of water supply and water disposal approved in accordance with the established procedure is not allowed.

5. If objects of centralized systems of water supply and (or) water disposal and capital construction projects of subscribers which pumps water and (or) at which sewage with use of these systems is accepted are in borders of several subjects of the Russian Federation, the investing program affirms authorized body of the executive authority of the subject of the Russian Federation in which the amount of the pumped water and (or) the accepted sewage from subscribers in kind makes the greatest share (percent) of total amount of the pumped water and (or) the accepted sewage in kind, in coordination with authorized bodies of the executive authority of subjects of the Russian Federation in the territory of which part of objects of centralized systems of water supply and (or) water disposal is located.

II. Specification on development of investing program

6. The project of investing program is developed on the basis of the specification on development of investing program of the regulated organization (further - the specification). The specification develops and approves local government body of the settlement (the city district). The specification on development of investing program of the regulated organization which acquired rights of possession and uses of centralized systems of water supply and (or) water disposal, separate objects of such systems based on the concessionary agreement providing obligations of the specified organization for creation and (or) reconstruction of centralized systems of water supply and (or) water disposal, separate objects of such systems with acquisition for the term established by the concessionary agreement, rights of possession and uses of such systems, objects (further - the concessionary agreement), shall correspond to conditions of the concessionary agreement.
