According to article 25 of the Law of Ukraine "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", the Presidential decree of Ukraine of February 11, 2013 "About the National implementation plan of provisions of the Communique of the Seoul summit on nuclear safety for 2013 - 2014" and for the purpose of ensuring state regulation in the field of physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation I ORDER to No. 73:

1. Approve the Procedure for forming and cultural development of security of the nuclear installations and objects intended for the treatment of radioactive waste, other sources of ionizing radiation and the Instruction for evaluating condition of culture of security of the nuclear installations, objects intended for the treatment of radioactive waste, other sources of ionizing radiation which is applied.

2. To submit to management concerning nuclear security and international cooperation (Kushka V.M.) this order to the Ministry of Justice of Ukraine on state registration in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the vice-chairman Makarovskaya O. A.

Procedure for forming and cultural development of security of the nuclear installations and objects intended for the treatment of radioactive waste, other sources of ionizing radiation

І. General provisions

1.1. This Procedure is aimed at providing achievement of high level of culture of security of the nuclear installations and objects intended for the treatment of radioactive waste, other sources of ionizing radiation (further - object).

1.2. In this Procedure terms are used in such values:

the statement concerning policy on physical protection, recognitions of priority of culture of security - the written instrument in which the licensee states the understanding to role of physical protection of objects in ensuring their security taking into account the importance of such security for ensuring nuclear and radiation safety;

criteria of culture of security - signs, on compliance to which assessment of condition of culture of security of specific object is carried out;

assessment of condition of culture of security - process of establishment of compliance of condition of culture of security to requirements of the legislation.

Other terms are used in the values given in the Laws of Ukraine "About use of nuclear energy and radiation safety", "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation".

1.3. Achievement of high culture of security of object is performed by accomplishment of specific measures during forming, development and maintenance of culture of security of object.

1.4. The purpose of forming, development and maintenance of high level of culture of security of object is reduction of risk of making of illegal actions concerning object by the maximum taking into account of human factor.

1.5. The culture of security of object is based on understanding by the head, other officials, personnel of the licensee of reality of existence of threat of making of illegal actions concerning object and role of physical protection in opposition to such threat.

1.6. The licensee makes the statement concerning policy on physical protection, recognitions of priority of culture of security.

1.7. The licensee performs actions for forming, development and maintenance of high level of culture of security according to the plans approved by the head of the licensee.

Plans provide financial, personnel and material logistics of actions for forming, development and maintenance of high level of culture of security of object.

1.8. The licensee provides periodic evaluating condition of culture of security and by its results takes necessary measures.

II. Actions for forming of culture of security

2.1. Implementation of actions for forming of culture of security begins with the statement, stipulated in Item 1.6 Sections I of this Procedure.

2.2. The head of the licensee performs such actions for forming of culture of security of object:

will organize development and approves the actions plan on forming of culture of security of object, controls the course of its accomplishment;

creates at personnel of object belief that the threat of making of illegal actions concerning object is real and that fulfillment of requirements of physical protection is obligatory for personnel;

will organize and provides forming of business relations between heads and subordinates;

designates person responsible for condition of culture of security of object (further - the responsible person), determines its obligations and the rights;

appoints on representation of the responsible person of the coordinator on culture of security and responsible persons on culture of security in divisions which provide operation of object, use, storage of radioactive materials (further - responsible persons in divisions), determines their obligations and the rights;

provides training in questions of culture of security of the responsible person and the coordinator on culture of security in training centers of the state system of professional training, retraining and advanced training of specialists in physical protection, accounting and control of nuclear materials;

creates proper conditions for accomplishment by personnel of division of physical protection of the obligations;

creates policy of motivation of personnel of division of physical protection and other personnel;

provides implementation on object of the best experiment on forming of culture of security.

2.3. The responsible person performs such actions for forming of culture of security of object:

develops together with the coordinator on culture of security the actions plan on forming of culture of security of object, analyzes the course of its accomplishment and reports on analysis results on the head of the licensee;

provides personnel training of object concerning culture of security;

participates in forming of policy of motivation of personnel of division of physical protection and other personnel;

explains to the population which lives in the region of arrangement of object, value of physical protection and culture of security in ensuring safe operation of object;

coordinates work of the coordinator on culture of security and responsible persons in divisions;

makes offers to the head of the licensee concerning evaluating condition of culture of security of object and participates in its carrying out.

2.4. The coordinator on culture of security performs such actions for forming of culture of security of object:

participates in plan development of actions for forming of culture of security of object, coordinates activities of responsible persons in divisions on its accomplishment;

plans and performs actions for increase in awareness of personnel of object concerning culture of security;

participates in the organization and carrying out periodic personnel training of object for culture of security;

performs actions for explanation concerning need of forming of culture of security;

analyzes characteristic violations of requirements of physical protection, information on influence of human factor on condition of physical protection of object, considers analysis results in the activities and submits to the responsible person proposals on forming of culture of security of object;

submits to the responsible person proposals concerning evaluating condition of culture of security of object or its separate divisions, participates in its carrying out.

2.5. The head of the licensee makes the decision on accomplishment of actions for forming of culture of security of object if by results of assessment of condition of culture of security it is determined that the condition of culture of security for the period of implementation of actions for forming of culture of security answers the criteria determined in appendix 1 to this Procedure.

III. Actions for development and maintenance of high level of culture of security

3.1. The head of the licensee performs such actions for development and maintenance of high level of culture of security of object:

will organize development and approves the actions plan on development and maintenance of high level of culture of security of object and controls the course of its accomplishment;

provides maintenance of business relations between heads and subordinates who remove origins of conflict situations, minimize cases of concealment by personnel of division of physical protection of the made mistakes and the wrong actions;

implements and enhances policy of motivation of personnel of division of physical protection and other personnel;

provides planned advanced training concerning culture of security of the responsible person and the coordinator on culture of security in training centers of the state system of professional training, retraining and advanced training of specialists in physical protection, accounting and control of nuclear materials;

provides maintenance of knowledge of personnel of object concerning culture of security;

provides implementation on object of the best experiment on development and maintenance of high level of culture of security;

participates in informing the population which lives in the region of arrangement of object, concerning role of culture of security in safety of object.

3.2. The responsible person performs such actions for development and maintenance of high level of culture of security of object:

together with the coordinator on culture of security develops the actions plan on development and maintenance of high level of culture of security of object, analyzes the course of its accomplishment and reports on analysis results on the head of the licensee;

involves personnel of division of physical protection in activities for development and maintenance of high level of culture of security of object;

provides periodic study of personnel of object concerning culture of security;

explains to the population which lives in the region of arrangement of object, task of physical protection and role of the population in task performance of physical protection;

participates in realization and enhancement of policy of motivation of personnel of division of physical protection and other personnel;

coordinates work of the coordinator on culture of security and responsible persons in divisions;

brings to the head of the licensee of the offer concerning evaluating condition of culture of security of object and participates in its carrying out.

3.3. The coordinator on culture of security performs such actions for development and maintenance of high level of culture of security of object:

together with the responsible person develops the actions plan on development and maintenance of high level of culture of security of object, analyzes the course of accomplishment of the plan and reports on the responsible person on problems which arise during its realization;

coordinates activities of responsible persons in divisions on accomplishment of the actions plan on development and maintenance of high level of culture of security;

will organize and participates in implementation of actions for distribution of understanding of need of forming of culture of security, analyzes their efficiency, on analysis results takes necessary measures;

participates in the organization and carrying out periodic personnel of study of object for culture of security;

performs questioning and poll of personnel of division of physical protection and personnel of other divisions of object for the purpose of receipt of information on condition of culture of security in divisions;

submits to the responsible person proposals concerning evaluating condition of culture of security of object and participates in its carrying out.

3.4. The head of the licensee makes the decision that the culture of security of object is at the high level if by results of the carried-out assessment of condition of culture of security it is determined that the condition of culture of security answers the criteria determined in appendix 2 to this Procedure.

ІV. Assessment of condition of culture of security

4.1. The purpose of assessment of condition of culture of security of object is receipt of reliable information by the head of the licensee about condition of culture of security of object.

4.2. Assessment of condition of culture of security of object is carried out at least once a year according to Gosatomregulirovaniya's instruction of Ukraine for evaluating condition of culture of security of the nuclear installations, objects intended for the treatment of radioactive waste, other sources of ionizing radiation.

4.3. Results of assessment of condition of culture of security of object are displayed in annual reports of the licensee on condition of system of physical protection.

 

                                                                  

Appendix 1

to the Procedure for forming and cultural development of security of the nuclear installations and objects intended for the treatment of radioactive waste, other sources of ionizing radiation (Item 2. 5)

Criteria of culture of security for the period of implementation of actions for forming of culture of security

Criteria of culture of security for the period of implementation of actions for forming of culture of security are:

1) the statement of the head of the licensee concerning policy on physical protection and recognition of priority of culture of security, brought to each person from personnel of object;

2) heads and other personnel of object underwent study concerning physical protection and are acquainted with basic provisions of culture of security;

3) the personnel of object are warned that observance of the licensee of policy on physical protection proclaimed the head is obligatory for each person from personnel;

4) actions for understanding by personnel of division of physical protection of importance of recognition of priority of culture of security are performed;

5) obligations of each person from personnel of division of physical protection are accurately determined, documented and displayed in the job description of person;

6) proper conditions for accomplishment by personnel of division of physical protection of the obligations, instructions, installations and the procedures for physical protection clear to personnel of division are created;

7) the address with information with limited access is performed on object according to requirements of the legislation of Ukraine;

8) the number of personnel necessary for ensuring effective functioning of system of physical protection, his competence are constantly analyzed and documented;

9) the list of positions of personnel of object on which robot requires the admission to accomplishment of special works, is developed and approved according to requirements of the legislation;

10) categories of admissions of personnel of object to accomplishment of special works answer categories of special works which the personnel perform;

11) actions for ensuring continued operation of system of physical protection are performed according to requirements of the legislation;

12) the operations procedure of personnel of division of physical protection in the conditions of emergency situations on object is displayed in job descriptions of personnel, the personnel underwent the corresponding training;

13) the personnel of object which belong to forces of the object plan of interaction in case of diversion making underwent the corresponding training, training and examination and abilities concerning accomplishment of obligations in crisis situations;

14) the responsible person, the coordinator on culture of security and responsible persons in divisions of object are designated;

15) obligations and the rights of the responsible person, the coordinator on culture of security and responsible persons in divisions of object are accurately determined, documented and displayed in their job descriptions;

16) the responsible person, the coordinator on culture of security, responsible persons in divisions of object underwent advanced training on culture of security in educational institutions of the state system of professional training, retraining and advanced training of specialists in physical protection, accounting and control of nuclear materials;

17) the policy of motivation of personnel is developed and takes root;

18) the responsible person controls the course of accomplishment of the actions plan on forming of culture of security, provides the help to the coordinator on culture of security and to responsible persons in divisions of object when implementing of the obligations by them;

19) responsible persons in divisions of object perform actions for forming of culture of security at personnel of the divisions;

20) the explanation to the population which lives in the region of arrangement of object, concerning value of physical protection and culture of security in ensuring safe operation of object is carried out;

21) the course of accomplishment of the plan for forming of culture of security periodically, at least once a quarter is considered by the head of the licensee. By results of consideration necessary measures are taken;

22) the head of the licensee controls implementation of assessment of condition of culture of security on object.

 

Appendix 2

to the Procedure for forming and cultural development of security of the nuclear installations and objects intended for the treatment of radioactive waste, other sources of ionizing radiation (Item 3. 4)

Criteria of high level of culture of security

Criteria of high level of culture of security are such:

1) the head of the licensee the behavior and actions is example for subordinates concerning accomplishment of provisions of the proclaimed policy on physical protection and recognition of priority of culture of security;

2) the personnel of object are confident in existence of threats to object, realize scales of effects of realization of these threats, understand value of actions for physical protection;

3) each person from personnel of object realizes the personal liability for safety of object;

4) the head of the licensee, his deputies, heads of structural divisions of object and responsible persons in divisions of object in case of fulfillment of requirements of physical protection show the understanding of culture of security;

5) the head of the licensee, his deputies responsible for condition of culture of security, the coordinator on culture of security, responsible persons in divisions of object periodically improve skills on culture of security in educational institutions of the state system of professional training, retraining and advanced training of specialists in physical protection, accounting and control of nuclear materials;

6) the coordinator on culture of security with involvement of responsible persons in divisions of object analyzes condition of physical protection of object, influence of human factor on condition of physical protection, prepares recommendations concerning taking into account of human factor when implementing actions for ensuring physical protection of object;

7) modern scientific achievements, in particular on psychology, for the purpose of reduction of influence of human factor by condition of physical protection are applied;

8) the policy of motivation of personnel is thought deeply over and is skillfully applied;

9) decisions on physical protection are deeply proved, the opinion of personnel of division of physical protection is considered;

10) the reasons of incidents which caused are determined and analyzed or can cause crisis situation, radiation effects of these incidents are considered;

11) the personnel of object show vigilance, pay attention to unusual incidents and acts of people, suspicious pieces, signs of intervention in work of technical means of system of physical protection, the systems important for safety of object, processing equipment of object and report on it on the heads;

12) the personnel of object periodically undergo training and trainings concerning actions in the conditions of emergency and crisis situations;

13) the personnel of object are provided with the individual protection equipment necessary for actions in the conditions of emergency and crisis situations;

14) to personnel of division of physical protection charge to perform only those works for which accomplishment the personnel have sufficient knowledge, skills;

15) the personnel of object strictly adhere to procedures for physical protection and realize that these procedures are result of generalization of knowledge and experience;

16) the personnel of division of physical protection obtain information necessary for it for accomplishment of the obligations, participate in meetings on physical protection, raise the production questions at meetings, receive answers concerning the measures taken according to earlier raised questions receive explanations concerning policy of the licensee on physical protection;

17) problematic issues on physical protection are resolved in a complex and taking into account experience, skills of personnel;

18) the international and domestic experiment on security cultural development accumulates, analyzed, the best experience takes root on object;

19) assessment of the changes implemented on object in the field of physical protection for the purpose of confirmation of the expected results is performed;

20) the quality management system covers all aspects of activity in the field of physical protection;

21) the personnel of division of physical protection report on the heads on the mistakes and/or the wrong actions allowed by it during execution of the obligations, on object the analysis of the reasons of the made mistakes or the wrong actions for the purpose of prevention of such mistakes and actions in the future is performed;

22) division managers of physical protection consider the voluntary statement of personnel for the made mistakes or the wrong actions during consideration of the made mistakes and/or the wrong actions;

23) the coordinator on culture of security interacts with heads and personnel of divisions concerning culture of security;

24) recommendations of the coordinator on culture of security timely are considered, by results of consideration necessary measures are taken;

25) the coordinator on culture of security regularly reports on the responsible person on the course of accomplishment of the actions plan on development and maintenance of high level of culture of security;

26) the responsible person analyzes the course of accomplishment of the actions plan on development and maintenance of high level of culture of security, reveals the problems connected with accomplishment of the plan, develops ways of their decision and reports on it on the head of the licensee;

27) the head of the licensee at least once a quarter considers the course of accomplishment of the actions plan on development and maintenance of high level of culture of security, by results of consideration takes necessary measures;

28) the population which lives in the region of arrangement of object is periodically informed on condition of culture of security in safety of object;

29) assessment of condition of culture of security on object is performed, by results of assessment of condition of culture of security necessary measures are taken.

Instruktsiyapo to evaluating condition of culture of security of nuclear installations, the objects intended for the treatment of radioactive waste, other sources of ionizing radiation

I. General provisions

1.1. This Instruction contains explanations concerning implementation by the operating organizations and other licensees (further - the licensee) estimates of condition of culture of security of nuclear installations, objects intended for the treatment of radioactive waste, other sources of ionizing radiation (further - object).

1.2. In this Instruction terms are used in the values given in the Laws of Ukraine "About use of nuclear energy and radiation safety", "About physical protection of nuclear installations, nuclear materials, radioactive waste, other sources of ionizing radiation", "About allowing activities in the field of use of nuclear energy".

1.3. Assessment of condition of culture of security of object is performed with frequency which allows the head of the licensee to obtain reliable data about condition of culture of security of object and to timely take measures for reduction of condition of culture of security in compliance with requirements of the legislation, but at least, than once a year.

II. Organization of evaluating condition of culture of security

2.1. The head of the licensee issues the order on evaluating condition of culture of security of object in which are specified:

bases for evaluating condition of culture of security;

structure of the commission to which evaluating condition of culture of security, and its chairman is assigned;

criteria of culture of security, for compliance to which the condition of culture of security is checked (further - certain criteria);

amounts of work of the commission (the commission can perform assessment of condition of culture of security of object in general or in its separate divisions);

term of work of the commission;

form of the reporting of the commission of results of evaluating condition of culture of security.

2.2. The structure of the commission is determined taking into account qualification of alternate members of the commission, their psychophysiological features and experience, observance of the policy on physical protection proclaimed the licensee by them, recognitions of priority of culture of security by them.

The commissions on check of condition of culture of security of object surely are included responsible for condition of culture of security (further - the responsible person) which heads the commission, and the coordinator on culture of security. The coordinator on culture of security can head the commission in case task of the commission is assessment of condition of culture of security of separate divisions of object. Representatives of divisions of object in whom check of assessment of condition of culture of security will be performed cannot be members of the commission.

2.3. The commission on assessment of condition of culture of security carries out assessment of condition of culture of security according to the work plan of the commission approved by the head of the licensee. The work plan of the commission contains list of actions which shall be performed by the commission, terms of their accomplishment.

2.4. The commission on assessment of condition of security applies such evaluation methods of condition of culture of security:

questioning of personnel;

conversation of members of the commission with individuals from personnel of division of physical protection and other divisions of object;

studying of documentation of rather elementary training and advanced training of personnel of division of physical protection, other personnel of object;

observation of accomplishment by personnel of subject of requirements of physical protection and accomplishment by personnel of division of physical protection of the obligations;

analysis of content of means of promotion of culture of security;

hearing of the report of the coordinator on culture of security on condition of culture of security;

the analysis of documentation of the measures which are rather taken on object to violators of requirements of physical protection;

verification of presence on the workplaces of personnel of division of physical protection of technical and operational documentation, job descriptions, reference books and other literature necessary for personnel for accomplishment of the obligations;

comparison of results of the previous assessment of condition of culture of security of object with the results received by the commission.

2.5. Evaluation methods of condition of culture of security shall not influence condition of physical protection, nuclear, radiation and fire safety of object, engineering procedures of object, accomplishment by personnel of the obligations.

2.6. The commission chairman informs division managers of object in whom evaluating condition of culture of security, in 10 working days prior to work of the commission in their divisions is planned.

III. Evaluating condition of culture of security

3.1. The commission chairman on evaluating condition of culture of security of object before work of the commission convenes meeting to which representatives of administration of object, members of the commission, division managers, the condition of culture of security at whom will be estimated, responsible persons on culture of security in divisions of object which provide operation of object, use, storage of radioactive materials are invited.

The commission chairman during the meeting informs participants of the meeting about:

tasks of evaluating condition of culture of security;

plan of evaluating condition of culture of security;

evaluation methods of condition of culture of security;

the list of documents which shall be provided to the commission by management of the licensee and/or division managers of object;

order of interaction of the chairman and members of the commission with heads and personnel of divisions of object at whom the condition of culture of security is estimated;

date of meeting on summing up work of the commission on assessment of condition of culture of security and procedure for convocation of meetings during evaluating condition of culture of security.

3.2. Evaluating condition of culture of security of separate division of object begins with questioning of personnel of division for the purpose of determination of extent of awareness of importance of physical protection by personnel and priority of culture of security.

Questionnaires shall contain questions which will allow the commission to draw conclusion relatively:

recognitions by personnel of availability of threat of object;

understanding personnel of tasks of physical protection;

understanding personnel of role of culture of security in safety of object;

availability at personnel of internal requirement to fulfill the duties in strict accordance with requirements of regulations, rules and instructions for physical protection.

3.3. When evaluating condition of culture of security of separate division of object the commission analyzes the actions performed by the head and personnel of division of action for physical protection, in particular which influence forming/development and maintenance of high level of culture of security of division, determines compliance of results of taking measures to certain criteria.

3.4. The commission chairman together with the division manager of object after completion of assessment of condition of culture of security of division will organize discussion of results of assessment of condition of culture of security of division. All members of the commission, heads and personnel or staff representatives of division are involved in discussion.

Main objective of discussion is bringing to permission of the head and personnel of division of results of assessment of condition of culture of security of division with indication of discrepancies of condition of culture of security to certain criteria.

The commission in case of need provides recommendations concerning reduction of condition of culture of security of division in compliance with certain criteria.

3.5. The commission when evaluating condition of culture of security of object pays special attention to questions:

recognitions by the head of the licensee of importance of physical protection, priority of culture of security and understanding by personnel of division of physical protection of the personal role in safety of object;

availability on subject of the approved actions plan on forming/development and maintenance of high level of culture of security and implementation by the head of the licensee of control over the implementation of the plan;

implementation by the head of the licensee of actions for motivation of personnel;

assistance by the head of the licensee and division managers of object in work to the coordinator on culture of security;

personnel trainings of division of physical protection and other personnel of object concerning culture of security;

implementation of the analysis of violations of requirements of physical protection on object, acceptances on analysis results of measures for reduction of influence of human factor on safety of object;

taking into account by the head of the licensee of condition of culture of security of specific division in case of summing up the results of its activities;

reflections of condition of culture of security of object in annual status reports of system of physical protection of object.

3.6. The head of the licensee participates in meetings which are held before work of the commission on assessment of condition of culture of security of object, meets the commission chairman, including meetings on the commission chairman's initiative, for discussion of results of work of the commission and acceptance of adequate measures.

3.7. The commission on results of the work draws conclusion about compliance of condition of culture of security of object to certain criteria.

3.8. The commission chairman convenes meeting on summing up work of the commission on assessment of condition of culture of security to which the head of the licensee and his deputies, heads of structural divisions of object, responsible persons, members of the commission are invited.

The commission chairman reports on participants of the meeting about:

results of assessment of condition of culture of security of object or its separate divisions;

discrepancies if such is, conditions of culture of security of object or its separate divisions to certain criteria;

recommendations of the commission concerning elimination of the revealed discrepancies.

3.9. The commission displays results of evaluating condition of culture of security of object in the act according to condition of culture of security of object.

The act shall contain information about:

bases for evaluating condition of culture of security;

structure of the commission and its chairman;

certain criteria;

discrepancy of condition of culture of security of object or its separate divisions to certain criteria of culture of security;

decision of the commission on condition of culture of security of object or its separate divisions;

recommendations of the commission on elimination of the revealed discrepancies.

3.10. The commission prepares the act according to condition of culture of security in duplicate which are signed by the chairman and all members of the commission. In case the member of the commission does not agree with information which contains in the act, he states the opinion on the single sheet of paper which is integral part of the act.

The commission chairman provides the act according to condition of culture of security to the head of the licensee.

3.11. The head of the licensee gets acquainted with the act according to condition of culture of security of object and approves it.

The head of the licensee if the act contains data on discrepancy of condition of culture of security to certain criteria, determines basic reasons of discrepancies and makes the decision concerning their elimination.
