1. Approve enclosed:

1) Rules of provision of services of mail service;

2) Rules of application of postage stamp on mailings.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of provision of services of mail service

1. General provisions

1. These rules of provision of services of mail service (further - Rules) are developed according to the Law of the Republic of Kazakhstan of February 8, 2003 "About mail", the international treaties ratified by the Republic of Kazakhstan and determine procedure for provision to users of services of mail service by operators of mail.

2. Treat services of mail service:

1) public services of mail service which consist in transfer of non-registered letters, postcards and parcels post of the users who are brought together from mailboxes and (or) accepted in operational windows;

2) services in transfer of the registered mailings to which transfer belongs:

registered mail;

custom postcard;

custom parcel post;

letters with the announced value;

parcels post with the announced value;

small packet;

sack of "M";

sending simple;

sending with the announced value;

direct post container;

3) services of the accelerated and express mail to which transfer of the letter (packet) and sending by the accelerated and express mail belongs;

4) service of postal money transfer to which transfer of money treats with use of the form of the established sample sent on post network. These rules do not regulate money transfer service, performed according to the legislation of the Republic of Kazakhstan in the field of payments and money transfers;

5) service of distribution of periodic printing editions in subscription which consists in acceptance of subscription according to the catalog, processing of orders, forwarding, transfer and delivery of periodic printing editions, and implementation of periodic printing editions which consists in their retail sale;

6) service of realization of philatelic products which consists in sale of the state signs of post payment of the Republic of Kazakhstan to users for the purposes of collecting. Holding philatelic actions by the National operator of mail is regulated by its internal legal acts;

7) other services of mail service which are:

acceptance of mailings at home;

home delivery of mailings which are subject to issue in production facilities of the operator of mail;

provision in use of subscription and subscriber boxes;

filling of accompanying forms;

packaging of mailings;

storage of mailings;

services which provision is inseparably linked with services of mail service, including service of e-mail and fax connection.

Services of e-mail are subdivided into the electronic message given to the user on the electronic medium or transferred to the personal computer of the user, and the electronic message, sent at separate stage by the non-registered or registered mail (hybrid departure).

Services of fax connection are subdivided into the open facsimile message given in production facilities of the operator of mail, and the closed facsimile message delivered to the specified address by the non-registered or registered mail.

3. In these rules the following basic concepts are used:

1) defective departure - the departure having signs of access to investment (violation of integrity of packaging) or weight of which does not correspond to weight in case of acceptance;

2) the mailing with the notification on obtaining - the registered mailing when which giving the sender charges to the operator of mail to tell him or person specified to them when also who is handed the mailing;

3) the control term (control terms of transfer of mailings, postal money transfers, departures of the accelerated and express mail) - the term during which the operator shall perform transfer of departures from production facility of the place of their acceptance to production facility of the place of their issue;

4) parcel post - the mailing with printing editions, official papers and other objects, investment, the sizes which mass and method of packaging are provided by these rules;

5) Universal Postal Union (further - VPS) - the international organization in the field of mail service;

6) acts of Universal Postal Union (further - Acts VPS) - the Charter, General regulations of Universal Postal Union, the World post convention, the Regulations of written correspondence, Regulations of postal parcels, the Agreement and the Regulations of the Agreement on service of post payments;

7) simple sending - sending without investment value assessment which is accepted from the sender with issue of the receipt and is issued to the receiver on receipt;

8) departures of the accelerated mail - the letter (packets) and sending processed and delivered in the accelerated procedure;

9) the catalog - the collection list of the periodic printing editions accepted to distribution on retail and subscription;

10) "Consignment" - service of transfer of the international mailings grouped by one sender to one receiver;

11) departures of express mail - the letter (packets) and sending processed and delivered in the accelerated procedure with use of the courier;

12) sack of "M" (special sack) - the international mailing containing printing editions (periodicals, books and other), sent by one sender to one addressee;

13) operational window - workplace on production facility of the operator of mail where services are provided to the user;

14) delivery of the mailing - movement of the mailing from production facilities of the destination in post office, subscription mailbox, or to other address specified by the sender;

15) category of the mailing - set of the signs determining procedure and conditions of acceptance, processing, transfer and delivery of the mailing (simple, custom, with the announced value, with special marks);

16) sending - the mailing with goods and other objects, investment, the sizes, weight and which packaging are provided by these rules;

17) sekogramma - the mailing with investment of the written messages written by sekografichesky method, submitted openly, cliche with signs of sekografiya, the sound records intended only for blind people;

18) not distributed mailings - not delivered (not handed) addressee during fixed term mailings which due to the lack of the return address are not returned to the sender;

21) post case of strong point - the special case intended for temporary storage of mailings on the delivery site or for receipt of mailings by the addressee;

22) small packet - the international registered mail with single samples of goods, small objects of gift nature, investment, the sizes, weight and which packaging are provided by these rules;

23) shortpaid written correspondence - ordinary written mail which transfer by the sender is in parts or in full not paid;

24) the internal mailing - the departure accepted for transfer and delivery to the addressee within the territory of the Republic of Kazakhstan;

25) the international mailing - the departure accepted for transfer and delivery to the addressee within the territory of member countries of VPS;

26) the letter - the mailing sent in the form of envelope with written investment.

2. Requirements for the organization of servicing of users and procedure for carrying out operational day

The national operator of mail in coordination with local executive bodies of the city of republican value, the capital, areas (cities of regional value) in settlements, and also at railway stations, at the airports, sea (river) ports and on the piers servicing passengers on parking of mobile units of mail service establishes mailboxes for collection of ordinary written mail. Mailboxes are established also at entrance to production facility of the National operator of mail.

The logo of the National operator of mail, the assigned number, frequency and time of dredging of correspondence (the beginning of the first and last dredging) is applied on mailboxes. On mailboxes in the rural zone are specified logo of the National operator of mail, the assigned number, the postal index of the servicing department of mail service, dredging time, and also days when dredging is not performed.

5. For provision of services of mail service in production facilities of the operator of mail operational windows with workplaces for provision of services of mail service during the whole operational day are equipped.

6. The procedure for carrying out operational day and its duration is established by the operator of mail in the mode, convenient for users, taking into account technologies of mail service.
