About approval of standards of the state services in the field of medical activities

According to the subitem 3) 6, the subitem 11) of article 9 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" the Government of the Republic of Kazakhstan DECIDES: Articles

1. Approve enclosed:

1) standard of the state service "Issue of the Certificate of the Specialist without Assignment of Qualification Category";

2) standard of the state service "Issue of the Certificate of the Specialist with Assignment of Qualification Category";

3) standard of the state service "Issue of the Certificate on Accreditation to the Medical Organizations";

4) standard of the state service "Issue of the Certificate on Accreditation to Physical Persons for Conducting Independent Examination of Activities of Subjects of Health Care";

5) standard of the state service "Licensing, Renewal, Issue of Duplicates of the License for Medical Activities";

6) standard of the state service "Certification of Medicolegal, Forensic-psychiatric and Judicial and Narcological Experts";

7) standard of the state service "Assignment of Qualification on the Right of Production of Certain Type of Medicolegal, Forensic-psychiatric and Judicial and Narcological Examinations";

8) standard of the state service "Issue of Permission to Performing Clinical Trials of Medical Technologies";

9) the standard of the state service "Licensing for import, export of fabrics and (or) bodies (part of bodies) of the person, and also for import, export of blood and its components in the cases provided by the Code of the Republic of Kazakhstan "About health of the people and health care system".

2. Recognize to invalid:

1) the order of the Government of the Republic of Kazakhstan of September 10, 2012 No. 1173 "About approval of standards of the state services in the field of medical activities" (SAPP of the Republic of Kazakhstan, 2012, No. 70, the Art. 1014);

2) the order of the Government of the Republic of Kazakhstan of February 20, 2013 No. 158 "About modification of the orders of the Government of the Republic of Kazakhstan of July 20, 2010 No. 745 "About approval of the register of the state services rendered to physical persons and legal entities" and of September 10, 2012 No. 1173 "About approval of standards of the state services in the field of medical activities" (SAPP of the Republic of Kazakhstan, 2013, No. 16, the Art. 293).

3. This resolution becomes effective after ten calendar days after day of its first official publication.

Standard of the state service "Issue of the Certificate of the Specialist without Assignment of Qualification Category"

1. General provisions

1. The state service "Issue of the Certificate of the Specialist without Assignment of Qualification Category" (further - the state service).

2. The standard of the state service is developed by the Ministry of Health of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears territorial departments of Committee of control of medical and pharmaceutical activities of the Ministry of Health of the Republic of Kazakhstan (further - the service provider).

Reception of applications and issue of results of rendering the state service are performed through:

1) the service provider by means of office or the web portal "E-licensing: www.elicense.kz (further - the portal);

2) web portal of "the electronic government": www.egov.kz.

2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package to the service provider, and also in case of the address on the portal - 10 (ten) working days;

2) the most allowed time of expectation for delivery of documents - 15 (fifteen) minutes;

3) the most allowed time of servicing - 15 (fifteen) minutes.

5. Form of rendering the state service: electronic (partially automated).

6. Result of rendering the state service - the certificate of the specialist (further - the certificate) in form, according to appendix 1 to this standard of the state service in electronic form. The certificate is issued in case of positive passing of testing.

Form of provision of result of rendering the state service electronic.

In case of the address of uslugopoluchatel to the service provider - the result of rendering the state service is drawn up on paper, unpacked, certified by seal and the signature of the head of the service provider.

In case of the address of uslugopoluchatel through the portal the result of the state service goes to uslugopoluchatel to "personal account" in electronic form, certified by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered to free of charge physical persons (further - uslugopoluchatel).

8. Working schedule:

1) the service provider - Monday through Friday from 9:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

The state service is rendered in turn, without making an appointment and the accelerated servicing;

2) the portal - round the clock (except for technical breaks in connection with carrying out repair work).

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

1) to the service provider:

the statement in form according to appendix 2 to this standard of the state service;

form of data, according to appendix 3 to this standard of the state service;

2) on the portal:

request in electronic form, the uslugopoluchatel certified by the EDS;

form of data, according to appendix 3 to this standard of the state service.

The data of the identity document of uslugopoluchatel which are the state electronic information resources, the service provider receives from the corresponding state information systems in the form of the electronic documents certified by the EDS of authorized persons of state body.

Reclamation from uslugopoluchatel of documents which can be received from information systems is not allowed.

When giving by uslugopoluchatel of all necessary documents:

through office of the service provider the receipt (notification) on acceptance of the relevant documents is issued with indication of:

numbers and dates of reception of an application;

type of required state service;

the number of the enclosed documents to the application;

date and time of passing of testing (in case of its admission by results of verification of documents to testing);

surnames and initials of the employee of office who adopted the statement.

through the portal - in "personal account" of uslugopoluchatel the status about acceptance of request for rendering the state service with indication of date, time and the place of passing of testing is displayed (in case of its admission by results of verification of documents to testing).

3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) their officials concerning rendering the state service

Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider, or the Ministry, to the addresses specified in Item 13 of this standard of the state service.

The claim is submitted in writing by mail or purposely through office of the service provider, or the Ministry, Monday through Friday from 9:00 till 17:00 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Confirmation of adoption of the claim is registration (stamp, the entering number and date) in office of the service provider with issue of the coupon in which are specified number, date, surname of person which accepted the claim with indication of contact information, and also term and the place of receipt of the answer, contact information of officials at which it is possible to learn about the course of consideration of the claim. After registration the claim goes to the head of the service provider, or the Ministry, for determination of the executive in charge and acceptance of adequate measures.

The claim of uslugopoluchatel which arrived to the service provider or the Ministries, is subject to consideration within five working days from the date of its registration. The result of consideration of the claim goes to uslugopoluchatel by means of mail service or is issued purposely in office of the service provider or the Ministry.

Confirmation of adoption of the claim of uslugopoluchatel through the portal is the notice of registration.

In case of the address through the portal information on procedure for appeal can be obtained by phone single contact center concerning rendering the state services.

When sending the claim through the portal information on the claim which is updated during processing of the claim by the service provider is available to uslugopoluchatel from "personal account" (mark about delivery, registration, execution, the answer about consideration or refusal in consideration).

In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is considered within fifteen working days from the date of its registration.

11. In disagreement cases with results of the rendered state service the uslugopoluchatel can take a legal action in the procedure established by the legislation.

4. Other requirements taking into account features of rendering the state service including rendered electronically

12. In rooms of the service provider conditions for servicing of uslugopoluchatel with limited opportunities (ramps and elevators) are provided.

13. Addresses of places of rendering the state service are placed on Internet resource of the Ministry: www.mz.gov.kz.

14. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.

15. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also single contact center concerning rendering the state services.

16. Single contact center concerning rendering the state services: 1414, 8-800-080-7777.
