According to the subitem 22) of article 10 of the Law of the Republic of Kazakhstan of April 17, 2014 "About traffic" I ORDER:

1. Approve enclosed:

1)   No. 573 is excluded according to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of 28.12.2016;

2) Rules of forming and implementation of activities of the qualification commission according to appendix 2 to this order;

3) Rules of carrying out certification of candidates for teachers, training officers and masters of driving instruction during educational process on training of transport drivers according to appendix 3 to this order;

4) form and reporting frequency of the activities by professional associations.

2. To committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.):

1) to provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its official publication;

4) to provide placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan.

3. To impose control of execution of this order on the deputy minister of internal affairs of the police major general Turgumbayev E. Z. and Committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Lepekh I. V.).

4. This order is subject to official publication and becomes effective since October 19, 2014.

Rules of forming and implementation of activities of the qualification commission

1. These rules are developed according to the Law of the Republic of Kazakhstan "About traffic" and determine procedure for forming and implementation of activities of the qualification commission on certification of candidates for teachers, training officers and masters of driving instruction during educational process by training of transport drivers (further - the Commission) in the Republic of Kazakhstan.

2. The commission is created by the Professional association on training of transport drivers (further - Professional association) which won tender.

3. The commission is created for the purpose of certification of candidates for qualification assignment "teacher", "training officer", "the master of driving instruction during educational process the" of persons wishing to be engaged in preparation and training of candidates for transport drivers in the territory of the Republic of Kazakhstan.

4. The commission is the non-profit organization created in form of business of organization and acts on the basis of the provisions (charter).

6. The professional association sends to the address of the educational organizations for training of the transport drivers who are her members (further - the educational organization), authorized body on traffic safety (further - authorized body) request about nominations for their inclusion in the created Commission.

From among the candidacies presented by the educational organizations for inclusion in structure of the Commission, governing body of Professional association creates the Commission.

About one representative from authorized body is part of the Commission.

7. The authorized body, within three working days from the date of receipt of request, in writing notifies Professional association on the representative of authorized body which will be part of the Commission.

8. The commission chairman is elected members of the commission after forming of its structure. The representative of the educational organizations, from among their members by a simple majority vote is elected the commission chairman.

9. Commission sessions are held according to the work plan which is annually approved by the Commission chairman.

Commission session is considered competent in the presence of at least 51 percent from total number of members of the commission. Decisions of the Commission are made by a simple majority vote the present members of the commission. In case of equality of votes the Commission chairman's voice is decisive.

10. Emergency meetings of the Commission are held upon the demand of the Commission chairman or at least three members of the commission.

11. The made decisions are drawn up by the protocol which is signed by the Commission chairman and members of the commission who are present at meeting.

Record keeping, preparation of protocols are provided with the secretary of the Commission.

12. In case of systematic nonparticipation of the member of the commission in the regular meetings (at least three next), the Commission chairman makes the offer in governing body of Professional association and (or) authorized body on exception of the representative of the educational organization of structure of the Commission and its replacement.

13. The commission stops the activities from the date of suspension of operations of Professional association.

The commission resumes the activities from the date of renewal of the activities by Professional association, or based on the court resolution which took legal effect.

14. In case of disposal of the representative of the educational organization - the member of the commission from structure of Professional association or dismissal of the representative of authorized body, the governing body of Professional association or authorized body make corresponding changes to structure of the Commission.

15. Commission:

1) will be organized by process of acceptance of qualification examination;

2) timely informs candidates for teachers, training officers, masters of driving instruction during educational process on the place and time of carrying out certification;

3) provides proper conditions for holding qualification examination;

4) no later than five working days before date of meeting informs the representative of authorized body, on the place and time of carrying out commission session;

Develops 5) and approves the program of certification of candidates for teachers, training officers, masters of driving instruction during educational process;

6) approves dates of qualification examinations;

7) accepts documents for certification of candidates for teachers, training officers, masters of driving instruction during educational process;

8) carries out certification in teachers, training officers, candidates of masters of driving instruction during educational process, by means of consideration of results of qualification examinations;

9) within ten working days from decision date about issue of the certificate of competency "teacher", "training officer", "the master of driving instruction during educational process" in the state and Russian languages publish the decision of the Commission on qualification assignment in the periodic printing editions and Internet resources of Professional association and Ministry of Internal Affairs of the Republic of Kazakhstan extended in all territory of the Republic of Kazakhstan. By results of the carried-out certification of candidates "teacher", "training officer", "the master of driving instruction during educational process" in form according to appendix to this order with indication of number of the certificate of competency, surname, name and middle name grants certificates of competency (in the presence);

10)   No. 288 is excluded according to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of 25.04.2017

Rules of carrying out certification of candidates for teachers, training officers and masters of driving instruction during educational process on training of transport drivers

1. These rules of carrying out certification of candidates for teachers, training officers and masters of driving instruction during educational process (further - Rules) determine conditions for receipt of the certificate of competency by training of transport drivers.

2. In these rules the following concepts are used:

1) certification - the procedure of determination by the Qualification commission (further - the Commission) knowledge and skills of candidates for teachers, training officers and masters of training of driving during educational process on training of transport drivers (further - the candidate) by means of acceptance of qualification examinations;

2) qualification examination (further - examination) - form of examination and skills of candidates solution of modular task and conducting testing;

3) modular task - the amount of tasks consisting at least of two tasks, providing theoretical questions and tests.

3. Persons having the higher technical or secondary technical education, the car driver license of that category on which they will provide training, driver's years of service at least five years are allowed to certification.

4. Certification of candidates is carried out at least two times a year, according to the work plans which are annually approved by the Commission.

5. Date of certification is published in mass media, Internet resources of Professional associations and the Ministries of Internal Affairs of the Republic of Kazakhstan, and told candidates not later than two months before the established date of certification.

6. For registration for certification the candidate submits the following documents to the Commission:

the statement in form according to appendix 1 to these rules;

1) copy of the identity document;

2) the copy of the document confirming the higher technical or secondary technical education;

3) the medical certificate in the form No. 086u approved by the order of the deputy. The Minister of Health of the Republic of Kazakhstan of November 23, 2010, No. 907 "About approval of forms of primary medical documentation of the organizations of health care", registered in the Register of state registration of regulations No. 6697;

4) copy of the car driver license.

7. Receipt date of documents in the Commission is fixed in the magazine of incoming correspondence and together with the entering number is put down on the statement of the candidate.

8. Candidate lists, registered on examination, affirm the order of the Commission chairman (in its absence the vice-chairman). The decision on the admission is brought to the attention of the candidate not later than two weeks prior to holding examinations in oral or written form.

9. To the candidates who successfully completed certification, the decision of the Commission grants the certificate of competency about qualification assignment "teacher", "training officer", "the master of training of driving during educational process" with indication of number of the certificate of competency, surname, name and middle name (in the presence).

10. Carrying out certification is performed according to these rules and the program of the certification of candidates for teachers, training officers, masters of driving instruction during educational process (further - the program of certification) approved by the Commission.

11. For holding examinations of the Commission:

1) is created by modular tasks in the state and Russian languages;

2) will organize holding examinations;

3) perform also assessment of examination-papers of candidates.

12. Examinations are held according to the schedules approved by the Commissions. The schedule and the venue of examinations are told candidates at least in ten calendar days prior to the first examination.

13. Examination is carried out in two steps:

1) by means of accomplishment of modular task in writing;

2) testing by means of use of the automated systems equipped with the corresponding software with use of the automated base of examination questions on state or Russian (at the choice of examined).

14. The modular task, at the request of the candidate, is represented and is carried out in the state or Russian languages.

15. Envelopes which contain modular tasks are opened in twenty minutes prior to the examination by the Commission chairman (in its absence the vice-chairman) in the presence of candidates and members of the commission.

16. Issue of the certificate of competency "teacher", "training officer", "the master of training of driving during educational process" is performed by the Commission, according to the program of certification according to which certification of the candidate was performed.

17. Recovery of the lost certificate of competency is performed based on results of the previous certification on effective period of the lost certificate of competency.

18. Effective period of the certificate of competency - five years.

19. The result of examination is estimated on 100-mark system (fifty points for the first stage - theoretical questions of modular task and fifty points for the second stage testing).

Successfully passed qualification examination is considered the candidate who gained in the amount for the performed modular task seventy five points and more.

20. Each examination-paper is checked by at least than two members of the commission separately, independently from each other, the middle mark of two results is as a result removed. In case of difference of results more than ten points and in the cases requiring refining, the examination-paper is checked by the third independent specialist from among members of the commission. In such cases the final result makes arithmetic-mean three estimates.

21. The decision on approval of estimates not later than in ten days after completion of the procedure of assessment on all examinations, is accepted by a simple majority vote members of the commission, is entered in the protocol and signed page by page by all members of the commission who are present at meeting.

Results of examination are told candidates next day after approval of job evaluation in writing.

Individual results of each candidate are brought in its examination card in form according to appendix 2 to these rules which is hemmed with other documents of the candidate. The performed modular tasks, irrespective of assessment, to candidates do not return.

22. Results of certification are entered in the protocol which is signed by the Chairman (in its absence the vice-chairman) and all members of the commission who were taking part in certification.
