Procedure for maintaining registers of lawyers of subjects of the Russian Federation

I. General provisions

1. This Procedure determines maintaining registers of lawyers of subjects of the Russian Federation according to Item 3 of article 14 of the Federal Law of May 31, 2002 No. 63-FZ "About lawyer activities and legal profession in the Russian Federation" (The Russian Federation Code, 2002, No. 23, Art. 2102; 2003, No. 44, Art. 4262; 2004, No. 35, Art. 3607, No. 52 (p. 2. According to Item 1 of article 14 of the Federal Law the register of lawyers of the subject of the Russian Federation (further - the register) (appendix No. 1 to this Procedure) conducts territorial authority of the Ministry of Justice of the Russian Federation (further - territorial authority).

3. The register is kept on paper and in electronic form. Information containing in the register on paper corresponds to information in the register on the electronic medium. In case of discrepancy between records on paper and in electronic form records on paper have priority.

Maintaining the register is performed according to this Procedure.

4. The register contains the following data:

1) name of the subject of the Russian Federation;

2) registration number of the lawyer;

3) surname, name, middle name (the last - in the presence) the lawyer;

4) about assignment of the status of the lawyer:

details of the decision of the qualification commission of Chamber of Advocates of the subject of the Russian Federation (further - the qualification commission of Chamber of Advocates) about assignment of the status of the lawyer or the decision of council of Chamber of Advocates of the subject of the Russian Federation (further - council of Chamber of Advocates) about acceptance of the lawyer in members of Chamber of Advocates of the subject of the Russian Federation (further - Chamber of Advocates) in case of change by the lawyer of membership in Chamber of Advocates;

details of the order of territorial authority about entering of information about the lawyer into the register;

5) about suspension of the status of the lawyer:

details of the decision of council of Chamber of Advocates on suspension of the status of the lawyer;

details of the order of territorial authority about entering into the register of data on suspension of the status of the lawyer;

6) about renewal of the status of the lawyer:

details of the decision of council of Chamber of Advocates on renewal of the status of the lawyer;

details of the order of territorial authority about entering into the register of data on renewal of the status of the lawyer;

7) about the termination of the status of the lawyer:

details of the decision of council of Chamber of Advocates on the termination of the status of the lawyer;

details of the order of territorial authority about entering into the register of data on the termination of the status of the lawyer;

8) about recovery of the status of the lawyer:

a) based on the judgment:

details of the decision of council of Chamber of Advocates on recovery of the status of the lawyer based on the judgment;

details of the order of territorial authority about recovery of the status of the lawyer based on the judgment;

b) in case of cancellation by council of Chamber of Advocates or council of Federal chamber of lawyers of the Russian Federation decisions on the termination of the status of the lawyer:

10) about modification:

content of changes;

details of the order of territorial authority about entering into the register of changes.

5. The register is on paper stitched, its sheets are numbered, data on the number of sheets are certified by the signature of the chief of territorial authority (person fulfilling its duties).

6. Entering into the register of data (exception of the register of data) is performed free of charge.

7. The data containing in the register are open and public.

The register is posted on the official site of lawyers.minjust.ru on the Internet, the territorial authority posts the reference to the specified website on the official site.
