According to the subitem 8) of article 14 of the Law of the Republic of Kazakhstan of July 4, 2013 "About National chamber of entrepreneurs of the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed list of the documents confirming goods origin.

2. Declare invalid the order of the acting minister of the industry and new technologies of the Republic of Kazakhstan of December 2, 2011 No. 441 "About approval of the list of the documents confirming goods origin" (No. registered in the Register of state registration of regulatory legal acts 7372, No. 51 published in the Kazakhstanskaya Pravda newspaper of February 18, 2012 (26870).

3. (Kaneshev B. B.) in the procedure established by the legislation to provide to committee of technical regulation and metrology of the Ministry of the industry and new technologies of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in mass media and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of the industry and new technologies of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of the industry and new technologies of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

4. To impose control of execution of this order on the first vice-minister of the industry and new technologies of the Republic of Kazakhstan Rau A. P.

5. This order becomes effective after ten calendar days after day of its official publication.

The list of the documents confirming goods origin

1. The documents confirming the status of the applicant:

1) the copy of the identity document - for physical persons;

2) the copy of the reference (certificate) on state registration (re-registration) of the legal entity - for legal entities;

3) the copy of the certificate on state registration as the individual entrepreneur or the copy of the notification on the beginning of activities as the individual entrepreneur - for individual entrepreneurs;

4) the copy of the certificate on state registration of peasant farm or the copy of the notification on the beginning of activities as the individual entrepreneur - for country or farms.

1-1. The copy of the contract in foreign trade (agreement), the invoice or accounts proforma, or other document reflecting financial and (or) quantitative parameters of goods (when implementing long-term foreign trade agreements / transactions when the load goes from the same consignor to the same consignee, provision of the invoice or the account proforma is not required if it does not contradict requirements of the existing (ratified) international agreements or agreements and (or) rules of determination of country of source (criteria of determination of country of source) established unilaterally by the country (union) of import).

In commodity exportation cases on exhibitions (fairs), execution of the certificate of origin of batch production and also if the goods are implemented after export from the territory of the Republic of Kazakhstan, provision of the documents specified in Item 1-1 of this List is not required if it does not contradict requirements of the existing (ratified) international agreements or agreements and (or) rules of determination of country of source (criteria of determination of country of source) established unilaterally by the country (union) of import.

1-2. If the goods are completely made in the Republic of Kazakhstan, the copy of documents, confirmatory that the goods are completely made in the Republic of Kazakhstan:

1) if the applicant is not producer of the goods specified in subitems 2), 4), 5), 6), 7), 8), 9), 12), 13), 14), 15), 16), 17), 18), 19), 20) and 22) this Item, then copies of the documents confirming transition of the property right to goods from the producer to the applicant (the agreement or accounts invoices, either delivery note or other document confirming transition of the property right from the producer of goods to the applicant) are shown;

2) on the minerals, mineral products, land resources got from subsoil of the Republic of Kazakhstan or in the territorial sea (other reservoir of the Republic of Kazakhstan) or bottom it is provided to the copy of the license for production or the act of registration of the contract for subsurface use or the contract for subsurface use or the trust management agreement (submission of the specified documents is allowed once a year);

3) on agricultural goods of plant origin, including vegetables and fruit, the waybill copy or the grain receipt, or the statement according to the grain receipt or other document confirmatory transition of the property right to goods is provided to the applicant, and also the certificate of the place of collection of products from the applicant;

4) on wild-growing plants and their parts copies of the documents certifying legality of cutting down, collection or procurement of such plants and their parts are provided;

5) on all types of live animals (agricultural, house, wild, zoo, sea, trade fur, circus, laboratory and others); all types of live birds (house, wild, decorative); live bees, cocoons of silkworm suitable for unwinding; live decorative insects, amphibiouses, reptiles and reptiles; live fish (including decorative), live frogs, crayfish, sea invertebrates and other gidrobionat, wine snails for content and cultivation; the impregnated caviar, embryos, zygotes, sperm of animals; incubatory egg; live forages for fishes (including, гамарус, Artemy Salina) the copy of the certificate of origin of catch or confirmation about assignment of accounting number is provided to object of production (cultivation of animals and birds) or the import permit or the veterinary certificate or the reference;

6) on the meat in hulks, half carcasses, quarter timbers, blocks received from farm animals, meat of agricultural bird, and also offal of slaughter of farm animals and birds, salted pork fat, fats not melted and melted acknowledgment copies about assignment of accounting number are provided to object of production (the lethal workshop), the veterinary reference on live animals and birds (who underwent to slaughter (face) or confirmations about assignment of accounting number to object of production (cultivation of animals and birds) or the import permit or the veterinary certificate or the reference;

If the vessel which makes catch or conversion of the goods specified in this subitem of the List (is leased affreighted) by resident of the Republic of Kazakhstan, then copies of the documents confirming such fact are provided;

8) on the meat in hulks, half carcasses, quarter timbers, blocks received from wild animals and birds and also offal of slaughter of wild animals and birds, fats not melted and melted the copy of the veterinary certificate or the copy of the import permit is provided;

9) on honey bee; egg of birds commodity; tanning and pushnomekhovy raw materials, endocrine raw materials; intestinal raw materials; offal non-food; rogokopytny raw materials unmanufactured, including bones; the hair (bristle, wool, down, feather, waste, molt), inner side and scraps of rawhide, bile, wax, propolis, Merv, uterine milk, bee sting, poison snake, hunting trophies, manure (bird's dung) is provided the copy of the veterinary certificate or the reference or the copy of the import permit;

10) on the scrap and waste of non-ferrous and ferrous metals which were in the use of product and collected in the territory of the Republic of Kazakhstan the copy of the license (permission) or the notification on the beginning of activities for collection (procurement), storage, conversion and realization by legal entities of scrap and waste of non-ferrous and ferrous metals, both the certificate of education and the place of collection of scrap and waste of non-ferrous and ferrous metals is provided;

11) on waste (secondary raw materials), including scrap and the waste of non-ferrous and ferrous metals received as a result of production or other operations on conversion the copy of the act (reference) of write-off (education) of waste of scrap or the copy of the act on disposal (write-off) of fixed assets or the copy of the act of receipt of the inventories received in case of disassembly and dismantle of fixed assets is provided (these documents are provided only by the applicant who is not performing the type of activity connected with conversion of waste and scrap of non-ferrous and ferrous metals);

12) on water copies of documents, the confirming legalities of use of water objects or the copy of the contract for water supply or water disposal are provided;

13) on the goods made only from the raw materials and materials specified in the subitem 2) of this Item the copy of the license for production or the contract for subsurface use or the trust management agreement (are provided once a year), the copy of the short description of engineering procedure is provided;

14) on the goods made only from the raw materials and materials specified in the subitem 3) of this Item the statement according to the grain receipt or other document confirmatory transition of the property right to goods, the certificate of the place of collection of products, the copy of the short description of engineering procedure are provided to the applicant of the waybill copy or the grain receipt, or;

15) on the goods made only from the raw materials and materials specified in the subitem 4) of this Item copies of the documents certifying legality of cutting down, collection or procurement of such plants and their parts, the copy of the short description of engineering procedure are provided;

16) on the goods made only from the raw materials and materials specified in subitems 5), 6), 8) and 9) of this Item the copy of the veterinary reference, the copy of the short description of engineering procedure, confirmation about assignment of accounting number is provided to object of production to the producer of goods;

17) on the goods made only from the raw materials and materials specified in the subitem 7) of this Item copies of the veterinary reference or the certificate of catch origin, the copy of the short description of engineering procedure and confirmation about assignment of accounting number are provided to object of production to the producer of goods;

18) on the goods made only from scrap and waste of non-ferrous and ferrous metals the copy of the act (reference) of write-off (education) of waste or scrap or the copy of the act on disposal (write-off) of fixed assets or the copy of the act of receipt of the inventories received in case of disassembly and dismantle of fixed assets, the copy of the short description of engineering procedure is provided;

19) on the goods made only from waste (secondary raw materials) except scrap and waste of non-ferrous and ferrous metals the copy of the reference of formation of waste or the copy of the act on disposal (write-off) of fixed assets or the copy of the act of receipt of the inventories received in case of disassembly and dismantle of fixed assets, the copy of the short description of engineering procedure are provided;

20) on the goods made only from the raw materials and materials specified in subitems 2), 3), 4), 5), 6), 7), 8), 9), 10), 11) and 12) of this Item the documents specified in these Items and also the copy of the short description of engineering procedure are provided;

21) on the goods made only from atmospheric air the copy of the short description of engineering procedure is provided;

22) on electric, thermal and other types of energy the copy of the short description of engineering procedure is provided.

For receipt of the certificate of origin of batch production provision of the veterinary certificate, specified in subitems 5), 6), 7), 8) and 9) this Item is not required.

2. The copy of the contract in foreign trade (agreement), the invoice or accounts proforma, or other document reflecting financial and (or) quantitative parameters of goods (when implementing long-term foreign trade agreements / transactions when the load goes from the same consignor to the same consignee, provision of the invoice or the account proforma is not required if it does not contradict requirements of the existing (ratified) international agreements / agreements and/or rules of determination of country of source (criteria of determination of country of source) established unilaterally by the country (union) of import).

3. If the goods are completely made in the Republic of Kazakhstan, the copy of documents, confirmatory that the goods are completely made in the Republic of Kazakhstan:

1) if the applicant is not producer of the goods specified in subitems 2), 4), 5), 6), 7), 8), 9), 12), 13), 14), 15), 16), 17), 18), 19) and 20) this Item, then copies of the documents confirming transition of the property right to goods from the producer to the applicant (the agreement and (or) accounts invoices, and (or) delivery note and (or) other document confirming transition of the property right from the producer of goods to the applicant) are shown;

14) on the goods made only from the raw materials and materials specified in the subitem 3) of this Item the statement according to the grain receipt or other document confirmatory transition of the property right to goods, the certificate of the place of collection of products, the copy of the short description of engineering procedure are provided to the applicant of the waybill copy or the grain receipt, or;

15) on the goods made only from the raw materials and materials specified in the subitem 4) of this Item copies of the documents certifying legality of cutting down, collection or procurement of such plants and their parts, the copy of the short description of engineering procedure are provided;

16) on the goods made only from the raw materials and materials specified in subitems 5), 6), 8) and 9) of this Item the copy of the veterinary reference, the copy of the short description of engineering procedure, confirmation about assignment of accounting number is provided to object of production to the producer of goods;

17) on the goods made only from the raw materials and materials specified in the subitem 7) of this Item copies of the veterinary reference or the certificate of catch origin, the copy of the short description of engineering procedure and confirmation about assignment of accounting number are provided to object of production to the producer of goods;

18) on the goods made only from scrap and waste of non-ferrous and ferrous metals the copy of the act (reference) of write-off (education) of waste of scrap and (or) the copy of the act on disposal (write-off) of fixed assets and (or) the copy of the act of receipt of the inventories received in case of disassembly and dismantle of fixed assets, the copy of the short description of engineering procedure is provided;

19) on the goods made only from waste (secondary raw materials) except scrap and waste of non-ferrous and ferrous metals the copy of the reference of formation of waste and (or) the copy of the act on disposal (write-off) of fixed assets and (or) the copy of the act of receipt of the inventories received in case of disassembly and dismantle of fixed assets, the copy of the short description of engineering procedure are provided;

20) on the goods made only from the raw materials and materials specified in subitems 2), 3), 4), 5), 6), 7), 8), 9), 10), 11) and 12) of this Item the documents specified in these Items and also the copy of the short description of engineering procedure are provided;

21) on the goods made only from atmospheric air the copy of the short description of engineering procedure is provided;

22) on electric, thermal and other types of energy the copy of the agreement or other document confirming transition of the property right to goods to the applicant is provided.

4. If the goods are made in the Republic of Kazakhstan taking into account criterion of sufficient conversion of goods, the following documents for determination of criterion of sufficient conversion of goods are provided:

1) if the applicant is not producer of the declared goods, then copies of the documents confirming transition of the property right to goods from the producer to the applicant (the agreement and (or) the invoice, and (or) delivery note and (or) other document confirming transition of the property right from the producer of goods to the applicant) are shown;

2) the copy of the agreement and (or) the invoice and (or) other document confirming transition of the property right to raw materials and the materials used in production of goods;

3) copy of the short description of engineering procedure of production of goods;

4) the copy of costing of cost of goods on ex-works price with allocation of cost of raw materials and components of foreign origin.

4-1. For receipt of the certificate of origin of batch production the applicant in addition provides:

1) confirmation about assignment of accounting number to object of production, or information on obtaining at least 2 (two) certificates of origin of the ST-1 or CT-KZ form confirming availability of production of goods or goods, homogeneous with it, during at least 12 (twelve) months before application. At the same time, one of the provided certificates shall be issued not earlier than 12 (twelve) months before application, and the second no more than 12 (twelve) months before application.

2) data on absence of debt according to which account is kept in bodies of state revenues.

4-2. For receipt of the certificate of origin of batch production the applicant in addition provides:

1) confirmation about assignment of accounting number to object of production, or information on obtaining at least 2 (two) certificates of origin of the ST-1 or CT-KZ form confirming availability of production of goods or goods, homogeneous with it, during at least 12 (twelve) months before application. One of the provided certificates is issued not earlier than 12 (twelve) months before application, and the second no more than 12 (twelve) months before application;

2) data on absence of debt according to which account is kept in bodies of state revenues.

5. For the goods re-exported from the Republic of Kazakhstan:

1) copies of documents for purchase of goods (agreement and (or) invoice or other document confirmatory transition of the property right of goods to the applicant);

2) copies of the documents confirming the commodity importation fact on the territory of the Republic of Kazakhstan (the declaration on goods (if the goods are imported from the territory of state members of the Eurasian Economic Union, the declaration on goods is not provided), documents on transportation of goods (if the goods are transported by road transport from the territory of state members of the Eurasian Economic Union, the coupon of passing of the state control in addition is submitted);

3) copies of the documents confirming goods origin (the copy of the certificate of origin or the copy of the declaration on goods origin) issued by authorized body (organization) of the country of export according to requirements of the existing (ratified) international agreements / agreements and (or) rules of determination of country of source (criteria of determination of country of source) established unilaterally by the country (union) of export) and certified by the authorized signature and seal (in case of its availability) authorized body (organization) of the country of the export which issued the document.

5-1. When moving goods within the State Parties of the Agreement on the Rules of determination of the country of goods' origin in the Commonwealth of Independent States of November 20, 2009 (further - the Agreement) made in their territories and imported (placed) on customs areas State Parties of the Agreement before entry into force of Rules of determination of the country of goods' origin of September 24, 1993, the applicant provides the documents confirming information on the manufacturer of goods (its name, the address, and also year of production of goods).

2) if the goods were exported to the countries of state members of the Eurasian Economic Union, then copies of transport documents are provided.

7. For carrying out identification of goods or determination of criterion of sufficient conversion the applicant provides:

1) copies of the documents certifying origin of raw materials, materials, goods if it is provided by requirements of the existing (ratified) international agreements / agreements;

2) copies of regulating documents on standardization according to which the goods are made (in the presence);

3) copies of test reports on raw materials, materials and (or) the goods issued by accredited test laboratories (centers) if identification of goods without laboratory researches and researches is impossible.

Note:

Long-term agreements (contracts, agreements) which effective period lasts one calendar year and more and the documents confirming the status of the Applicant, and also serial production of goods, the rights of production of goods are represented once with the subsequent updating in process of entering of any changes and amendments into them.

Reclamation of documents and data which can be received from information systems is not allowed.
