About approval of the Regulations on procedure for issue of the certificate on inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products

According to article 12 of the Law of the Republic of Uzbekistan "About allowing procedures in the field of business activity" and the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of August 15, 2013 No. 225 "About measures for implementation of the Law of the Republic of Uzbekistan "About allowing procedures in the field of business activity", the Cabinet of Ministers decides:

1. Approve Regulations on procedure for issue of the certificate on inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products, according to appendix.

2. To the State Tax Committee of the Republic of Uzbekistan together with the interested ministries and departments in a month:

bring the departmental regulatory legal acts adopted by them into accord with this resolution;

provide the organization and holding actions for extended coverage of the purposes, content and the practical importance of this resolution among subjects of entrepreneurship.

3. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R.S.Azimov.

Regulations on procedure for issue of the certificate on inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products

I. General provisions

1. This Provision determines procedure for issue of the certificate on inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products.

2. The certificate on inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products (further - the certificate) is granted by the State Tax Committee of the Republic of Uzbekistan (GNK) according to the scheme and form according to appendices No. No. 1 and 2 to this Provision.

3. Action of this provision extends to the legal entities having licenses for the right of implementation of activities for production of alcoholic products issued in accordance with the established procedure by the Commission of the Cabinet of Ministers on licensing of activities for production of ethyl alcohol, alcoholic products, fermentation of tobacco raw materials and tobacco products manufacture.

4. The certificate grants the right to implementation of pouring of alcoholic products only the line of pouring of alcoholic products specified in it.

Lines of pouring of alcoholic products are understood as the capital processing equipment intended for pouring of alcoholic products.

The list of the capital processing equipment intended for pouring of alcoholic products is given in appendix No. 3 to this Provision.

5. The certificate is granted on effective period of the license for the right of implementation of activities for production of alcoholic products.

II. Allowing requirements and conditions

6. In case of inclusion of lines of pouring of alcoholic products in the unified register of accounting and use of lines of pouring of alcoholic products (further - the unified register) on which the certificate is granted, treat allowing requirements and conditions:

obligatory compliance with law by legal entities in case of inclusion of lines of pouring of alcoholic products;

the notification GNK on change of the name or the location (postal address) of the legal entity within seven working days after passing of re-registration;

strict observance of requirements of the corresponding standards, and also environmental, sanitary and hygienic and other standards and rules;

implementation of pouring of alcoholic products only the line of pouring of alcoholic products specified in the certificate.

7. To each line of pouring of alcoholic products to the legal entity the separate certificate is granted.

III. Documents necessary for receipt of the certificate

8. For receipt of the certificate the legal entity submits the following documents to GNK:

a) the statement for issue of the certificate in form according to appendix No. 4 to this Provision;

b) copy of the certificate on state registration of the legal entity;

c) the copy of the license for the right of implementation of activities for production of the alcoholic products granted by the Commission of the Cabinet of Ministers on licensing of activities for production of ethyl alcohol, alcoholic products, fermentation of tobacco raw materials and tobacco products manufacture;

d) passport copies on the equipment of lines of pouring of alcoholic products;

e) copies of the documents confirming the property right of the legal entity to lines of pouring of alcoholic products, including the copy of agreements (agreements, contracts etc.) on acquisition and import to customs area of the Republic of Uzbekistan of lines of pouring of alcoholic products (in case of their availability).

9. The requirement from the legal entity of submission of documents, not stipulated in Item the 8th this provision, is not allowed.
