About approval of the Regulations on procedure for service of civil protection of the private by persons and the commanding structure and recognition voided some resolutions of the Cabinet of Ministers of Ukraine

1. Approve Regulations on procedure for service of civil protection of the private by persons and the commanding structure which is applied.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Regulations on procedure for service of civil protection of the private by persons and the commanding structure

General questions

1. In this Provision the procedure for service of civil protection of the private by persons and the commanding structure is determined and the questions connected with stay of citizens of Ukraine (further - citizens) in voluntary procedure in reserve of service of civil protection are regulated.

2. The service of civil protection is public service of special nature which provides fire protection, protection of the population and the territories against negative impact of emergency situations, takes measures to prevention and emergency response, liquidation of their effects in peace time and during the special period.

3. Faces of the private and the commanding structure of service of civil protection (further - face of the private and the commanding structure) are the citizens in voluntary procedure employed civil protection under the contract and which gives according to this Provision the special ranks.

4. Face of the private and the commanding structure treat personnel (personnel) of DSNS. The status of face of the private and the commanding structure is confirmed by the official ID which form and procedure for issue are established by DSNS.

5. Time of service of civil protection of the private by persons and the commanding structure is set off in their insurance years of service, length of service, length of service in the specialty, and also in years of service of public service according to the law.

6. Faces of the commanding structure are persons authorized on accomplishment of functions of the state to whom action of the requirements and restrictions provided by the Law of Ukraine "About prevention of corruption" extend.

7. Citizens, are for the first time employed civil protection, the Oath of service of civil protection according to article 108 of the Code of civil protection of Ukraine.

8. Citizens who are in accordance with the established procedure enlisted in organizations of formation of civil protection on day form of education for the purpose of receipt of the higher education on certain degree (educational qualification to level) and which gives the special ranks of the ordinary and younger commanding structure according to the procedure, determined by this Provision or which have the specified special ranks are considered as cadets.

As listeners are considered:

persons of average and the senior commanding structure who are in accordance with the established procedure enlisted in institutions of higher education of civil protection on day form of education for the purpose of receipt of the higher education;

face of the private and the commanding structure which are in accordance with the established procedure enlisted in organizations of formation of civil protection on extramural studies for the purpose of receipt of the higher education on certain degree (educational qualification to level) or receive educational services in programs of post-qualifying education in these institutions.

Persons of average and the senior commanding structure who are in accordance with the established procedure enlisted in institutions of higher education of civil protection, scientific institutions for receipt of degree of the doctor of philosophy are considered as graduateds in a military academy.

Persons of average and the senior commanding structure who are in accordance with the established procedure enlisted or attached in institutions of higher education of civil protection, scientific institutions for receipt of doctor's degree are considered as doctoral candidates.

9. The general period of service of civil protection includes time of stay of face of the private and the commanding structure on service of civil protection and is established in calendar calculation, and in the cases determined by the legislation - in preferential calculation.

10. In the first afternoon of service of civil protection day of acceptance of the citizen on service of civil protection, its transfer in personnel of DSNS, assignment to it the corresponding special rank and position assignment in the device DSNS, its territorial authorities, divisions of operational rescue service of civil protection (rescue units of the central subordination, rescue units of special purpose, special aviation, sea and other forming, the state rescue and fire fighting divisions (parts), training centers, forming and divisions of providing), organizations of formation of civil protection, scientific institutions and other divisions in which face of the private and the commanding structure serve civil protection (further - bodies and divisions of civil protection) is considered.

11. The service of civil protection comes to an end in case of dismissal of face of the private or the commanding structure from service of civil protection in inventory of Armed Forces or in resignation, death (death), recognition by its court is unknown absent or announcements the dead.

12. Last afternoon of service of civil protection day of exception of face of the private and the commanding structure of DSNS personnel is considered.

13. Face of the private and the commanding structure are considered as the acting as service of civil protection:

1) in the territory of body and division of civil protection or in other place of employment (occupations) during working (educational) hours, including the breaks established by daily routine (lesson schedule);

2) in travel time on service or from service, office trips, return to the duty station;

3) during stay out of the location of body and division of civil protection if during such stay they carry out the obligations or are directed by order of the corresponding head (chief).

14. The basic principle of service of civil protection is the principle of one-man management which consists in:

investment of the head (chief) in full the administrative power concerning subordinates and assignment on it the personal responsibility before the state for the organization of activities of the body headed by it or division of civil protection and each face of the private and the commanding structure;

provision to the head (chief) of the right to solely make the decision, to issue orders or orders;

ensuring accomplishment of decisions, orders or orders of the head (chief), proceeding from results of comprehensive assessment of conditions and circumstances and being guided by requirements of the legislation.

15. The list of persons who are on service of civil protection shares on ordinary and commanding. The commanding structure is divided on younger, average, senior and the highest.

To faces of the private and the commanding structure the following special ranks are given:

ordinary structure - ordinary service of civil protection;

the younger commanding structure - the lance sergeant of service of civil protection, the sergeant of service of civil protection, the staff sergeant of service of civil protection, the foreman of service of civil protection, the ensign of service of civil protection, the senior warrant officer of service of civil protection;

the average commanding structure - the second lieutenant of service of civil protection, the lieutenant of service of civil protection, the senior lieutenant of service of civil protection, the captain of service of civil protection;

the senior commanding structure - the major of service of civil protection lieutenant colonel of service of civil protection, the colonel of service of civil protection;

the highest commanding structure - the major general of service of civil protection, the lieutenant general of service of civil protection, the colonel general of service of civil protection, the general of service of civil protection of Ukraine.

16. The age limit of stay on service of civil protection is established:

1) for faces of the ordinary, younger and average commanding structure - up to 50 years;

2) for faces of the senior commanding structure - up to 55 years;

3) for faces of the highest commanding structure - up to 60 years.

17. Face of the private and the commanding structure which have high professional training, the experience of practical work on post recognized suitable for health reasons for service on their request can be left according to the decision of the Chairman of DSNS, the head (chief) of body or division of civil protection on service over age limit of stay on service of civil protection up to five years.

18. To faces of the private and the commanding structure according to the decision of the Chairman of DSNS (the head (chief) of body or division of civil protection) service life can be prolonged repeatedly up to five years, and to faces of the commanding structure which serve in organizations of education and scientific institutions of civil protection and have scientific degree or academic status, - up to ten years in cases, are determined by the Ministry of Internal Affairs.

19. For faces of the private and the commanding structure five-day 40-hour business week with two days off, and for faces of the private and the commanding structure, cadets (listeners) of organizations of formation of civil protection - six-day business week with one day of rest is established.

Executions of internal, garrison and guard duty by faces of the private and the commanding structure it can be performed over the established duration of working hours.

In case of the variable mode of service the identical duration of day, evening and night shift is established.

In case of accomplishment of service duties over the established duration of working hours time for rest during the following business week is provided.

20. In case of installation of high alerts, emergency situation, emergency state, and also carrying out rescue and other urgent works, suppressions of the fires, mitigations of consequences of emergency situations of face of the private and the commanding structure serve over the established duration of working hours, and also in days off and holidays.

21. Face of the private and the commanding structure in case of temporary disability are exempted from accomplishment of service duties for the period of such disability.

22. Internal rules and procedures in which requirements to the organization of service are determined and daily routine in bodies and divisions of civil protection are established by their heads (chiefs) taking into account features of activities of such bodies and divisions.

23. Faces of the commanding structure shall promote creation of safe and healthy conditions for service by subordinates, give them opportunity for job development taking into account experience, qualifications, professional skill and capabilities, and also to create proper conditions for rest.

24. The face of the private and the commanding structure has the right to conducting office investigation according to its requirement for the purpose of removal groundless, in his opinion, accusations or suspicion concerning violation by it of the legislation, office discipline, abuses or other offenses in office activities.

25. Face of the private and the commanding structure are provided with uniform and special clothes, distinction signs, equipment and individual protection equipment.

26. Social and legal protection of faces of the private and the commanding structure and members of their families is provided according to the legislation.

27. Heads (chiefs) of bodies and divisions of civil protection bear the personal responsibility for failure to meet requirements of this provision and other regulatory legal acts concerning service of civil protection of the private by persons and the commanding structure.

In case of identification of the corruption or connected with corruption offense or receipt of information on making of such offense by person of the commanding structure heads (chiefs) of bodies and divisions of civil protection shall take within the powers measures to the termination of such offense and notify immediately in writing on its making to specially authorized subject in the field of anti-corruption according to the procedure determined by the legislation.

27-1. Faces of the commanding structure are forbidden to be engaged during service entrepreneurial or another paid (except teaching, scientific and creative activities, medical practice, instructor and judicial practice from sport) in activities.

Rights, obligations and responsibility

28. Face of the private and the commanding structure have the rights and carry out service duties according to the legislation and this Provision.
