About approval of the Procedure for making of separate customs transactions when using customs regime of customs warehouse and Mandatory requirements to arrangement, the equipment and the location of rooms and (or) the open areas, held for use as customs warehouse

For the purpose of realization of provisions of the Customs code of the Russian Federation (Meeting, legislations of the Russian Federation, 2003, N 22, Art. 2066; 5038) I order to Art. N 52,:

1. Approve the Procedure for making of separate customs transactions when using customs regime of customs warehouse (appendix 1) and Mandatory requirements to arrangement, the equipment and the location of rooms and (or) the open areas, held for use as customs warehouse (appendix 2).

2. Determine that:

a) permission of customs authority to goods placement under customs regime of customs warehouse is conditional release of goods according to customs regime of customs warehouse;

b) under customs locks there can be goods which are not placed under customs regime of customs warehouse if such goods are goods:

- concerning which action of customs regime of customs warehouse is complete and which are intended to export from customs warehouse;

- which storage duration under customs locks expired, and the order by which it is performed according to provisions of Chapter 41 of the Customs code of the Russian Federation;

- being on temporary storage in cases, stipulated in Clause 117 Customs codes of the Russian Federation;

c) the goods which are exposed to bystry spoil and being the food intended for subsequent their use as the supplies intended for consumption by passengers and members of crews onboard ocean (river) ships, aircrafts and trains, and also being medicines shall be declared to other customs regime, than customs regime of customs warehouse, and are exported from customs warehouse not later than 60 days before the expiration of their expiration date and (or) realization;

d) the customs clearance of the Russian goods intended for export from customs area of the Russian Federation according to customs regime of export and placed under customs regime of customs warehouse in case of impossibility of implementation of their actual export and the statement of goods to free circulation on customs area of the Russian Federation is made according to the procedure, in relation to customs regime of reimport;

e) the chief of customs in which region of activities the customs warehouse functions, or the official, it authorized, beforehand, but not later than 15 days before the expiration of storage of goods under customs locks and their forthcoming transfer of the relevant organization authorized by the Government of the Russian Federation to perform the order provides with goods according to the procedure established by the Government of the Russian Federation the notification on it in any written form of the legal owner of goods or person specified in Article 16 of the Customs code of the Russian Federation (if these persons are identified by customs authority).
