About modification and amendments in some decisions of the Government of the Republic of Kazakhstan

1. Approve the enclosed changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days after the first official publication.

Changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan

1. Ceased to be valid according to the Order of the Government of the Republic of Kazakhstan of 11.09.2015 No. 774

2. In the order of the Government of the Republic of Kazakhstan of May 12, 2011 No. 506 "About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2011, No. 38, the Art. 459):

in the Rules of use of airspace of the Republic of Kazakhstan approved by the specified resolution:

add Item 2 with subitems 35) and 36) of the following content:

"35) remotely piloted aircraft - the aircraft which is piloted by the trained professional who is not onboard this aircraft;

36) the established route - the route out of the airway, local air-line approved with the authorized bodies interested in departments and the organizations and intended for accomplishment of aviation works.";

2) of Item 7 to state the subitem in the following edition:

"2) routes of servicing of air traffic (airways, MVL and the established routes);";

state Items 11 and 13 in the following edition:

"11. The route of servicing of air traffic in appropriate cases designates the airway, local air-line or the established route. The principles of establishment of indexes of routes of servicing of air traffic are established according to appendix 1 to these rules.";

"13. Local air-lines and the established routes are established in the lower airspace. Width of local air-line and the established route for flights on PVP is established in 4 kilometers.";

"17-1. For each object (polygon, shooting range, training center, pit, the field, the mine, section, the aerological station) on which the works connected with production of firing practice, missiles launches, explosive works, flights of unmanned aerial vehicles, uncontrollable aerostats are carried out and other activities posing safety hazard of flights by the owner or body responsible for operation of object are performed, the instruction for interaction with bodies of the Department of Internal Affairs which is approved with body of the Department of Internal Affairs around which responsibility there is object is developed.";

"22. Danger areas are established for the benefit of the following types of activity, connected with:

1) work with ammunition on objects of their storage;

2) implementation of scientific research in the atmosphere;

3) electromagnetic radiations;

4) light radiations;

6) zones of fall of the separated parts of carrier rockets.

23. Zones of restriction of flights are established over areas of carrying out all types of firing practice, missiles launches, explosive works, the national natural parks, national parks, historical and cultural monuments, and also over the protected objects for representation of the interested state bodies.";

add with Items 26-1, 26-2 and 26-3 of the following content:

"26-1. In case of initial establishment of prohibited areas, danger areas or zones of restriction of flights designation is appropriated to each zone.

26-2. The appropriated designation is used for designation of zone in all subsequent changes concerning this zone.

26-3. Designation consists of the following group of letters and figures:

1) alphabetic reference of UA;

2) letter P - for the prohibited area, letter R - for zone of restriction of flights and letter D - for the danger area respectively;

3) number which is not duplicated within the territory of the Republic of Kazakhstan.";

33, of 55, 58 and 59 to state Items in the following edition:

"33. Aviation works, parachute jumps, flights of unmanned aerial vehicles, remotely piloted aircrafts, raising of fastened aerostats on settlements are carried out in the presence at users of airspace of permission of HZ of the Department of Internal Affairs to flight over the settlement and with the notification the user of airspace of local executive bodies of the city of republican value and the capital, cities of regional value within whose territory flights are planned.";

"55. The plan of use of airspace is subdivided on:

1) plans of flights of aircrafts;

2) plans of flights of unmanned aerial vehicles, remotely piloted aircrafts, the managed aerostats, airships;

3) plans of carrying out starts of uncontrollable aerostats (sounding balloons), firing practice, missiles launches and explosive works.";

"58. Flight plan is represented for receipt of permission to use of airspace of classes A and (or) C, and also when using airspace of class G for the purpose of the notification of bodies of servicing of air traffic (air traffic control) and flight and information servicing at the request of the operator.

The message on flight plan of the pilotless lethal device, remotely piloted aircraft or the managed aerostat moves for receipt of permission to use of airspace irrespective of airspace class.

Flights of unmanned aerial vehicles, remotely piloted aircrafts or the managed aerostats over the protected objects are approved by operators with Security service of the President of the Republic of Kazakhstan at least in 5 working days prior to such flights.

59. Flight plan is represented the user of airspace on the PVD HZ Internet resource or in the closest Briefing group of body of Department of Internal Affairs in case of accomplishment of flights:

1) aircrafts on airways, local air-lines and the established routes in airspace of classes A and (or) C;

2) civil aircrafts out of airways and local air-lines of airspace of classes A and (or) C;

3) civil aircrafts in class G airspace.";

add Item 60 with the subitem 5) of the following content:

"5) pilotless lethal devices, remotely piloted aircrafts.";

add Item 61 with part two of the following content:

"The message with use of the Internet containing information on the provided plan moves on the PVD HZ Internet resource. For submission of such plans users of airspace receive login and the password in authorized body of civil aviation in the presence of the existing documents certifying the right of accomplishment of flights.";

state Item 63 in the following edition:

"63. Flight plan of the aircraft contains:

1) information on identification index of the aircraft (number of flight, state and registration identification marks of the aircraft);

2) information on rules of flight (the instrument flight rule (further - PPP), the visual flight rules (further - PVP) and flight type (regular (S), irregular (N), flight of aircraft of general purpose (G), flight of the aircraft of the state aircraft (M), for any other flights (X));

3) information on quantity and type of aircrafts, categories of turbulence of trace (for civil aircrafts);

4) information on the aircraft equipment;

5) information on airfield of departure and time of departure;

6) information on flight route;

7) information on airfield of appointment and the general estimated expired time (before landing), reserve airfields;

8) information necessary for the description of features of route of flight, registration signs of the aircraft, the name of the operator, flight specifications of the aircraft, the used onboard equipment, and other necessary information if it differs from standard or requires the special relation from bodies of servicing of air traffic (air traffic control), the status of flight according to appendix 4 to these rules;

9) information concerning fuel reserve, numbers of persons onboard, crash equipment.

The standard structure (amount) of information included in the message on flight plan of the civil aircraft, and transfer of the specified plan are determined by appendices 3, 5 and 6 to these rules.

For the purpose of exception of duplication of numbers of flights in case of accomplishment of flights coordination of the used numbers of flights of the Kazakhstan operators is performed by PVD HZ.

In flight plan of the pilotless lethal device, remotely piloted aircraft or the managed aerostat information specified in subitems 1), 3) - 6), 8) this Item of Rules is entered.";

Estimated time of departure is understood as time of cleaning of blocks from the aircraft to start its taxing if it is applicable, and in other cases - time of take-off of the aircraft.";

"The provided repeating plan for accomplishment of the international regular flights through the territory of the Republic of Kazakhstan without landing is subject to approval by authorized body in the field of civil aviation, with issue of the notification on approval through PVD HZ.";
