The government of the Russian Federation and the Government of People's Republic of China which further are referred to as with the Parties, considering general interest in preserving and rational use of live marine resources in sea areas, based on the principles stated internationally the actions according to the prevention, control and liquidation illegal which are not reported and non-regulated fishery, approved by the Food and Agriculture Organization of the United Nations (FAO) on June 23, 2001, realizing threat to preserving, rational use and regulation of the live marine resources living in sea areas owing to their trade with violation of the law of the states of the Parties, understanding need of acceptance by the Parties of adequate measures for the purpose of the prevention, control and liquidation illegal, unreported and unregulated fishing of live marine resources in sea areas, and also export from the territory of the states of the Parties (import to the territory of the states of the Parties) of live marine resources with violation of the law of the states of the Parties, wishing and to develop and expand further on stable and long-term basis trade in live marine resources between the states of the Parties, agreed as follows:

Article 1

1. In this agreement the following concepts are applied:

1) "competent authorities": concerning the Russian Federation - Federal Agency for Fishery, the Federal Customs Service, Federal Security Service of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation; concerning People's Republic of China - the Ministry of Agriculture of People's Republic of China, the Head customs authority of People's Republic of China;

2) "live marine resources" - catch of types of the live marine resources specified in Appendix No. 1 to this agreement and products from them;
