The government of the Republic of Kazakhstan DECIDES:

1. Bring in the order of the Government of the Republic of Kazakhstan of August 25, 2006 No. 819 "About approval of Rules of appointment and implementation of payment of the public basic social benefits for disability, on the occasion of loss of the supporter and on age, retirement benefits from the State center for pension payment, the state base retirement benefit, the public special welfare payments" (SAPP of the Republic of Kazakhstan, 2006, No. 33, the Art. 355) the following changes:

state heading in the following edition:

"About approval of Rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization";

These rules of provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization (further - Rules) are developed according to the laws of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan", of June 16, 1997 "About the public social benefits on disability, on the occasion of loss of the supporter and on age in the Republic of Kazakhstan", of July 13, 1999 "About the public special welfare payment to persons working at underground and open mining operations at works with especially harmful and especially severe conditions of work or at works with harmful and severe conditions of work" and determine procedure for provision of the state base retirement benefit at the expense of budgetary funds, and also appointment and implementation of retirement benefits, public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments from authorized organization.

1. General provisions

1. In these rules the following basic concepts are used:

1) the public basic social benefits (further - the public social benefit) - the monthly money payments performed at the expense of budgetary funds, provided to citizens in case of disability approach, loss of the supporter and on age;

2) the state base retirement benefit - the monthly money payment provided to citizens of the Republic of Kazakhstan on reaching the retirement age established by the legislation of the Republic of Kazakhstan;

3) the public special welfare payment - money payment to persons which had as of January 1, 1998 the length of service established by the legislation of the Republic of Kazakhstan on underground and open mining operations, at works with especially harmful and especially severe conditions of work or at works with harmful and severe conditions of work;

4) authorized organization (further - the Center) - the republican state state company created according to the decision of the Government of the Republic of Kazakhstan;

5) branches of the Center - regional, the cities of Astana and Almaty branches of the Center;

6) departments of the Center - city, district departments of the Center;

7) retirement benefits from the Center - the state base retirement benefit and payment to the physical persons having working life at least six months as of January 1, 1998 performed in proportion to working life;

8) authorized state body to destination pensions and benefits (further - authorized body) - territorial authorities of Committee on control and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan;

9) authorized organization for issue of pensions and benefits - the organizations having licenses of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of JSC Kazpochta;

10) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

11) the centralized database (further - TsBD) - the centralized database of the Center for implementation of payment types on the conditions established by the legislation of the Republic of Kazakhstan;

12) the applicant - person addressing for purpose of retirement benefits and (or) benefits;

13) the receiver of retirement benefits and benefits (further - the receiver) - physical person which is granted retirement benefits and allowances from the Center;

14) AIS "E-prototype" - the automated information system of electronic purpose of retirement benefits and benefits from the Center.

2. Provision of the state base retirement benefits is performed on conditions and according to the procedure of the address and purpose of the retirement benefits from the Center provided by these rules.

Copies of documents shall be certified by the specialist of department of the Center after checking with the provided originals, except cases when copies of documents are attested according to the procedure, established by the Law of the Republic of Kazakhstan of July 14, 1997 "About notariate".

Filing of application and necessary documents for purpose of pensions and benefits by the third parties can be performed under notarially certified power of attorney of person having the right to pension or benefit according to the procedure, established by the Law of the Republic of Kazakhstan of July 14, 1997 "About notariate".

For purpose of pensions and benefits to persons, by the judgment acknowledged incapacitated or it is limited capable and needing guardianship or custody, the statement and necessary documents are filed by their guardians or custodians.

4. The following documents of person having the right to pensions or benefit in the presence of individual identification number (further - IIN), including on dependents (are enclosed to the application in case of purpose of the public social benefit on the occasion of loss of the supporter or on the handicapped child up to 16 years):

1) the identity document (the identity certificate, certificates of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan);

2) the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for inhabitants Baikonur the reference of department of accounting and registration of citizens of housing Baikonur of the Russian Federation);

3) data on bank account number in authorized organization for issue of pensions and benefits or the control account of cash of correctional facility.

In case of establishment of guardianship (guardianship) over the child (the receiver of pensions and benefits), the document confirming establishment of guardianship (guardianship) is submitted.

5. For provision and purpose of pensions in addition to the documents listed in item 4 of these rules are represented:

1) the certificate of the organization (company) of the average monthly income from January 1, 1995 for any 3 years in a row, irrespective of work stoppages, in form according to appendix 2 to these rules.

In case of liquidation of the organization (company), the archive reference with indication of data on the income is submitted.

The size of the average monthly income for calculation of the size of retirement benefits from January 1, 1998, in case of impossibility of submission of the certificate of the organization (company) of the average monthly income, is established according to the income from which compulsory pension contributions in the accumulation pension funds or the single accumulation pension fund, except for income gained during work in the Russian organizations of the Baikonur complex were performed;

2) for confirmation of working life of person having the right to retirement benefits the following documents are submitted depending on their availability:

service record;

education document;

the military ID or the reference of managements and departments of areas and cities for defense;

certificates of birth of children (either the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration) and one of the following documents of children:

identity certificate;

the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage;

the certificate about the termination of average educational institution;

the diploma about the termination of specialized secondary or higher educational institution or the reference of educational institution confirming training;

the document confirming place of registration on the permanent residence of children;

the death certificate of children (or assembly record about death, or the certificate of registration of the act of civil status issued by bodies of civil registration);

the certificate of tax authority of payment of insurance premiums in the pension fund of the Republic of Kazakhstan for the period works till January 1, 1998 (when accounting years of service according to subitems 5) and 17) Item 1 of article 13 of the Law of the Republic of Kazakhstan of June 21, 2013 "About provision of pensions in the Republic of Kazakhstan");

certificate of rehabilitation;

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner, needing assistance, aged, reached eighty-year age, the disabled person aged up to 16 years who was injured from effects of atomic testing, ecological disasters or infected with human immunodeficiency virus or sick AIDS;

the document confirming the accommodation fact in zones of extreme and maximum radiation risk from August 29, 1949 to July 5, 1963;

references from archive organizations or from place of employment if records about labor activity are not made in the service record or are available corrections;

the reference confirming accommodation abroad of the spouse (spouse) of employees of the former Soviet organizations, organizations of the Republic of Kazakhstan and the international organizations;

the reference confirming accommodation of the spouse (spouse) of the military personnel in areas where there was no employment opportunity;

the reference confirming accommodation of the spouse (spouse) of the employee of special state bodies in areas where there was no possibility of her (his) employment in the specialty;

the marriage certficate and (or) annulment of marriage or the statement from assembly record about the conclusion and (or) annulment of marriage or the certificate of registration of the act of civil status issued by bodies of civil registration (in case of change of surname).

6. For purpose of the public social benefits on disability in addition to the documents listed in item 4 of these rules, departments of medico-social examination of territorial authorities of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan the statement from the certificate of disability of the established form is submitted.

Besides, depending on their availability the following documents are submitted:

1) the decision of Interdepartmental advisory council on establishment of causal relationship of diseases, disability of persons which underwent to radiative effects;

2) decision of the Central military-medical commission;

3) the certificate on disease granted by hospital or the conclusion of the military-medical commission;

4) the certificate of birth of the handicapped child up to 16 years.

7. For purpose of the public social benefits on the occasion of loss of the supporter in addition to the documents listed in item 4 of these rules the death certificate of the supporter or the judgment about recognition of person are represented it is unknown absent or died.

Besides, depending on their availability the following documents are submitted:

1) the document confirming the related relations of the dependent with the dead (certificates of birth, marriage, annulment of marriage, paternity proof (motherhood) and others);

2) the reference of bodies for civil registration of the Ministry of Justice of the Republic of Kazakhstan of the established form if data on the father in the certificate of birth are entered according to the statement of mother;

3) the document confirming guardianship (guardianship);

4) the certificate of educational institution that persons aged from 18 up to 23 years are students of full-time courses in form according to appendix 3 to these rules (it is represented annually since the beginning of academic year);

5) the military ID of the died (dead) or the certificate of passing of military service;

6) the reference, confirmatory that death or the death of the serviceman, employee of law-enforcement bodies and the former State Investigative Committee of the Republic of Kazakhstan occurred owing to wound, contusions, mutilations, diseases got on duty or passing of military service.

Persons occupied with care of the children, brothers, sisters or grandsons of the dead who did not reach eight years submit the following documents:

1) the service record confirming the termination of labor activity (the copy is compared to the original of the service record annually);

2) the certificate of tax authority that person is not registered as the individual entrepreneur (it is updated annually).

8. The state base retirement benefit and the public social benefit on age are appointed based on the documents specified in item 4 of these rules.

9. For purpose of the public special welfare payments in addition to the documents listed in item 4 of these rules are represented:

1) service record;

2) the reference of the organization confirming kind of work or working conditions for form according to appendix 4 to these rules;

3) education document;

4) the military ID or the reference of managements and departments of areas and cities for defense;

5) certificates of birth of children (either the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration) and one of the following documents of children:

identity certificate;

the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage;

the certificate about the termination of average educational institution;
