About differentiation of bottom of the Caspian Sea between the Republic of Kazakhstan and Turkmenistan

The Republic of Kazakhstan and Turkmenistan which further are referred to as with the Parties

aiming to provide favorable conditions for realization of the sovereign rights to development and use of resources of bottom and subsoil of the Caspian Sea,

in view of that the existing legal regime of the Caspian Sea does not meet modern requirements and does not regulate in full relation of the Caspian states,

calling the Caspian states for the fastest conclusion on the basis of their consensus of the Convention on legal status of the Caspian Sea,

being guided by the principles and rules of international law,

convinced that this agreement will promote further strengthening of neighborliness and development of mutually beneficial and equal cooperation between the Parties,

agreed as follows:

Article 1

The bottom and subsoil of the Caspian Sea are differentiated between the Parties on the line which is under construction on the basis of the median line taking into account the principles and rules of international law, and also by agreement of the Parties (further - the line of demarcation).

Article 2

For creation of the line of demarcation of the Party proceeded from the average long-term level of the Caspian Sea equal to mark minus 28 meters of the Baltic system of 1977 of heights concerning zero Kronshtadsky tide gage.

Coordinates of rotary points of the line of demarcation are determined on the basis of the cartographic materials approved by the Parties in system of coordinates of 1942 and enshrined in the Catalogue of geographical coordinates of rotary points of the line of demarcation (Appendix 1).
