1. Approve the enclosed Regulations on accreditation on the right of maintaining hunting economy.

2. Add Chapter 6 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330; National legal Internet portal of the Republic of Belarus, 23.05. 2013, 5/37271; 10:08. 2013, 5/37654; 19:11. 2013, 5/38009), Item 6.60 of the following content:

"6.60. Accreditation on the right of maintaining hunting economy with issue of the certificate on accreditation on the right of maintaining hunting economy

Minleskhoz together with Ministry for Protection of the Environment and Natural Resources, the State inspectorate of protection of animal and flora in case of the President of the Republic of Belarus and regional executive committees

Regulations on accreditation on the right of maintaining hunting economy

1. This Provision is developed according to Item 23 of Rules of maintaining hunting economy and the hunting approved by the Presidential decree of the Republic of Belarus of December 8, 2005 No. 580 "About some measures for increase in efficiency of maintaining hunting economy and fishing activities, enhancement of public administration by them" (The national register of legal acts of the Republic of Belarus, 2005, No. 196, 1/6996; National legal Internet portal of the Republic of Belarus, 25.12.2013, 1/14679). This Provision establishes procedure for accreditation of users of hunting grounds on the right of maintaining hunting economy (further - accreditation).

2. The user of hunting grounds once in five years undergoes accreditation.

Accreditation is performed by the Ministry of forestry together with the Ministry of Natural Resources and Environmental Protection, the State inspectorate of protection of animal and flora in case of the President of the Republic of Belarus and regional executive committees.

3. Accreditation - activities of state bodies for establishment of compliance of opportunities of users of hunting grounds (technical, personnel and others) and their okhotokhozyaystvenny activities to requirements of this provision and other acts of the legislation on protection and use of fauna.

4. Accreditation is carried out after four years nine months from the moment of the conclusion by the user of hunting grounds of the lease agreement of hunting grounds or its previous accreditation, except as specified, specified in part two of this Item.

The users of hunting grounds who signed lease agreements of hunting grounds till June 26, 2014 undergo accreditation according to the schedule of accreditation approved by the Minister of forestry or the deputy authorized by it.

For accreditation passing the user of hunting grounds not later than 30 calendar days before the expiration specified in part one of this Item or determined by the schedule of accreditation files in the Ministry of forestry petition for receipt of the certificate on accreditation on the right of maintaining hunting economy (further - the statement) in form according to appendix 1 and submits the documents provided in Item 6.60 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, the Council of Ministers of the Republic of Belarus approved by the resolution of February 17, 2012 No. 156 "About approval of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs entering of amendment into the resolution of Council of Ministers of the Republic of Belarus of February 14, 2009 No. 193 and recognition voided some resolutions of Council of Ministers of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2012, No. 35, 5/35330).

5. For carrying out accreditation by the Ministry of forestry the interdepartmental commission on accreditation on the right of maintaining hunting economy is created (further - the interdepartmental commission). Its structure affirms the order of the Minister of forestry.

The chairman - the authorized deputy minister of forestry heads the interdepartmental commission.

The interdepartmental commission about two representatives of the Ministry of Natural Resources and Environmental Protection, the State inspection of protection of animal and flora to the President of the Republic of Belarus and on one representative of the Ministry of forestry and regional executive committee in the territory of which the hunting grounds leased by the user of hunting grounds undergoing accreditation are located (further - regional executive committee) are included.

6. The meeting of the interdepartmental commission is considered competent in case of presence on it on one representative of the Ministry of forestry, the Ministry of Natural Resources and Environmental Protection, the State inspection of protection of animal and flora to the President of the Republic of Belarus and regional executive committee. The decision of the interdepartmental commission is made by results of simple majority vote of voices. In case of the identical number of votes of pros and cons the voice of the chairman of the interdepartmental commission is decisive.

7. Meetings of the interdepartmental commission are held as required, but at least once in three months, in the presence of the arrived statements from users of hunting grounds.

Information on date of meeting of the interdepartmental commission in five days prior to its carrying out shall be posted on the website of the Ministry of forestry.

8. The interdepartmental commission considers arrived from the user of hunting grounds according to Item 6.60 of the single list of the ministerial procedures performed by state bodies and other organizations concerning legal entities and individual entrepreneurs, documents, the conclusion of regional executive committee about accomplishment by the user of hunting grounds of provisions of the lease of hunting grounds *, the conclusion of the Ministry of forestry about availability of the okhotoustroitelny documentation corresponding to the legislation and accepts one of the following decisions:

about issue to the user of hunting grounds of the certificate on accreditation (further - the certificate);

in case of non-presentation by the user of hunting grounds of all necessary documents or emergence of need to specify reliability of the provided data - about consideration of question repeated (within a month) of issue to the user of hunting grounds of the certificate;

about refusal in issue to the user of hunting grounds of the certificate (about not accreditation) (further - the decision on refusal).

* The regional executive committee three days before the meeting of the interdepartmental commission represents the conclusion about accomplishment by the user of hunting grounds of provisions of the lease of hunting grounds undergoing accreditation to the Ministry of forestry.

9. The decision on refusal is made in cases:

repeated non-presentation by the user of hunting grounds of all necessary documents or submission of false information;

recognitions of claims of regional executive committee by the interdepartmental commission regarding accomplishment by the user of hunting grounds of provisions of the lease of hunting grounds reasonable;

absence at the user of hunting grounds of the okhotoustroitelny documentation corresponding to the legislation;

steady (at least three years in a row) decrease in the actual number of any of the normalized types of hunting animals (except as specified, not depending on actions or failure to act of the user of hunting grounds, or exceeding of optimum number);

steady (at least three years in a row) excesses of the actual number of any of the normalized types of hunting animals over optimum more than for 30 percent (except as specified, not depending on actions or failure to act of the user of hunting grounds);

steady (at least three years in a row) growth of the actual number of wolf, either fox, or raccoon dog (except as specified, not depending on actions or failure to act of the user of hunting grounds);

variations more than for 50 percent of data on the number of any of the normalized types of the hunting animals received as a result of the accounting which is carried out by the user of hunting grounds from the data on the number of this type received as a result of control accounting in case of their carrying out in accordance with the established procedure;

absence at the user of hunting grounds of the official (the game manager, the hunting economy engineer, the head or the deputy manager of the user of hunting grounds) who is performing direct management of okhotokhozyaystvenny activities, having profile * the higher or secondary vocational education or getting such education by means of extramural studies and recognized in the Ministry of forestry in accordance with the established procedure certified regarding knowledge of the legislation in the field of maintaining hunting economy and hunting (in case when such certification was obligatory);

absence at the user of hunting grounds of the vehicles provided by okhotoustroitelny documentation for implementation of protection of hunting animals in the leased hunting grounds which had the state technical inspection (for motorized vehicles) and assigned to workers, representatives to perform protection of hunting animals in leased hunting grounds.

The decision on refusal can be appealed by the user of hunting grounds in court in the procedure established by the legislation.

The relevant decision of the interdepartmental commission is drawn up by the protocol and affirms the order of the Ministry of forestry.

10. Based on the order of the Ministry of forestry specified in Item 9 of this provision, to the user of hunting grounds the certificate on accreditation on the right of maintaining hunting economy in form according to appendix 2, signed by the Minister of forestry or the deputy authorized by it and certified by official stamp of the Ministry of forestry is granted.

The user of hunting grounds who did not address at the scheduled time to the Ministry of forestry with the statement is considered not accredited.

11. The ministry of forestry creates and keeps the register of the granted certificates in the form established by it.

12. Information on issue (about refusal in issue) certificates with application of a copy of the minutes of the interdepartmental commission in ten-day time from the date of adoption of the relevant decision by the interdepartmental commission goes the Ministry of forestry to the State inspection of protection of animal and flora in case of the President of the Republic of Belarus, the Ministry of Natural Resources and Environmental Protection, regional executive committee.
