About approval of Rules of transportation of passengers, baggage and loads on air-lines of the Republic of Kazakhstan
For the purpose of reduction of base of regulatory legal acts in the field of civil aviation of the Republic of Kazakhstan according to requirements of the Presidential decree of the Republic of Kazakhstan, the valid law, of December 20, 1995 N 2697 "About use of airspace and activities of aircraft of the Republic of Kazakhstan" and the Law of the Republic of Kazakhstan of December 15, 2001 N 271-II "About state regulation of civil aviation" I order:
1. Approve the enclosed Rules of transportation of passengers, baggage and loads on air-lines of the Republic of Kazakhstan.
2. To impose control of execution of this order on the vice-chairman of Committee of civil aviation B. M. Naurzaliyev.
3. This order becomes effective from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan.

1. These rules are applied to all engineering procedures of airborne transportations of passengers, baggage and loads, including the servicing relating to them which are performed by Carriers of the Republic of Kazakhstan.
2. The transportations which are carried out according to these rules submit to operation of the relevant laws, resolutions and instructions of state bodies of any country, on the territory, from the territory or through the territory of which such transportations are performed.
3. In these rules the following concepts and terms are used:
1) Airline - any air-transport organization performing air traffics or offering the services in this area.
2) the Agent - the physical person or legal entity representing Carrier which is authorized direct it or from his name to act in case of accomplishment of all formalities connected with arrival, departure and registration of the aircraft of this Carrier, crew, passengers, baggage, load, mail and bortpripas.
3) the Act of defects in transit baggage - (PIR - Property IrreguLarity Report), load (CIR - Carqo IrrequLarity Report) the document processed by Carrier in the presence of the passenger (receiver) immediately after detection of the harm done to baggage (load) which transportation is made by aircrafts of one or several Carriers. The act is signed by Carrier and the passenger (receiver).
4) the Airport - the complex of constructions intended for acceptance and sending aircrafts, servicing of airborne transportations and having airfield, air terminal, other constructions, and also the necessary equipment for these purposes.
5) the international airport - the airport providing the international airborne transportations at which customs, border, sanitary and quarantine control is organized.
6) the Airport (Item) of appointment - the airport (Item) to which the passenger, baggage or load, according to the agreement of airborne transportation shall be brought.
7) the Airport (Item) of stop - the intermediate airport (Item) at which the passenger according to the agreement of airborne transportation temporarily interrupts flight.
8) The airport (Item) of departure - the airport (Item) from which, according to the agreement of airborne transportation, transportation of the passenger, baggage or load begins.
9) the Airport (Item) of transfer - the airport (Item) specified in the ticket or the freight bill in which according to the agreement of airborne transportation the passenger makes change or is performed transhipment of cargo from one flight to another for further following along transportation route.
10) Baggage - the personal belongings of passengers or crew transported onboard the aircraft under the agreement with Carrier. The term "baggage" is understood as registered, and as the unregistered baggage.
11) the Baggage registered - baggage of the passenger which is accepted by Carrier for shipment under the responsibility for its safety and on which it issued the luggage receipt and luggage label.
12) the Baggage sent - the baggage sent not to destination because of Carrier.
13) Baggage unclaimed - baggage which arrived to the airport (Item) of appointment specified in luggage label and was not received by the passenger.
14) Baggage unregistered - baggage of the passenger, except registered, transported on the aircraft and placed in its luggage compartments and passenger salons. It is delivered aboard the aircraft by passengers. It is transported under control and responsibility of Carrier, except for the period when the baggage is in case of the passenger.
15) Baggage unaccompanied - baggage which is transported as load on another or on the same aircraft on which there is person which is its owner.
16) Baggage paid - part of mass of baggage which exceeds the regulation of free conveyance established by Carrier or requires obligatory payment, irrespective of the specified regulation.
17) the Luggage number label - the document issued by Carrier for identification of the registered baggage.
18) the Ticket - (The passenger ticket and the luggage receipt / Passengir Ticket and Baggage Check) the document for transportation issued by Carrier or his agents, certifying the conclusion of the agreement of airborne transportation of the passenger and his condition.
