Procedure for maintaining registers of unified information system of notariate

I. General provisions

1. The procedure for maintaining registers of unified information system of notariate (further - the Procedure) is prepared in pursuance of Article 34 part six provisions. 3, parts three of Article 37 and part three of Article 38 of Bases of the legislation of the Russian Federation on notariate of February 11, 1993 No. 4462-1 (further - Bases).

2. The procedure establishes rules of maintaining registers of unified information system of notariate (further - registers, EIS respectively):

register of notarial actions;

register of heritable cases;

the register of notifications on pledge of personal estate (further - the register of notifications);

register of participant lists of limited liability companies.

3. Control of observance of the Procedure is exercised by Federal notarial chamber and the Ministry of Justice of the Russian Federation according to Bases.

4. Maintaining registers includes introduction in them of data, storage of registers, ensuring confidentiality of the data included in registers (in the cases established by the legislation of the Russian Federation), provision of data from these registers.

5. When maintaining registers along with Procedure the Rules of notarial clerical work approved by the order of the Ministry of Justice of the Russian Federation of April 16, 2014 No. 78 are applied (it is registered by the Ministry of Justice of the Russian Federation 23.04. 2014, registration No. 32095) (further - Rules of notarial clerical work).

takes measures for ensuring access to registers of EIS in the cases provided by Bases including provides with use of the information and telecommunication Internet daily both round the clock open and direct entry of the unrestricted group of people without collection of payment to the data determined by part one of Article 34.4 of Bases, placed on the information and telecommunication Internet to the address published on the official site of the operator of EIS - http://www.notariat.ru/, and also provides possibility of provision of open and public data, stipulated in Item 2 parts one of Article 34.4 of the Bases containing in the register of notifications on pledge of personal estate on the inquiries sent use of the federal state information system "Single Portal of the State and Municipal Services (Functions)";

provides production of backup copies of registers of EIS and provision to their federal executive body performing functions on control and supervision in the field of notariate;

provides enciphering of the data specified in Procedure Item 15;

provides integrity of the data containing in registers of EIS;
