1. Approve the enclosed Rules of primary resettlement of ethnic Kazakhs before assignment of the status of kandas and internal migrants, in case of resettlement within regional quota of acceptance of immigrants, and also members of their families at will, in the centers of temporary placement.

2. Declare invalid the order of the Minister of Internal Affairs of the Republic of Kazakhstan of October 28, 2011 No. 570 "About approval of Rules of primary resettlement of ethnic Kazakhs and members of their families, at will, before assignment of the status of the oralman in the centers of temporary placement" (it is registered in the Register of state registration of regulatory legal acts for No. 7310, No. 611-615) is published in the Egemen Kazakstan newspaper of December 10, 2011.

3. To committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (Sarbasov A. A.) provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of Egemberda E. K.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules and terms of primary resettlement of ethnic Kazakhs and members of their families, at will, before assignment of the status of kandas, and also internal migrants in case of resettlement within regional quota of acceptance of immigrants in the centers of temporary placement (further – Rules) are developed according to Item 1 of article 24 of the Law of the Republic of Kazakhstan of 2011 on July 22 "About population shift" (further – the Law) and determine procedure for primary resettlement and term of stay of ethnic Kazakhs and immigrants, and also members of their families in the centers of temporary placement.

2. In these rules the following basic concepts are used:

1) the immigrant – the internal migrant moving to the regions determined by the Government of the Republic of Kazakhstan;

2) the center of temporary placement (further – the Center) – the dwelling intended for temporary residence of ethnic Kazakhs and immigrants, and also members of their families;

3) the ethnic Kazakh – the foreigner or the stateless person of the Kazakh nationality.

Chapter 2. Procedure for primary resettlement of ethnic Kazakhs and immigrants, and also members of their families in the Center and the term of their stay

3. For primary resettlement in the Center the ethnic Kazakh or the immigrant submits the application in form according to appendix 1 to these rules to local executive body in the field of population shift.

The application is considered by local executive body in the field of population shift in day of its giving.

4. The statement is registered in the magazine of registration of primary resettlement of the ethnic Kazakh or immigrant, and also members of their families in the Center of temporary placement for form according to appendix 2 to these rules.

5. After consideration of the application by local executive body in the field of population shift the direction in form according to appendix 3 to these rules is issued and is registered in the magazine of registration of primary resettlement of ethnic Kazakhs or immigrants, and also members of their families in the Center.

6. The ethnic Kazakh or the immigrant, and also members of their families are settled in the Center within one working day after receipt of the direction.

7. In case of non-compliance with term of resettlement in the Center the ethnic Kazakh or the immigrant, and also members of their families lose the right to resettlement. At the same time behind them the right of repeated filing of application to primary resettlement in the Center remains.

8. In the absence of free beds in the Center in adoption of the statement and its registration does not refuse.

In this case the ethnic Kazakh or the immigrant, and also members of their families are enlisted in the reserve created by local executive body in the field of population shift according to the procedure of priority of filing of application without issue of the direction.

9. In case of release of beds in the Center the local executive body in the field of population shift issues the direction to the ethnic Kazakh or immigrant, and also members of their families for resettlement in the Center according to the procedure of priority.

10. Resettlement in the Center of other persons, except the ethnic Kazakh or the immigrant, and also members of their families, is not allowed.

11. The ethnic Kazakh and members of his family live in the Center before receipt of the status of kandas, the immigrant and members of his family before execution of an employment agreement with the employer, no more than 10 calendar days.

12. The ethnic Kazakh and members of his family from the date of assignment or refusal in assignment of the status of kandas, the immigrant and members of his family from the date of execution of an employment agreement or in case of refusal in execution of an employment agreement with the employer exempt the room provided to them in the Center no later than five calendar days.
