Procedure for providing the Public criminal and executive service with ware property of personnel

General questions

1. This Procedure determines the mechanism of ware providing personnel of the Public criminal and executive service - faces of the private and the commanding structure, specialists who do not have special ranks, and the workers working according to employment contracts.

2. Material providing is the personnel requirements satisfaction in dress code, footwear, underwear, warm and bedding, equipment, fabrics for tailoring of dress code, narukavny signs and signs of distinction, special clothes and footwear, sanitary and economic property, clothes on point duty, repair materials (further - ware property) that allows to create necessary conditions for accomplishment by personnel of office tasks.

3. The real property on purpose is material property of the current providing, and in use is divided into property of private use and inventory property.

The ware property is acquired by public institution "General directorate of the Public criminal and executive service of Ukraine" for Administration of the Public criminal and executive service (further - Administration), interregional managements concerning execution of criminal penalties and probation of Ministry of Justice (further - interregional managements), organizations of execution of punishments, pre-trial detention centers, paramilitary forces, educational institutions of the Public criminal and executive service (further - organizations of education), public institution "Center of probation" - for authorized bodies concerning probation, public institution "Center of health protection of the Public criminal and executive service of Ukraine" - for institutions of health care of the Public criminal and executive service (further - bodies and organizations) on a centralized basis according to the procedure, stipulated by the legislation.

The decentralized acquisition of ware property by interregional managements, organizations of execution of punishments, by pre-trial detention centers, educational institutions according to the procedure, stipulated by the legislation is allowed.

4. The ware property is released according to the procedure, established by Ministry of Justice:

public institution "General directorate of the Public criminal and executive service of Ukraine" - to Administration, interregional managements, organizations of execution of punishments, pre-trial detention centers, paramilitary forces, organizations of education, control room of public institution "General directorate of the Public criminal and executive service of Ukraine";

public institution "Center of probation" - to authorized bodies concerning probation;

public institution "Center of health protection of the Public criminal and executive service of Ukraine" - to healthcare institutions of the Public criminal and executive service of Ukraine.

5. Real property of private use by property of persons to whom it is issued, from the moment of its obtaining, except the faces of the ordinary and younger commanding structure studying in organizations of education (further - cadets).

The inventory property is state-owned property and is on accounting in body, organization which issued it in use.

6. The quantity and terms of carrying or operation of the pieces of ware property issued on one person one bed, post or the fire truck, are determined according to regulations of providing the Public criminal and executive service with the ware property of personnel approved by the resolution of the Cabinet of Ministers of Ukraine of August 14, 2013 No. 578 (further - providing regulations).

7. Term socks or operation of pieces of ware property is established according to regulations of providing time during which they shall be in use or operation.

Terms of carrying or operation of pieces of ware property of private use are estimated from the date of emergence of the right to their obtaining.

Terms of carrying or operation of pieces of inventory property are established from the date of their actual issue. Storage time of inventory property in warehouses socks or operation is not set off in time. For pieces of inventory property of seasonal use the term of carrying or operation within one season is set off in one year.

8. The real property of private use is issued to persons from among personnel free of charge on regulations of supply No. 1-5, and inventory property - on regulations No. 6-13.

The right to providing with ware property on the established regulations of supply is had:

face of the private and the commanding structure - from the date of assignment by it of the corresponding special ranks and/or appointment to positions;

cadets - from the date of their transfer in lists of educational institutions;

specialists who have no special ranks, and other workers who work according to employment contracts, - from the date of appointment to the corresponding positions.

Issue of ware property in private use is made according to anthropometrical data (growth, amount of breast, neck, head, the footwear size).

9. Providing persons with ware property from among personnel is performed in bodies of Administration, interregional managements, organizations of execution of punishments, pre-trial detention centers, paramilitary forces, organizations of education, public institution "Center of probation" and authorized bodies concerning probation, public institution "Center of health protection of the Public criminal and executive service of Ukraine" and healthcare institutions of the Public criminal and executive service, control room of public institution "General directorate of the Public criminal and executive service of Ukraine" where they serve or work. Statement on ware providing faces of the private and the commanding structure of the Public criminal and executive service (further - face of the private and the commanding structure) in body or organization is performed based on the order of the head of body or organization on position assignment and the certificate on pieces of ware property (further - the ware certificate) in form according to appendix 1, and in case of assignment to person of primary special rank or position assignment of the specialists who do not have special ranks, and the workers working according to employment contracts - based on the relevant order of the head of body or organization.

10. Pieces of ware property are issued to persons according to the procedure of planned providing personnel with it according to providing regulations according to terms of their carrying or operation.

Issue of pieces of ware property over the established regulations, to the third-party companies, organizations or the organizations or persons who do not serve or do not work in relevant organ or organization, it is forbidden.

Early issue of pieces of ware property is allowed only in case:

changes of dress code by results of recertification;

assignments to faces of the younger commanding structure of special rank of the second lieutenant of internal service, the lieutenant of internal service (issue of peak-cap);

assignments of the next rank of the major of internal service (issue of trousers of the senior commanding structure);

assignments of special rank of the lieutenant general of internal service (issue of single-breasted coat and uniform with trousers);

assignments of special rank of the colonel general of internal service (issue of peak-cap).

The ware property is issued to persons from among personnel for use forward during further service or work.

11. In bodies and organizations transitional inventories of objects of dress code for providing for the first time the employed faces of the private and the commanding structure are created in necessary quantity.

12. The next issue of pieces of ware property to persons from among personnel is performed after the terms established according to regulations of providing socks or operation of earlier received similar objects.

13. The ware property (except inventory things, next-to-skin and bed linen) is issued to cadets in their private use.

14. Along with receipt of new pieces of ware property cadets shall hand over in accordance with the established procedure similar objects which were in their use, on structure of organization of education.

In case of assignment to the cadet of special rank of the average commanding structure or expel of the cadet from organization of education previously issued ware property of private use is given it on warehouse of organization of education.

Pieces of ware property which were in use of cadets after cleaning and repair are transferred to substitution fund.

In case of loss of pieces of ware property because of the cadet similar pieces of property from substitution fund are issued to it. The cost of the lost pieces of ware property keeps from the cadet according to Item 64 of this Procedure taking into account their depreciation.

15. Persons who leave from service in the Public criminal and executive service (further - dismissals from service) after the termination of organizations of education, are not provided with ware property.

16. Signs of distinction are issued to faces of the private and the commanding structure along with dress code objects on which their carrying is provided. Samples of narukavny signs of Administration, interregional managements, public institution "Center of probation" are established by Ministry of Justice.

Signs of distinction and shoulder straps in the quantity necessary for dress code objects in addition are issued to faces of the commanding structure in case of assignment of the next special rank, terms socks of which did not end.

Ensuring private use with ware property

17. The ware property of private use, as a rule, is issued to faces of the private and the commanding structure in finished form. If to pick up separate pieces of ware property of private use of the size and growth there is no opportunity, their custom tailoring on the specialized enterprises which are not relating Ministry of Justice to the management sphere with payment of cost of the performed works at the expense of the budgetary funds provided on the specified purposes is performed.

Besides, custom tailoring on specialized enterprises of dress code is performed for faces of the senior (in special colonelcy of internal service) and the highest commanding structure.

18. Face of the private and the commanding structure, sent to executive bodies, are provided with ware property of private use in the place of service in business trip.

Face of the private and the commanding structure which are disposed in long business trips with preserving in lists of bodies and organizations are provided with ware property of private use in the place of service in business trip.

In some cases in case of business trip of faces of the private and the commanding structure for service in other bodies and organizations at will ensuring private use with ware property can be performed in the place of the actual service.

19. In case of transfer of faces of the private or the commanding structure for service in other bodies or organizations the pieces of ware property of private use of the previous place of service ought in day of disposal are issued to them and the ware certificate which is the basis for delivery to ware providing on the new duty station is written out.

In case of lack of necessary pieces of ware property of private use in body or organization in day of disposal of specified persons to the new duty station providing them is performed by such objects of the new duty station according to accounting data of the ware certificate.
