According to Item 9 of Rules of acceptance of the regulatory legal acts of safety and protection works by the relevant authorized bodies approved by the order of the Government of the Republic of Kazakhstan of August 21, 2007 No. 721, I ORDER:

1. Approve the enclosed Safety requirements and labor protections in the organizations of TV and radio broadcasting of the Republic of Kazakhstan.

2. To provide to committee of information and archives of the Ministry of Culture and information of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication;

2) placement of this order on Internet resource of the Ministry of Culture and information of the Republic of Kazakhstan.

3. This order becomes effective after ten calendar days after day of its first official publication.

Safety requirements and labor protections in the organizations of TV and radio broadcasting of the Republic of Kazakhstan

1. General provisions

Paragraph 1. General requirements of labor safety

1. These Safety requirements and labor protections in the organizations of TV and radio broadcasting (further - Requirements) are developed according to Item 7 of Rules of acceptance of the regulatory legal acts of safety and labor protection by the relevant authorized bodies approved by the order of the Government of the Republic of Kazakhstan of August 21, 2007 No. 721 and establish the main requirements for safety and labor protection in the organizations of TV and radio broadcasting of the Republic of Kazakhstan.

2. These Requirements are obligatory for execution administrative, engineering personnel and employees of the organizations of TV and radio broadcasting (further - the organizations).

3. In these Requirements the following concepts are used:

1) labor safety - the condition of security of workers provided with complex of the actions excluding impact of harmful and (or) dangerous production factors on workers in the course of labor activity;

2) blocking - the part of electrotechnical product (device) intended for prevention or restriction of accomplishment of transactions with one parts of product in case of certain conditions or provisions of other parts of product for the purpose of the prevention of origin in it inadmissible conditions or exception of access to its parts which are energized;

3) grounding conductor - the conductor or set metal the connected conductors which are in contact with the earth or its equivalent;

4) the grounding conductor - the conductor connecting the grounded parts to grounding conductor;

5) the grounding device - set of the constructive and integrated grounding conductors and grounding conductor;

6) labor protection - the system of safety of life and health of workers in the course of labor activity including legal, social and economic, organizational and technical, sanitary and epidemiologic, treatment-and-prophylactic, rehabilitation and other actions and means;

7) electroinstallation - set of the machines, devices, lines and the service equipment (together with constructions and rooms, in which they are established) intended for production, transformation, transformation, transfer, distribution of electrical energy and its transformation to other type of energy;

8) the job specification - the written task for work in electroinstallations which is drawn up on the form of the established form and the determining content, the place, time of the beginning and completion of work, condition of its safe carrying out, structure of crew and persons responsible for safety of work and others;

9) the current operation - carrying out works by operation (operational and repair) personnel on the site assigned to it during one change;

10) the Main electroprotective equipment - electroprotective equipment which isolation maintains the working tension of installation and by means of which it is possible to concern the current carrying parts which are energized.

Additional electroprotective equipment - the electroprotective equipment serving as additional protection against defeat by electric current and which do not allow to concern directly the current carrying parts which are energized.

Paragraph 2. Organization of works on safety and labor protection

5. The common directorship on safety and labor protection in the organization is assigned to her head (employer), in case of absence of the head, by replacement his face.

6. For the purpose of ensuring compliance with safety and labor protection in the organizations numbering more than fifty workers the employer creates security service and labor protections which is effective according to the Labor code of the Republic of Kazakhstan (further - the Labor Code).

According to the status the security service and labor protections is equated to the main production services and liquidated only in case of the organization activity termination. In the organizations numbering more than fifty workers rooms for office on labor protection are allocated.

The structure, number, the main objectives, functions and the rights of security service and labor protection are determined by the employer based on the Standard regulations on security service and labor protections in the organization approved by the order of the Government of the Republic of Kazakhstan of October 28, 2011 No. 1219.

If the quantity of working does not exceed fifty workers, the decision on introduction of position of the security specialist and labor protection is accepted by the employer taking into account specifics of activities of this organization, or obligations on safety and labor protection are assigned in combination to other specialist.

7. Training, instructing, examination of workers in safety issues and labor protections are carried out by the employer at the expense of own means, instructing and examinations of workers on safety issues and labor protections.

8. On nature and time of carrying out the personnel safety notification (further - instructing) is subdivided on:

1) introduction;

2) primary on workplace;

3) repeated;

4) unplanned;

5) target.

9. Primary instructing on workplace, repeated, unplanned and target is carried out by the direct works manager.

About carrying out primary instructing on workplace, repeated, unplanned instructing, training and the admission to work the works manager instructing makes the log entry of registration of instructing on workplace.

10. The induction is held with all employed, irrespective of their education, length of service by this profession or position, and also with the temporary employees sent the pupils and students who arrived to inservice training or practice.

The induction is held by the security specialist and labor protection, or person to who these obligations are assigned.

The induction is held according to the program approved by the head of the organization developed by security service and labor protections taking into account requirements of occupational safety standards system (further - SSBT).

11. The program of induction includes the following questions:

1) general information about the organization and its activities;

2) basic provisions of the Labor code;

3) employment policies and procedures in the organization;

4) the organization of work on safety and labor protection in the organization;

5) general rules of conduct of workers in the territory of the organization, in production and auxiliary rooms, arrangement of the main services, production and auxiliary rooms;

6) major dangerous and harmful production factors characteristic of this type of activity, methods and warning facilities of accidents and occupational diseases, means of collective protection, posters, safety signs, alarm system, main requirements for electrical safety;

7) main requirements of production sanitation and personal hygiene;

8) individual protection equipment (further - SIZ) issues, procedure and regulations terms of their use;

9) circumstances and the reasons of separate characteristics of accidents, accidents, the fires happening because of violation of safety requirements;

10) procedure for investigation and registration of accidents, occupational diseases;

11) industrial and fire safety, methods and means of prevention of the fires, explosions, accidents, actions of personnel in case of their origin;

12) measures of rendering primary medical and sanitary help to victims, actions of workers in case of accident on the site, in the workshop.

Holding induction is fixed by the log entry of registration of induction with the signature instructed and instructing, and also in the document on employment.

12. Primary instructing on workplace is carried out with all workers: again accepted in the organization, transferred from one division to another, sent, studying, the students who arrived to inservice training or practice with the workers performing work, new to them, and also with the citizens performing construction works in the territory of this organization.

13. The program of primary instructing on workplace includes the following questions:

1) general information about engineering procedure and the equipment on this workplace, production site the major dangerous and harmful production factors, threshold limit values of hazardous substances (further - maximum allowable concentration) and maximum permissible noise levels;

2) safe organization and content of workplace, danger areas of the machine, mechanism, device, equipment security aids (safety, brake mechanisms, barriers, systems of blocking and alarm systems, safety signs), requirements for the prevention of electroinjury rate;

3) procedure for preparation for work (check of operability of the equipment, starting equipment, tool and devices, blocking of grounding and other remedies) according to requirements of rules of technical operation (further - PTE) and safety regulations (further - PTB) in case of operation of electroinstallations;

4) safe acceptances and methods of work, action in case of dangerous situation;

5) individual protection equipment on workplace and instructions for use them;

6) the scheme of safe movement working at the territory of the workshop, site;

7) intra shop transport and load-lifting means and mechanisms, safety requirements during the handling works and cargo transportation;

8) characteristic reasons of accidents, explosions, fires, cases of industrial injuries, occupational diseases and poisonings;

9) measures of the prevention of accidents, explosions, fires, actions in case of accident, explosion, the fire, methods of application of the fire extinguishing means which are available on the site, antiemergency protection and the alarm system, the place of their arrangement.

14. Primary instructing on workplace is carried out with each worker individually with demonstration of safe acceptances and methods of work.

For the purpose of assimilation of skills of safe working methods, all workers after passing of primary instructing on workplace are assigned to experienced workers during the first two-five shifts (depending on kind of work, qualification of the worker) then the head of this site (workshop), having convinced of assimilation by again arrived worker of safe working methods, draws up the admission it to independent work.

15. Repeated instructing there undergo all workers irrespective of qualification, educations, years of service, nature of the performed work, except for the workers exempted from passing of this type of instructing by the order on the organization, at least once a half-year.

Repeated instructing is carried out individually or with employee group, servicing the same equipment, and within general workplace according to the program of primary instructing on workplace in full.

16. Unplanned instructing is carried out:

1) in case of enforcement new or modification of the existing standards, rules, security guidelines and labor protection;

2) in case of change of engineering procedure, replacement or upgrade of the equipment, the devices and the tool, initial raw materials, materials and other factors influencing labor safety;

3) in case of violation by workers of safety requirements of work which can bring or were led to injury, occupational disease, poisoning, accident, explosion or the fire;

4) upon the demand of state control bodies in the field of safety and labor protection.

17. The amount and content of unplanned instructing determine in each case depending on the reasons and circumstances which caused the necessity of its carrying out.

18. Target instructing is carried out in case of:

1) accomplishment of the one-time works which are not connected with direct obligations in (loading unloading, cleaning of the territory, one-time works out of the organization, the site, the workshop);

2) mitigations of consequences of accidents of natural and technogenic nature;

3) works on which the work permit is drawn up;

4) holding excursions on production facility, the organization of mass actions.

Target instructing with workers is fixed in the work permit in case of works in the conditions of the increased danger.

Work types in the conditions of the increased danger on which work permits are drawn up are determined by the order by the organization.

19. The personnel of the organization which are affected by harmful, dangerous and adverse production factors pass in accordance with the established procedure preliminary, in case of revenues to work, and periodic medical examination.

Availability in the organization of harmful, dangerous and adverse production factors is determined by results of carrying out certification of production facilities under the terms of work according to requirements of the Labor code.

20. Taking into account local conditions and specifics of production in the organizations are constituted to security guidelines and labor protection on the specific work types approved by heads of the organization.

Paragraph 3. Functions of the head (employer) on safety and labor protection

27. The head of the organization (employer) provides:

1) safe operation of factory buildings, constructions, equipment, safety of engineering procedures;

2) effective operation of means of collective and individual protection;

3) observance of work-rest schedule of workers according to the Labor code;

4) workers the necessary number of sanitary and household rooms and the equipment, control of work and their use to destination according to Rules of issue to workers of milk, treatment-and-prophylactic food, special clothes, special footwear and other individual protection equipment, providing workers with means of collective protection, the sanitary and household rooms and devices at the expense of means of the employer approved by the order of the Government of the Republic of Kazakhstan of December 5, 2011 No. 1458 and these Requirements;

5) working conditions on workplace according to requirements of the Labor code, these Requirements;

6) development and accomplishment of actions for safety and labor protection, fire safety;

7) passing by employees of the organization, preliminary and periodic medical examinations according to the Rules of performing obligatory medical examinations approved by the order of the Government of the Republic of Kazakhstan of January 25, 2012 No. 166;

8) carrying out obligatory certification of production facilities under the terms of work according to the Rules of obligatory periodic certification of production facilities under the terms of work approved by the order of the Government of the Republic of Kazakhstan of December 5, 2011 No. 1457;

9) holding the actions directed to the prevention of accidents on production facilities;

10) development and approval of security guidelines and labor protection, and also ensuring acquaintance with them all workers;

11) training, carrying out timely instructing and examination by workers of regulations and instructions for labor protection and fire safety;

12) workers at the expense of means of the organization by special clothes, special footwear and other individual protection equipment;

13) informing workers on condition of conditions and labor protection on workplace, about the existing risk of damage of health and individual protection equipment relying workers, compensations and privileges;

14) timely investigation of the labor accidents which happened to employees of the organization. The accidents which happened to workers on production are subject to investigation, registration and accounting, according to Chapter 37 of the Labor code;

15) the free admission of representatives of state supervision bodies and control for conducting checks if their organization and carrying out conforms to requirements of the Law of the Republic of Kazakhstan of January 6, 2011 "About the state control and supervision in the Republic of Kazakhstan";

16) necessary measures for ensuring preserving life and health of workers in case of emergencies, including measures for the organization of primary medical and sanitary help to victims;

17) compulsory social insurance or compulsory liability insurance of the employer for damnification of life and to health of workers in case of execution of labor service duties by them;

18) accomplishment of instructions of control facilities and provision of information on working conditions in the organization and accidents which happened in the organization.

Paragraph 4. To function of security specialists and labor protection

28. Security specialists and labor protection provide:

1) development and functioning of management system of safety and labor protection in the organization;

2) implementation of methodical management and single procedure for the organization of works on safety and labor protection;

3) control of accomplishment of these Requirements, Labor code;

4) organization of training of technical and other workers in safety rules and labor protections, industrial safety and fire safety;

5) control of observance of testing of mechanisms, electroinstallations, equipment and means of collective and individual protection;

6) imposing of prohibition on work on certain sites, machines, mechanisms and machines under conditions, life-threatening and health of workers;
