About entering of amendment into the Law of the Kyrgyz Republic "About highways"

Article 1. Bring in the Law of the Kyrgyz Republic "About highways" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 1998, No. 9, the Art. 322) the following amendment:

Add the law with Article 39-4 of the following content:

"Article 39-4. The contract for production of roadwork on construction, reconstruction and repair of highways

The contract for production of roadwork on construction, reconstruction and repair of highways consists with the compulsory provision of warranty ensuring agreement performance and specifying of warranty period of operation of object. The warranty period is estimated from the moment of delivery to the customer of the new highways finished with construction and constitutes at least two years, and for the reconstructed and repaired highways - at least one year.

In case of detection of the defects because of the contractor established by the commission with its participation in limits of warranty period, the warranty period for this element or the section of the highway is established from the moment of completion of works on elimination of defects again. Work duration on elimination of the revealed defects is not set off in warranty period.

Note. Warranty period - period of time during which the contractor who performed works on construction, reconstruction and repair of the section of the highway guarantees to the customer compliance of quality of such works to qualifying standards on condition of observance of service regulations of the highway.".

Article 2. This Law becomes effective from the date of official publication.
