About approval of Regulations of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan

According to Item 1 of article 9-1 of the Law of the Republic of Kazakhstan of November 27, 2000 "About ministerial procedures" I ORDER:

1. Approve the enclosed Regulations of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan.

2. To legal support department (Kuang A.) in the procedure established by the legislation to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) official publication of this order after its state registration.

3. To impose control of execution of this order on the responsible secretary of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan Kurmangaliyeva A. D.

4. This order becomes effective from the date of its state registration in the Ministry of Justice of the Republic of Kazakhstan.

Regulations of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan

1. General provisions

1. These Regulations of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further - Regulations) establish general rules of activities of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further - the Ministry) in the course of accomplishment of the functions assigned to it.

2. Job requirements with documents, the terms established by these Regulations extend to all staff of the Ministry, Committee on control and social protection of the Ministry of Labour and social protection of the population of the Republic of Kazakhstan, Committee on migration of the Ministry of Labour and social protection of the population of the Republic of Kazakhstan, (further - Committees) and the organizations which are under authority of the Ministry.

3. In the office of the Ministry, at the eight-hour duration of working hours, the beginning of work at 9 hours 00 minutes, completion of work - 18 hours 30 minutes is established. Lunch break from 13-00 till 14-30 o'clock.

4. The responsible secretary, vice-ministers, directors of Departments, chairmen of Committees inform the specialist of the reception Minister on the reasons and time of the absence from work (more than 30 minutes).

5. In reception of the Minister watch in holidays will be organized.

In case of watch in holidays at the request of the employee other day of rest is provided or payment not below than in double size, proceeding from day (sentry) rate of the employee, according to the Labor code of the Republic of Kazakhstan of May 15, 2007 is made.

6. The activities the Ministry performs according to the Presidential decree of the Republic of Kazakhstan of June 18, 2009 No. 827 "About system of state planning in the Republic of Kazakhstan".

2. Regulations of board

7. The ministry has the board which is advisory advisory body in case of the Minister. Numerical and the staff of Board affirms the Minister and consists of number of the first heads of Committees and structural divisions of the Ministry.

8. The purpose of carrying out Board - joint consideration, discussion and decision making on the questions having for the Ministry, Committees and the organizations which are under authority of the Ministry, priority value including following the results of work of the Ministry in general.

9. Meetings of Board of the Ministry are held in the state and Russian languages according to the work plan of Board. The number of cases in point at meetings of board is not limited.

In case of need according to the decision of the Minister emergency meetings of Board can be held.

The meeting of board is considered competent if more than a half from total number of members of board participate in it.

Members of board participate in meetings without the replacement right.

10. Representatives of state bodies, proceeding from their tasks of interagency coordination in adjacent fields of activity, and also in case of need non-governmental organizations are invited to meeting of board of the Ministry. The decision on the invitation of representatives of mass media and non-governmental organizations is accepted by the Minister.

11. The work plan of Board is developed on the basis of the annual plan of work of central office of the Ministry, according to offers of structural divisions of the Ministry, the Committees and organizations which are under authority of the Ministry no later than January 20 of the next year. The annual plan of Board affirms the Minister.

12. The approved work plans of Board are led up her secretary to all structural divisions of the Ministry, Committees and the organizations which are under authority of the Ministry.

13. The organization of carrying out, maintenance and record keeping of Board is assigned to Strategic development department and international cooperation.

14. The Minister, and in the absence of the Minister - person replacing him presides over meetings of Board.

15. Decisions of Board are made by a simple majority vote from total number of members of Board. In case of equality of votes the decision for which voted presiding over Board is deemed accepted. In case of expression of special opinion of members of Board, it is stated in writing and applied to the minutes of Board.

16. Meetings of Board are held openly. If necessary the chairman can declare holding private meeting of Board.

17. Questions of execution of orders of the President are considered at meeting of board of the Ministry according to the work plan.

18. Removal of the planned question or its transfer for later term is performed by the Minister based on the reference represented by heads of structural divisions of the Ministry and the organizations which are under authority of the Ministry, responsible for preparation of question.

19. Control of timely preparation of the materials which are subject to consideration at meetings of Board is assigned to one of the supervising vice-minister and the secretary of Board.

20. Heads of structural divisions not later than ten days prior to the regular meeting of Board transfer to the secretary of Board the draft decision of Board, the reference on the discussed question, and in case of need, drafts of other documents (orders, notes, information letters, reviews, presentation materials and so on).

Untimely representation of materials forms the basis for exception of the specified question of the agenda of the regular meeting of Board.

About all cases of untimely or low-quality preparation of materials for meeting of Board, the secretary of Board reports on the Minister.

21. Drafts of decisions and materials to them, upon termination of meetings, are subject to return to the secretary of Board.

22. By preparation of materials on the questions submitted for consideration of Board it is necessary to observe the following requirements:
