About measures for implementation of the Law of the Republic of Uzbekistan "About rescue service and the status of the rescuer"

In pursuance of the Law of the Republic of Uzbekistan "About rescue service and the status of the rescuer" and for the purpose of enhancement of activities of rescue services and rescue forming the Cabinet of Ministers decides:

1. Approve:

Regulations on procedure for certification of rescue services, rescue forming and rescuers, accounting registration of rescue services and rescue forming according to Appendix No. 1;

Rules of determination of the mode of working hours (service) of rescuers and payment of their work according to Appendix No. 2.

2. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent, bodies of the public and economic board and other organizations in three-months time:

create the corresponding certifying commissions and organize their activities;

bring the regulatory legal acts into accord with this resolution.

3. To public authorities on places, to bodies of the public and economic board, self-government institutions of citizens and other organizations to render every possible assistance to rescue services and rescue forming in case of performance of works on liquidation of emergency situations.

4. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan B. I. Zakirov.

Regulations on procedure for certification of rescue services, rescue forming and rescuers, accounting registration of rescue services and rescue forming

I. General provisions

1. This Provision according to the Law of the Republic of Uzbekistan "About rescue service and the status of the rescuer" determines procedure for carrying out certification of rescue services, professional, emergency and public rescue forming (further - rescue services, rescue forming) and rescuers, and also accounting registration of rescue services and rescue forming.

2. Citizens of the Republic of Uzbekistan acquire the status of the rescuer according to the solution of the corresponding certifying commission based on results of certification after passing of medical examination, training in the program of training of rescuers and accomplishment of standard rates by them on physical training.

II. Purposes and tasks of certification

3. Certification of the rescue services, rescue forming and rescuers involved to carrying out rescue operations in emergency situations is carried out for the purpose of determination of their professional readiness for emergency response of natural and technogenic nature and to work on their liquidation.

During certification obligatory check the professional training level of heads and rescuers of rescue services, rescue forming are subject, to their equipment rescue means and degree of readiness for accomplishment of rescue operations. By results of certification the relevant documents on the right of conducting rescue operations are issued.

4. The main objectives of certification are:

check of degree of practical readiness and possibility of attraction of rescue services, rescue forming to accomplishment of rescue operations in emergency situations;

check of level of knowledge, professional training, physical, psychological, moral fitness and state of health of rescuers;

check of level of equipment of the tasks certified by the equipment, necessary property and equipment for the decision them on purpose.

III. Bodies of certification of rescue services, rescue forming and rescuers

5. For carrying out certification of rescue services, rescue forming and rescuers departmental and territorial certifying commissions are created permanent Interdepartmental.

The organization of work on certification of rescue services, rescue forming and rescuers is assigned to Interdepartmental certifying commission on certification of rescue services, rescue forming and rescuers (further - Interdepartmental certifying commission), departmental certifying commissions on certification of rescue services, rescue forming and rescuers of the ministries, departments and other organizations (further - departmental certifying commissions) having in the structure rescue services and rescue forming, and also territorial certifying commissions on certification of rescue services, rescue forming and rescuers of the Republic of Karakalpakstan, areas and the city of Tashkent (further - territorial certifying commissions).

6. The structure of Interdepartmental certifying commission on certification of rescue services, rescue forming and rescuers affirms the Cabinet of Ministers of the Republic of Uzbekistan, representatives of the interested ministries, departments and other organizations according to appendix No. 1 to this Provision enter it on position.

7. Structures of departmental certifying commissions on certification of rescue services, rescue forming and rescuers affirm heads of the relevant ministries, departments and other organizations in coordination with Interdepartmental certifying commission, with assignment of accounting numbers by it according to the list according to appendix No. 2 to this Provision.

8. Structures of territorial certifying commissions on certification of rescue services, rescue forming and rescuers affirm respectively the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokimama of areas and the city of Tashkent in coordination with Interdepartmental certifying commission, with assignment of accounting numbers by him according to the list according to appendix No. 3 to this Provision.

IV. Interdepartmental certifying commission on certification of rescue services, rescue forming and rescuers

9. The interdepartmental certifying commission is created for the purpose of coordination and control of activities of departmental and territorial certifying commissions for certification of rescue services, rescue forming and rescuers, and also carrying out certification of rescue services, rescue forming and rescuers.

10. The interdepartmental certifying commission has the right:

make the decisions necessary for the organization and carrying out certification within the competence;

consider and approve the programs of initial preparation and retraining of rescuers developed by the ministries, departments and other organizations having rescue services, rescue forming;

consider and approve the main qualification requirements and criteria shown to rescue services, rescue forming and rescuers;

request and receive from the ministries, departments and other organizations information on rescue services, rescue forming and rescuers necessary for accomplishment of the tasks assigned to it;

make offers in state bodies and other organizations for enhancement of certification system, increase in functional readiness for actions of rescue services, rescue forming and rescuers, their hardware and professional training;

make offers on changes and amendments in the list of the ministries, departments and other organizations in which departmental certifying commissions are created;

check work of departmental and territorial certifying commissions, readiness of rescue services, rescue forming and rescuers to emergency response and work on their liquidation according to the plan approved by the head of the corresponding Complex of the Cabinet of Ministers of the Republic of Uzbekistan;

make the decision on carrying out extraordinary certification of rescue services, rescue forming and rescuers on unsatisfactory results of primary, periodic certification, and also checks of rescue services, rescue forming;

on the free admission to permanent bases of rescue services, rescue forming. The admission on sensitive sites and to the materials constituting the state secrets or other secret protected by the law is performed in the procedure established by the legislation.

11. Are assigned to Interdepartmental certifying commission:

a) coordination and control of activities of departmental and territorial certifying commissions for certification of rescue services, rescue forming and rescuers;

b) conducting checks of activities of departmental and territorial certifying commissions, and also rescue services, rescue forming according to the plan approved by the head of the corresponding Complex of the Cabinet of Ministers of the Republic of Uzbekistan;

c) approval of work plans of departmental and territorial certifying commissions;

d) approval of programs of training of the rescuers developed by the ministries, departments and other organizations having rescue services, rescue forming;

e) carrying out on the basis of the approved qualification requirements of certification:

the rescue services and professional rescue forming of republican level operating in all territory of the Republic of Uzbekistan, and their administrative board;

the rescuers represented to assignment of cool qualification "The rescuer of the international class".

12. The chairman of Interdepartmental certifying commission has the right to make, in case of need, changes to the existing structure of Interdepartmental certifying commission in coordination with the Cabinet of Ministers of the Republic of Uzbekistan.

13. For the objective solution of the questions requiring special knowledge, by the head of the corresponding Complex of the Cabinet of Ministers of the Republic of Uzbekistan on representation to Interdepartmental certifying commission the expert group of number of scientists and specialists of the ministries, departments and other organizations can be created.

V. Departmental certifying commissions on certification of rescue services, rescue forming and rescuers of the ministries, departments and other organizations

14. In the ministries, departments and other organizations as a part of which there are rescue services, rescue forming departmental certifying commissions are created.

15. The chairman of departmental certifying commission is the deputy manager of the ministry, department, organization supervising rescue service and rescue forming.

16. Departmental certifying commissions carry out certification:

departmental rescue services;

regular and emergency rescue forming (on profile of the ministry, department, organization);

rescuers of rescue services, regular and emergency rescue forming (on profile of the ministry, department, organization).

17. Departmental certifying commissions determine procedure for certification of departmental rescue services, rescue forming and rescuers taking into account interdepartmental acts.

18. Departmental certifying commissions are accountable to Interdepartmental certifying commission.

19. Departmental certifying commissions in accordance with the established procedure transfer data and materials of certification to Interdepartmental certifying commission.

VI. Territorial certifying commissions on certification of rescue services, rescue forming and rescuers of the Republic of Karakalpakstan, areas and the city of Tashkent

20. Territorial certifying commissions on certification of rescue services, rescue forming and rescuers are created under Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent.

21. The chief of territorial administration on emergency situations is appointed the chairman of territorial certifying commission.

22. Territorial certifying commissions carry out certification:

rescue services, regular and emergency rescue forming of territorial level;

public rescue forming of territorial level;

rescuers of rescue services, regular, emergency and public rescue forming of territorial level, and also the rescuers who are not part of rescue forming.

23. Territorial certifying commissions if necessary can interact in the territories with departmental certifying commissions concerning carrying out certification of departmental and territorial rescue services, rescue forming and rescuers.

24. Territorial certifying commissions are accountable to Interdepartmental certifying commission.

25. Territorial certifying commissions in accordance with the established procedure transfer data and materials of certification to Interdepartmental certifying commission.

VII. Carrying out certification of rescue services, rescue forming and rescuers

26. Certification is carried out by certifying commission:

primary and periodic - according to the plans and schedules developed by the corresponding certifying commissions for the next year on the basis of the materials represented by founders (participants) and heads of rescue services, rescue forming;

extraordinary - in case of change of type of the performed rescue work specified in the certificate the right of conducting rescue operations and also, on the solution of the corresponding certifying commission, on unsatisfactory results of primary, periodic certification, the staged drills and in case of identification during check by persons or the commissions of the facts of violation of requirements imposed to rescue services, rescue forming and rescuers authorized on that.

27. Joint carrying out certification of rescue services, rescue forming and rescuers by departmental and territorial certifying commissions is allowed. Document creation in this case is assigned to certifying commission under which authority the certified rescue service, rescue forming, the rescuer are.

28. For conducting check and certification of rescue services, rescue forming on site of dislocation, and also rescuers creation from among members of certifying commission or its representatives of working groups, with the subsequent representation of materials in certifying commissions for approval is allowed.

29. Certification of rescuers is carried out by certifying commission and drawn up by the protocol in form according to appendix No. 4 to this Provision.

30. Based on the considered materials and the performed rescue service or rescue forming the certifying commission draws up the statement of certification for form according to appendix No. 5 to this Provision with which it acquaints founders (participants) and the head of rescue service, rescue forming.

31. The act affirms the chairman of the corresponding certifying commission, with execution of the conclusion about opportunities of rescue service, rescue forming to perform the functions assigned to them on accomplishment of rescue operations in emergency situations according to the list according to appendix No. 6 to this Provision.

32. Results of certification are determined by open voting. The decision is made by a majority vote from total number of the members of certifying commission who are present at meeting of certifying commission.

33. The solution of certifying commission is considered valid if at meeting there are at least two thirds of her members. Results of certification are brought in registers of primary, periodic (extraordinary) certification of rescue services, rescue forming and rescuers of the corresponding certifying commissions in form according to appendix No. 7 to this Provision.

34. Results of certification are led up to heads of the relevant ministries, departments and other organizations, management of the serviced object and higher certifying commission.
