According to part 3 of Article 19 and part 2 of article 21 of the Federal law "About Special Assessment of Working Conditions" Government of the Russian Federation decides:

1. Approve the enclosed Rules of the admission of the organizations to activities for carrying out special assessment of working conditions, their registration in the register of the organizations which are carrying out special assessment of working conditions, suspensions and the terminations of activities for carrying out special assessment of working conditions, and also forming and maintaining the register of the organizations which are carrying out special assessment of working conditions.

2. To make to the Ministry of Labour and Social Protection of the Russian Federation explanations on application of this resolution.

3. Realization by the Ministry of Labour and Social Protection of the Russian Federation of the powers provided by this resolution is performed within the number of his workers and budgetary appropriations provided to it in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

4. This resolution becomes effective from the date of its official publication, except for the subitem "an" of Item 15 of the Rules approved by this resolution, which is becoming effective since January 1, 2015.

Rules of the admission of the organizations to activities for carrying out special assessment of working conditions, their registration in the register of the organizations which are carrying out special assessment of working conditions, suspensions and the terminations of activities for carrying out special assessment of working conditions, and also forming and maintaining the register of the organizations which are carrying out special assessment of working conditions

1. These rules establish procedure for the admission of the organizations to activities for carrying out special assessment of working conditions, their registration in the register of the organizations which are carrying out special assessment of working conditions, suspensions and the terminations of activities for carrying out special assessment of working conditions, forming and maintaining the register of the organizations which are carrying out special assessment of working conditions (further - the register).

2. The organization is considered the special assessment of working conditions allowed to activities for carrying out from acceptance date by the Ministry of Labour and Social Protection of the Russian Federation of the decision on its registration in the register or about organization activity renewal if these activities stopped earlier.

Organization activity on carrying out special assessment of working conditions stops from acceptance date the Ministry of Labour and Social Protection of the Russian Federation of the decision on entering into the register of record about suspension of operations of the organization.

Organization activity on carrying out special assessment of working conditions stops from acceptance date the Ministry of Labour and Social Protection of the Russian Federation of the decision on its exception of the register.

3. Forming and maintaining the register is performed by the Ministry of Labour and Social Protection of the Russian Federation using standardized technical and the software allowing to perform including information processing on the basis of use of single formats and standard protocols, and with observance of the requirements established by the legislation of the Russian Federation in the field of information, information technologies and information security.

4. The Ministry of Labour and Social Protection of the Russian Federation provides:

a) technical functioning of the register;

b) safe storage and use of the data containing in the register including their protection against destruction, modification and blocking of access to them, and also against other wrongful acts concerning such data;

c) implementation of the automated collection, storages, processings, generalization and the analysis of the data containing in the register;

d) access in accordance with the established procedure to the data containing in the register without collection of payment;

e) interaction of the register with other information systems.

5. The organizations which are conforming to requirements, the established Federal Law "About Special Assessment of Working Conditions", and provided to the Ministry of Labour and Social Protection of the Russian Federation the statement for registration in the register (further - the statement) containing the following data are subject to registration in the register:

a) full name and location of the organization, name and location of branches and representative offices of the organization (in the presence);

b) identification taxpayer number;

c) primary state registration number;

d) data on availability in statutory documents of the organization of specifying as core activity or one of types of its activities carrying out special assessment of working conditions;

e) data on availability as structural division of the organization of test laboratory (center) which is accredited by Federal Accreditation Service according to the procedure, established by the legislation of the Russian Federation, with indication of number, date of issue of the certificate of accreditation and area of its accreditation conforming to requirements of Item 3 of part 1 and part 2 of article 19 of the Federal law "About Special Assessment of Working Conditions";

e) data on availability in the organization at least 5 experts who are working according to the employment contract and having the certificate of the expert on the right of performance of works by special assessment of working conditions including at least one expert having the higher education on one of specialties - general hygiene, occupational health, sanitary and hygienic laboratory researches, with indication of their surname, name, middle name (in the presence), position and sequence number in the register of experts of the organizations which are carrying out special assessment of working conditions;

g) e-mail address of the organization (in the presence);

h) surname, name and middle name (in the presence) head of the organization.

6. The organizations have the right to enclose to the application documents (the copy of documents) specified in the statement confirmatory data, including copies of the certificate of accreditation of test laboratory (center) and area of its accreditation, the extract from the Unified State Register of Legal Entities.

7. Application is issued on the form of the organization in any form, signed by the head of the organization, certified by seal of the organization (in the presence of seal) and it can be provided to the Ministry of Labour and Social Protection of the Russian Federation on paper personally or is directed by the registered mail with the assurance of receipt or in the form of the electronic document by means of the Internet, including with use of the Single portal of the state and municipal services (functions).

In case of the direction of the application in the form of the electronic document signed by the strengthened qualified digital signature it shall be signed by type of the digital signature which is established by the legislation of the Russian Federation for signing of such documents.

8. The Ministry of Labour and Social Protection of the Russian Federation considers the arrived application within 20 working days from the date of its registration.

If necessary the Ministry of Labour and Social Protection of the Russian Federation can request in authorized federal executive bodies information confirming availability of information about the applicant in the Unified State Register of Legal Entities and (or) about its accreditation in national accreditation system by means of use of single system of interdepartmental electronic interaction. In this case the term of consideration of the application can be prolonged, but no more than for 20 working days.

9. By results of consideration of the application the decision on registration of the organization in the register or is made on refusal in registration of the organization in the register.

10. The basis for decision making about refusal in registration of the organization in the register is:

a) discrepancy of the statement to the requirements to its content and registration specified in Items 5 - 7 these rules;

b) submission of false documents or obviously false data.

11. The Ministry of Labour and Social Protection of the Russian Federation informs the organization on the decision made by results of consideration of the application within 5 working days from the date of decision making by means of the direction of the adequate notice the registered mail with the assurance of receipt or with use of information and telecommunication technologies in case of the direction of the statement and documents attached to it in the form of the electronic document.

In case of decision making about refusal in registration of the organization in the register the Ministry of Labour and Social Protection of the Russian Federation provides return of the organization of the documents submitted on paper.

In case of refusal in registration of the organization in the register for the basis specified in the subitem "an" of Item 10 of these rules, the organization has the right to submit repeatedly after their elimination the application according to the procedure, established by Items 5 - 7 these rules.

12. Registration of the organization in the register is performed by the Ministry of Labour and Social Protection of the Russian Federation within 3 working days from the date of decision making about registration of the organization in the register.

13. The register contains the following data:

a) full name and location of the organization, name and location of branches and representative offices of the organization (in the presence);

b) identification taxpayer number of the organization;

c) primary state registration number of the organization;

d) registration number of entry in the register;

e) decision date about entering of data on the organization into the register;

e) date and the basis of decision making about suspension of operations of the organization as the organization which is carrying out special assessment of working conditions;

g) date and the basis of decision making about renewal of organization activity as the organization which is carrying out special assessment of working conditions;

h) date and the basis of decision making about the termination of organization activity as the organization which is carrying out special assessment of working conditions.

14. In case of change of the data containing in the register of data concerning area of accreditation of test laboratory (center) and (or) the list of experts the organization within 10 working days from the date of such changes directs the corresponding application to the Ministry of Labour and Social Protection of the Russian Federation with indication of the data which are subject to change with application of copies of the relevant documents. The specified statement contains including data:

about reducing in accordance with the established procedure areas of accreditation of the test laboratory (center) which is structural division of such organization with indication of the harmful and (or) dangerous factors of the production circle and labor process specified in Items 1 excluded from area of accreditation - 11 and 15 - 23 parts 3 of article 13 of the Federal law "About Special Assessment of Working Conditions";

about change of list of the experts of the organization having the certificate of the expert issued in accordance with the established procedure on the right of performance of works by special assessment of working conditions.

The statement specified in paragraph one of this Item goes to the Ministry of Labour and Social Protection of the Russian Federation on paper the registered mail with the assurance of receipt or in electronic form, signed by the strengthened qualified digital signature.

The Ministry of Labour and Social Protection of the Russian Federation considers the application specified in paragraph one of this Item and the documents attached to it, makes the decision on entering of corresponding changes into the data on the organization containing in the register and makes such changes within 20 working days from the date of registration of such statement.

The requirements to the organization provided by the paragraph the second this Item are applied till December 31, 2021 inclusive.

15. Organization activity on carrying out special assessment of working conditions is subject to suspension in case:

a) involvement of the organization to the administrative responsibility in the form of administrative suspension of operations;

b) suspensions of action of accreditation of test laboratory (center) of the organization which is structural division of the organization;

c) identifications of the facts of non-compliance with requirements determined by part 4 of article 12 of the Federal law "About Special Assessment of Working Conditions" concerning application when carrying out researches (testing) and measurements of the harmful and (or) dangerous production factors approved and certified according to the procedure, the established legislation of the Russian Federation on ensuring unity of measurements, techniques (methods) of measurements, and also data on the measuring instruments entered into the Federal state information system of accounting of results of carrying out special assessment of working conditions according to the subitem "zh" of Item 3 of part 2 of article 18 of the Federal law "About Special Assessment of Working Conditions", and part 1 of article 19 of the Federal law "About Special Assessment of Working Conditions";

d) identifications of the facts of non-compliance with requirements of Items 2 and 3 of part 1 of article 19 of the Federal law "About Special Assessment of Working Conditions" by results of the consideration of the application directed to the Ministry of Labour and Social Protection of the Russian Federation by the organization according to Item 14 of these rules.

16. Data on the involvement of the organization to the administrative responsibility in the form of administrative suspension of operations provided by the subitem "an" of Item 15 of these rules go Federal Service for Labour and Employment to the Ministry of Labour and Social Protection of the Russian Federation within 10 working days from the date of pronouncement of the corresponding judgment by means of single system of interdepartmental electronic interaction.

17. Data on the suspension of action of accreditation of test laboratory (center) of the organization provided by the subitem "b" of Item 15 of these rules go Federal Accreditation Service to the Ministry of Labour and Social Protection of the Russian Federation within 5 working days from the date of adoption of the relevant decision by means of use of single system of interdepartmental electronic interaction.

17(1). Data on approach of the circumstances provided by the subitem "v" of Item 15 of these rules go Federal Service for Labour and Employment to the Ministry of Labour and Social Protection of the Russian Federation within 10 working days from the date of pronouncement of the corresponding instruction by means of single system of interdepartmental electronic interaction.

18. The Ministry of Labour and Social Protection of the Russian Federation provides consideration of the data specified in Items 16, 17 and 17 (1) these rules, makes the decision on entering into the register of record about suspension of operations of the organization and enters in the register such record within 5 working days from the date of registration of the specified data in the Ministry.

18(1). In the presence of the these rules of the bases for suspension of operations specified in the subitem "g" of Item 15 the Ministry of Labour and Social Protection of the Russian Federation makes the decision on entering into the register of record about suspension of operations of the organization and enters in the register such record within 5 working days from the date of adoption of the relevant decision.

19. In case of elimination of the reasons which formed the basis for suspension of operations of the organization for carrying out special assessment of working conditions, the organization sends to the Ministry of Labour and Social Protection of the Russian Federation the corresponding statement with application of documents, the specified reasons confirming elimination.

The Ministry of Labour and Social Protection of the Russian Federation provides consideration of the specified statement, makes the decision on entering into the register of record about renewal of organization activity on carrying out special assessment of working conditions and enters in the register such record within 20 working days from the date of registration of a statement in the Ministry.

20. The organization is subject to exception of the register in the following cases:

a) the activities implementation termination, including liquidation or reorganization (except for reorganization in the form of transformation), the termination of implementation of activities in the field of special assessment of working conditions;

b) cancellation of accreditation of the test laboratory (center) which is structural division of the organization;

c) the termination of effective period or cancellation of the certificate of the expert on the right of performance of works by special assessment of working conditions which will lead to violation of requirements, stipulated in Item 2 parts 1 of article 19 of the Federal law "About Special Assessment of Working Conditions";

d) not elimination of the reasons which formed the basis for suspension of operations of the organization according to the subitem "g" of Item 15 of these rules within 6 months from the date of decision making about suspension of operations;

e) by a court decision.

21. Data on availability in the Unified State Register of Legal Entities of record about the termination of organization activity go the Federal Tax Service to the Ministry of Labour and Social Protection of the Russian Federation quarterly based on request of the Ministry by means of single system of interdepartmental electronic interaction.

In case of the termination of implementation of activities in the field of special assessment of working conditions the organization sends the statement for the termination of implementation of the related activity to the Ministry of Labour and Social Protection of the Russian Federation.

22. The data provided by the subitem "b" of Item 20 of these rules go Federal Accreditation Service to the Ministry of Labour and Social Protection of the Russian Federation within 5 working days from the date of adoption of the relevant decision by means of use of single system of interdepartmental electronic interaction.

23. The Ministry of Labour and Social Protection of the Russian Federation provides consideration of the data or the statement specified in Items 21 and 22 of these rules makes the decision on exception of the organization of the register and excludes data on the organization from the register within 5 working days from the date of registration of the specified data or the statement in the Ministry.

24. In case of approach of the circumstances specified in the subitem "v" of Item 20 of these rules, the Ministry of Labour and Social Protection of the Russian Federation makes the decision on exception of the organization of the register and excludes data on the organization from the register within 3 working days from the date of approach of such circumstances.

25. The Ministry of Labour and Social Protection of the Russian Federation notifies in writing the organization on the decisions made according to Items 18, 18(1), 19 and 23 these rules within 5 working days from the date of adoption of the relevant decision.

26. Entering of data into the register is performed without collection of payment.

27. The data containing in the register are open and public for acquaintance of physical persons and legal entities with them on the official site of the Ministry of Labour and Social Protection of the Russian Federation on the Internet.

28. The actions (failure to act) of officials of the Ministry of Labour and Social Protection of the Russian Federation performed according to these rules can be appealed judicially, and also in pre-judicial procedure in accordance with the legislation of the Russian Federation about the organization of provision of the state and municipal services.

29. The Ministry of Labour and Social Protection of the Russian Federation provides storage of the data entered in the register without prescriptive limit.
