About modification and amendments in Regulations on procedure for application of the Customs convention on international delivery of loads using the book of MDP - Karnet TIR (The convention MDP, 1975)

 According to article 6 of the Law of the Republic of Uzbekistan "About the State Customs Service" (Sheets of Oliy Majlis of the Republic of Uzbekistan, 1997, No. 9, the Art. 230), the Presidential decree of the Republic of Uzbekistan of June 4, 2001 No. UP-2871 "About Demonopolization and Enhancement of Management in the field of Road Transport" (Sheets of Oliy Majlis of the Republic of Uzbekistan, 2001, No. 6, the Art. 118) and the order of the Cabinet of Ministers of the Republic of Uzbekistan of October 14, 1996 decide No. 422-f, the State Customs Committee of the Republic of Uzbekistan and the Uzbek agency of road and river transport:

1. Make changes and additions to Regulations on procedure for application of the Customs convention on international delivery of loads using the book of MDP - Karnet TIR (The convention MDP, 1975), approved by the State Tax Committee of the Republic of Uzbekistan on October 11, 1996 and Uzavtotrans State joint-stock corporation on October 16, 1996 (рег. No. 290 of December 10, 1996), according to appendix.

2. This resolution becomes effective from the date of its official publication.

Appendix

Changes and additions made to Regulations on procedure for application of the Customs convention on international delivery of loads using the book of MDP - Karnet TIR (The convention MDP, 1975)

1. State Item 1.4 in the following edition:

"1.4. In this Provision the following basic concepts are used:

The contracting party - the State Party of the Convention MDP, 1975;

transportation of MDP - cargo hauling from customs of departure to customs of appointment with observance of the MDP procedure;

transaction of MDP - the part of transportation of MDP made in the Contracting party from customs of departure or entrance (intermediate customs) to customs of appointment or departure (intermediate customs);

road and transport means - the mechanical road and transport means (RTM), and also any trail car or semitrailer truck intended for its towage by such vehicle;

structure of vehicles - the linked road and transport means which participate in traffic as single whole;

container - the transport equipment (cage, the removable tank, demountable bodies or other similar adaptation);

customs of departure - any customs of the Contracting party where for all load or its part transportation of MDP begins;

customs of appointment - any customs of the Contracting party where for all load or its part transportation of MDP comes to an end;

intermediate customs - any customs of the Contracting party through which road and transport means, the structure of vehicles or container drives in the Contracting party or leaves it in MDP course of carriage;

person - physical persons and legal entities;

the holder of the book of MDP - person to whom according to the Convention MDP, 1975, the book of MDP was issued and on behalf of whom in customs of departure the customs declaration in the form of the book of MDP with intention to place load under the MDP procedure was submitted. He bears responsibility for presentation of road and transport means, structure of vehicles or container together with load and the book of MDP relating to them in customs of departure, intermediate customs both in customs of appointment and for proper observance of other relevant provisions of the Convention MDP;

heavy or bulky goods - any heavy or bulky subject which because of the weight, the sizes or nature usually are not transported in the closed road and transport means or in closed container;

warranty consolidation - the consolidation recognized by customs authorities of the Contracting party as the guarantor for persons using the MDP procedure;

goods - the loads transported with observance of the MDP procedure.".

2. In Item 2.4 of the word of "transport road means" shall be replaced with words "road and transport means".

3. In Item 3.1:

the paragraph one to exclude;

paragraphs two and third to consider respectively paragraphs the first and second.

4. Add Item 3.3 with paragraphs of the following content:

"In case of the international delivery made with use of structure of the vehicles including the cargo vehicle or the car tractor registered in one state and the trail car or semitrailer truck registered in other state, the book of MDP for all structure of vehicles shall be received in warranty merging of the state in which the cargo vehicle or the car tractor is registered.

In case of following of road and transport means in goods quality the book of MDP shall be received in warranty merging of the state of the sender or receiver of goods.".

5. In paragraph one of Item 3.4 of the word "the State Parties of the Convention MDP, 1975" shall be replaced with words "Contracting parties".

6. In the paragraph the second Item 3.7 "schedules" to replace the word with the word "graphs".

7. In Item 4.1 of the word "Uzavtotrans state joint-stock corporation shall be replaced with words "The association of the international automobile carriers of Uzbekistan (ASMAP)".

8. To exclude from Item 5.2 of the word "Appendices No. No. 7-7v".

9. Items 5. 3, 6.7, 7.8, 12.3, 12.4, and also appendices No. No. 7-7v, 11, 12 and 17 to recognize invalid.

10. State Item 5.5 in the following edition:

"5.5. Certificates on assumption are represented without fail on road and transport means, in customs of departure. 

Certificates on assumption are not shown in case of transportation of heavyweight or bulky goods.".

11. State Items 6.5 and 6.6 in the following edition:

"6.5. If as a result of documentary and actual control any violations of the MDP procedure are not revealed, movement of goods and road and transport means on the territory of the Republic of Uzbekistan is performed according to this procedure.

6.6. For movement of goods and road and transport means on the territory of the Republic of Uzbekistan according to the MDP procedure:

collateral customs securities are imposed, in case of need, and the mark about it in the column "For Official Use" on both detachable sheets, white and green colors becomes;

customs value of goods is determined. For determination of customs value of goods invoices, transport and insurance documents, customs declarations of the countries of departure, other shipping documents are used. Customs value in contract currency is specified in the column "For Official Use" of both detachable sheets. In case of impossibility of establishment of customs value in this column the entry "The Cost Is Not Determined" is made;

whenever possible the detailed description of the transported goods, in column 10 of both detachable sheets, sufficient for its identification in case of issue, loss or not delivery of goods is given;

delivery date is established. Date of delivery date is specified in column 20 of both detachable sheets, white and green color together with root (SOUCHE) No. 1 (the root (SOUCHE) No. 1 which is drawn up in the customs relation with seal of customs authority remains in the book of MDP);

are filled column 16 - 23 detachable leaves (VOLET) No. No. 1 and 2 and root (SOUCHE) No. 1;

the detachable leaf (VOLET) No. 1 of white color which is stored in the separate folder separates;

the book of MDP is registered in the automated information system (further - AIS) the State Customs Committee and is put on control;

departure of road and transport means from the customs control zone is performed after putting down in column 23 of detachable leaf (VOLET) No. 1 of white color, and also in the column 6 of root (SOUCHE) No. 1 of date, personal seal and the signature of the official of the customs authority responsible for documentary control;

the drawn-up book of MDP returns to carrier.".

12. Add Item 6.10 with words "and remove it from control in AIS of the State Customs Committee".

13. In Item 6.11:

in the paragraph the second to replace figure "18" with figure "24";

the fifth after the words "book of MDP" to add the paragraph with words "acts from control in AIS of the State Customs Committee and".

14. State Items 7.5 and 7.6 in the following edition:

"7.5. In case of detection of any violations in case of registration transportation of goods according to the MDP procedure is not performed before elimination of these violations.

7.6. If as a result of documentary and actual control it is determined that all conditions of application of the MDP procedure are complied, then are without fail filled:

column 16 on all detachable sheets of white and green color of the book of MDP;

in the column "For Official Use" of detachable leaf (VOLET) No. 1 and in the column 5 of root (SOUCHE) No. 1, among others of data, customs value of the transported goods, code of customs regime according to which goods are exported from the Republic of Uzbekistan are specified;

root (SOUCHE) No. 1 of detachable leaf of white color;

whenever possible, in column 10 the detailed description of the transported goods with indication of codes according to the Commodity Nomenclature of Foreign Economic Activity is given. If there is not enough column 10 for introduction of all data, it is allowed to use additional sheets in duplicate. In additional sheets also number of the book of MDP, the name and the location (postal address) of her holder is specified. Additional sheets are certified by personal seal of the official of customs authority. The mark about availability of such sheets becomes in column 8 of all sets of detachable sheets of white and green color;

delivery date is established. Date of delivery date of goods is specified in column 20 of detachable leaf (VOLET) No. No. 1 and 2;

are dated, personal seal and the signature of the official of customs authority in column 23 of detachable leaf (VOLET) No. 1 and the column No. 6 of root (SOUCHE) No. 1.

The detachable leaf (VOLET) No. 1 of white color, separates from the book of MDP and is stored in the separate folder.

Control of the actual commodity exportation from the territory of the Republic of Uzbekistan is exercised by customs of departure, way of registration and statement for control of books of MDP to AIS of the State Customs Committee.".

15. Add Item 7.11 with words ", and removes it from control in AIS of the State Customs Committee".

16. In Item 7.12:

the fourth to exclude the paragraph;

to consider paragraphs of the fifth and sixth respectively paragraphs the fourth and fifth;

the fourth and fifth to state paragraphs in the following edition:

17. In Item 8.1 to replace figure "6.7" with figure "6.6".

18. In Item 8.2 of the word "Items 6.8 - 6.11." shall be replaced with words "Items 7.9 - 7.12".

19. In paragraph one of Item 9.4 of the word "Items 7.9 - 7.12." shall be replaced with words "Items 7.1 - 7.8".

20. In Item 9.6 of the word "personal stamp" shall be replaced with words "personal seal".

21. From paragraph one of Item 10.3 of the word "pack lists" to exclude.

22. Item 11.1 in paragraph three "stamp" shall be replaced with words the word "personal seal".

23. In Item 12.1 of the word "regulations GTU GNK" to replace with the word "legislation".

24. State Item 12.2 in the following edition:

"12.2. Accounting and control over transportations of goods with observance of the MDP procedure is exercised in accordance with the established procedure by means of AIS of the State Customs Committee.".

25. In Item 13.2:

in paragraph three of the word "make the decision on opportunity" shall be replaced with words "study opportunity";

word in paragraph four "bodies of GAI" shall be replaced with words "the staff of Public service of traffic safety of the Ministry of Internal Affairs of the Republic of Uzbekistan".

26. In Items 14. 14.3 and 14.6 word "permissions" to replace 2, with the word "participations".

27. In Item 14.5 the word "permissions" shall be replaced with words "participations of customs authority".

28. In Item 14.9:

30. State Item 14.11 in the following edition:

"14:11. The head department on the organization of customs control of the State Customs Committee controls observance of the established Conventions MDP, 1975, terms of consideration of the requirement about payment and together with Head department of customs and tariff regulation and accounting of payments of the State Customs Committee - receipt of the amounts of customs duties and taxes on the account of the State Customs Committee.".

31. In paragraph six of Chapter 3 of appendix No. 2 of the word "personal stamp" shall be replaced with words "the personal seal".

32. State appendix No. 14 in edition according to appendix to these changes and amendments.

33. These changes and amendments are approved with Association of the international automobile carriers of Uzbekistan.
