About modification and amendments in the order of the Government of the Kyrgyz Republic "About approval of Provisional rules of the organization of passenger traffic by road transport in the Kyrgyz Republic" of September 23, 2013 No. 519

For the purpose of reduction of some decisions of the Government of the Kyrgyz Republic in compliance with the Law of the Kyrgyz Republic "About road transport", being guided by articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About approval of Provisional rules of the organization of passenger traffic by road transport in the Kyrgyz Republic" of September 23, 2013 No. 519 the following changes and amendments:

in the name "Temporary" to exclude the word;

in Item 1 to exclude the word "Temporary";

recognize Items 2 and 3 invalid;

in Provisional rules of the organization of the passenger traffic by road transport in the Kyrgyz Republic approved by the above-stated resolution:

- in all text of the word "Provisional rules" in different cases to replace with the word of "Rule" in the corresponding cases;

- in all text and in appendices of the text in state language of the word "sonny", "synoo" in different cases to replace with the word "tender" in the corresponding cases;

- add Item 3 with the paragraph third the following content:

"-questions of the organization and carrying out tenders (tenders) for servicing of regular bus routes;";

- in the paragraph the second Item 29 of the word "about holding open tenders on determination of hauler for servicing of passengers on routes" shall be replaced with words "about procedure for the organization and carrying out tenders (tenders) for determination of hauler for servicing of regular bus routes (appendix 19 to these rules)";

- in paragraph three of Item 32 of the word and figures "for long-distance and international routes, more than 60 km long, and for mountainous areas -" to exclude 5 years;

- Item 103 in paragraph one to replace figure "5" with figure "3";

- in the paragraph the fourteenth Item 151 of the word "irrespective of the direction of the route specified in the license" shall be replaced with words "specified in the working schedule of buses along this route";

- add with appendix 19 in edition according to appendix to this resolution.

2. Declare invalid the order of the Government of the Kyrgyz Republic "About approval of Provisional regulations for holding open tenders on determination of hauler for servicing of passengers on routes" of July 30, 2013 No. 429.

3. This resolution becomes effective since April 1, 2014.

4. Publish this resolution in official mass media.

Appendix 19

to Rules of the organization of passenger traffic by road transport in the Kyrgyz Republic

Regulations on procedure for the organization and carrying out tenders (tenders) for determination of hauler for servicing of regular bus routes

General provisions

1. This Regulations on procedure for the organization and carrying out tenders (tenders) for determination of hauler for servicing of regular bus routes (further - the Provision) determine procedure for holding open tenders on determination of hauler or haulers for the organization of transportation of passengers by road transport on suburban and long-distance routes, establishes requirements to the legal entities and physical persons participating in open tender (further - the Participant).

2. The purpose of this provision is ensuring high-quality servicing of passengers with road transport and the transparent competition on suburban and long-distance routes.

2. Tender committee

3. Competition is held by authorized state body in the field of transport (further - the Organizer of tender).

4. For consideration of competitive offers, their assessment and determination of the winner of the tender Organizer of Tender creates tender committee and approves structure of tender committee (further - the Commission).

The secretary of the Commission who conducts clerical work and protocols of commission sessions is part of the Commission.

5. Representatives are part of the Commission:

- authorized state body in the field of transport;

- office of the plenipotentiary of the Government of the Kyrgyz Republic in area;

- authorized body in the field of traffic safety in the location;

- authorized state body in the field of development of entrepreneurship;

- the non-profit organization which is not representing the interests of carriers and passengers.

6. Commission chairman is the representative Organizatora of tender. In the absence of the chairman it is replaced by the vice-chairman.

The number of members of the commission shall be odd and constitute at least 5 (five), but no more than 9 (nine) people.

7. Commission session is recognized competent if at it there are at least 2/3 members of the commission.

8. The participant of tender prior to carrying out tender shall provide documentary confirmation of qualification data according to appendices 3 - 10 to this Provision.

9. The competitive offer is considered to the meeting requirements if it corresponds to all conditions specified in the tender documentation. If the competitive offer does not meet the requirements, it is rejected.

10. The commission can debar the Participant from tender for untimely data presentation according to appendices 3 - 10 to this Provision, and also for submission of inexact and incomplete data (qualification data, allowing documents and another), or when specifying in competitive offers of the data allowing to determine the Participant of tender.

11. The commission accepts only those competitive offers which are acknowledged conforming to requirements of the announced competition about what the protocol is constituted.

3. Packet of competitive documents

12. Before carrying out the tender Organizer of Tender creates lots and prepares packet of competitive documents.

13. The packet of competitive documents includes the following documents:

- the bid in the form specified in appendix 2 to this Provision;

- data on availability and condition of passenger vehicles of the Participant of tender in the form specified in appendix 3 to this Provision;

- data on condition of technological base of the Participant of tender, in the form specified in appendix 4 to this Provision;

- the information about persons (without specifying First name, middle initial, last name), responsible for traffic safety (further - DB), safe engineering (further - TB) and operation of vehicles of the Participant of tender in the form specified in appendix 5 to this Provision;

- the list of driver's structure (without F.I.O'S specifying). The participant of tender in the form specified in appendix 6 to this Provision;

- data on length of service of the Participant of tender (as legal entity) on passenger transport in the form specified in appendix 7 to this Provision;

- data on fares of passengers by route in the form specified in appendix 8 to this Provision;

- the information about persons responsible for DB, TB and operation of vehicles of the Participant (for information on the Participant), in the form specified in appendix 9 to this Provision;

- the information about the driver's list of the Participant (for information on the Participant), in the form specified in appendix 10 to this Provision;

- sample of the Standard contract on the organization of passenger traffic by road transport on routes according to appendix 11 to this Provision;

- big and small envelopes for submission of competitive offers and information on the Participant Organizatoru of tender. On small envelopes the text "Competitive offers" is put down and their quantity shall correspond to the number of members of the commission, and one - with text "Information on the Participant".

Competitive offers and information on the Participant are filled in according to the Instruction according to appendix 18 to this Provision.

4. Contents of competitive offers and information on the Participant

14. Competitive offers join data:

- specified in appendices 3 - 8 to this Provision;

- about coefficient of accident rate of the Participant (it is determined by formula: To = D/N, where To - accident rate coefficient, D - the number of road accident of reporting and accounting nature, N - quantity of railway vehicles of the Participant);

- about actions for updating of railway vehicles (in descriptive form at the expense of what means the new equipment will be acquired: grants, projects, credits, etc.).

In competitive offers data which can establish accessory of competitive offers to the specific Participant shall not be specified.

Repeated inclusion of vehicles and driver's structure at the same time more than on one route, except for seasonal is not allowed. The vehicles which are earlier exposed for participation in tender and won lots are not allowed further to participation in tender on other lots.

Competitive offers are filled in on forms of the established form according to appendices 3 - 8 to this Provision, without corrections and blots, in the number of copies corresponding to the number of members of the commission.

By the participant of tender data on participation in charity social events for the last year can be in addition provided (in descriptive form when also who was given financial and technical help how many money was transferred into accounts of child care facilities, etc.).

15. Information on the Participant includes the bid in the form specified in appendix 2 to this Provision with appendix of the following documents:

- the copy of the certificate on state registration in judicial authorities for legal entities, in bodies of the state statistics - for physical persons;

- the copy of the document confirming assignment to the Participant of identification code (number) of the taxpayer and the payer of insurance premiums;

- copy of the license for the organization of passenger traffic;

- the reference of Tax Service in the location about availability or absence of debt on taxes;

- the reference of Social fund of the Kyrgyz Republic in the location about availability or absence of debt;
