Procedure for development of schemes of planning of the territories of the Republic of Tajikistan

1. General provisions

1. The procedure for development of schemes of planning of the territories of the Republic of Tajikistan (further - the Procedure) is performed based on requirements of part 2 of article 47 of the Town-planning code of the Republic of Tajikistan and regulates the main directions of enhancement of systems of resettlement, development of settlements, the industries, agricultural industry engineering, transport and social infrastructure of regional and mezhselyonny value, border of settlements and residential suburbs and the cities, measures for protection of the territories of the Republic of Tajikistan against impact of emergency situations of natural and technogenic nature, measure for improvement of ecological situation and content of the territories of objects of cultural heritage.

2. The scheme of planning of the territories of the Republic of Tajikistan (further the scheme of the layout) is developed based on the Town-planning code of the Republic of Tajikistan, regulatory legal acts of the Republic of Tajikistan, state standards, regulations and rules of town planning.

3. The scheme of the layout determines state policy in the field of the strategy of town-planning development of the territories of the Republic of Tajikistan.

4. The organizational management also is scientific - methodical development of the scheme of the layout of the territories is performed by Committee on architecture and construction under the Government of the Republic of Tajikistan.

5. The procedure for approval, examination and approval of the scheme of the layout is performed according to the legislation of the Republic of Tajikistan, regulating conducting examination and approval of the town-planning, preproject and project documentation.

10. Customer of development of the scheme of the layout is the Committee on architecture and construction under the Government of the Republic of Tajikistan.

11. The scheme of the layout is developed based on task for development of town-planning documents according to appendix of 1 this Procedure issued by the customer.

12. Basic provisions of the scheme of the layout are subject to approval of local executive bodies of the government of the Gorno-Badakhshan Autonomous Region, areas, the city of Dushanbe, the cities and areas, Committee on architecture and construction under the Government of the Republic of Tajikistan, authorized body on land management, protection of historical monuments, state mining inspection, geology, the Sanitary and Epidemiological Inspectorate, transport, emergency situations and civil defense.

13. The list of bodies and organizations with which the scheme of the layout is approved is established by Committee on architecture and construction under the Government of the Republic of Tajikistan.

14. The procedure for approval and passing of examination of the scheme of the layout is determined in task for development of the scheme of the layout.

15. The customer sends to the interested bodies and organizations of the scheme of the layout and its basic provisions. The interested bodies and organizations shall provide within 10 days to the customer the conclusions.

16. If bodies and organizations did not submit the conclusion within the specified term, the scheme of the layout is considered approved.

17. Disagreements concerning approval of the scheme of the layout are solved according to the procedure, established by the legislation of the Republic of Tajikistan.
