Article 1

"Article 36.1. Independent quality evaluation of rendering services by the organizations of culture

The independent quality evaluation of rendering services by the organizations of culture is one of forms of public control and is carried out for the purpose of provision to citizens of information on quality of rendering services by the organizations of culture, and also for the purpose of improvement of quality of their activities.

The independent quality evaluation of rendering services by the organizations of culture provides assessment of conditions of rendering services in such general criterions as openness and availability of information on the organization of culture; comfort of conditions of provision of services and availability of their obtaining; waiting time of provision of service; goodwill, politeness, competence of employees of the organization of culture; satisfaction with quality of rendering services.

The independent quality evaluation of rendering services by the organizations of culture is carried out according to provisions of this Article. When carrying out independent quality evaluation of rendering services by the organizations of culture the public information on the organizations of culture placed including in the form of open data is used.

The independent quality evaluation of rendering services by the organizations of culture is not carried out concerning creation, execution and interpretation of literary works and art.

For the purpose of creation of conditions for the organization of carrying out independent quality evaluation of rendering services by the organizations of culture:

the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of culture (further - authorized federal executive body), with participation of the specialists performing professional activity in the field of culture, public organizations in the field of culture, public associations of consumers (their associations, the unions) (further - public organizations) creates public council on carrying out independent quality evaluation of rendering services by the organizations of culture and approves regulations on it. The list of the organizations of culture concerning which the independent quality evaluation of rendering services by them is not carried out affirms authorized federal executive body with preliminary discussion on public council;

public authorities of subjects of the Russian Federation with participation of public organizations create public councils on carrying out independent quality evaluation of rendering services by the organizations of culture located in the territories of subjects of the Russian Federation and approve regulations on them;

local government bodies with participation of public organizations have the right to create public councils on carrying out independent quality evaluation of rendering services by the organizations of culture located in the territories of municipalities and to approve regulations on them.

The indicators characterizing general criterions of quality evaluation of rendering services by the organizations of culture specified in part four of this Article are established by authorized federal executive body with preliminary discussion on public council.

According to the solution of authorized federal executive body, public authorities of subjects of the Russian Federation or local government bodies of function of public councils on carrying out independent quality evaluation of rendering services by the organizations of culture can be assigned to the public councils existing under these bodies. In such cases public councils on carrying out independent quality evaluation of rendering services by the organizations of culture are not created.

The public council on carrying out independent quality evaluation of rendering services by the organizations of culture is created so that possibility of conflict of interest was excluded. The structure of public council is created of number of representatives of public organizations. The number of members of public council cannot be less than five people. Members of public council perform the activities on a voluntary basis. Information on activities of public council is placed public authority, local government body under which it is created, on the official site on the Internet (further - Internet network).

The independent quality evaluation of rendering services by the organizations of culture organized by public councils on its carrying out is carried out not more often than once a year and at least once in three years.

Public councils on carrying out independent quality evaluation of rendering services by the organizations of culture:

determine lists of the organizations of culture concerning which independent assessment is carried out;
