1. Approve the enclosed Provision of Republican public institution "Committee on cases of religions of the Ministry of Culture and sport of the Republic of Kazakhstan".

2. To provide to committee on cases of religions of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of this order on official publication in periodic printing editions and in information system of law of Ad_let within ten calendar days after its state registration;

3) placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the vice-Minister for Culture and Sports of the Republic of Kazakhstan Azilkhanov M. A.

4. This order becomes effective from the date of its first official publication.

Provision of Republican public institution "Committee on cases of religions of the Ministry of Culture and sport of the Republic of Kazakhstan"

1. General provisions

1. The committee on cases of religions of the Ministry of Culture and sport of the Republic of Kazakhstan (further - Committee) is department of the Ministry of Culture and sport of the Republic of Kazakhstan (further - the Ministry) performing regulation in the field of religious activities.

2. The committee performs the activities according to the Constitution of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

2) implementation of other tasks assigned to Committee by the legislation of the Republic of Kazakhstan.

15. Functions:

1) participates in realization of the main directions of state policy in the field of religious activities and interaction with religious associations;

2) is carried out by studying and the analysis of religious situation in the republic;

3) is carried out by studying and the analysis of activities of the religious associations created in the territory of the Republic of Kazakhstan, missionaries, the spiritual (religious) organizations of education;

4) is provided by implementation of explanatory work on the questions which are within its competence;

5) performs information and propaganda actions for the questions which are within its competence;

6) is provided by conducting theological examinations;

7) is approved by activities of foreign religious associations in the territory of the republic, appointment of religious associations as the foreign religious centers of heads in the Republic of Kazakhstan;

8) will organize and performs cooperation with authorized bodies of foreign states in the field of religious activities;

9) is performed by international cooperation concerning religious activities and interaction with religious associations, and also drafts agreements, memorandums and agreements, including international, in the field of religious activities;

10) is coordinated by activities of local executive bodies of areas, the cities of republican value and the capital concerning religious activities and interaction with religious associations;

11) performs methodical management of local executive bodies in the field of religious activities;

Develops 12) and participates in development of regulatory legal acts in the field of religious activities within the competence;

13) participates in development of strategic and program documents concerning religious activities and interaction with religious associations;

14) considers the appeals of physical persons and legal entities concerning violations of the law of the Republic of Kazakhstan about religious activities and religious associations;

15) makes offers on prohibition of activities of the physical persons and legal entities violating the law in the field of religious activities of the Republic of Kazakhstan;

16) in the cases established by the legislation and procedure constitutes protocols on administrative offenses;

17) within the competence realizes the preventive measures directed to the prevention of extremism, performs counteraction to terrorism;

18) ensuring compliance with the laws and other regulatory legal acts in the field of homeland security makes suggestions for improvement of system of homeland security within the competence, and also;

19) provides consumer protection when rendering the state services by Committee within the competence;

20) is provided by respect for the principles of gender equality in personnel policy of Committee;

21) is carried out by legal monitoring of regulatory legal acts in the field of religious activities according to the procedure, established by the legislation;

22) also "The research and analytical center concerning religion" performs management of the corresponding industry (sphere) of public administration concerning republican public institutions "International center of cultures and religions";

23) performs other functions established by the legislation of the Republic of Kazakhstan.

16. Rights and obligations:

1) to organize and hold events within competence of Committee;

2) to create advisory advisory bodies under Committee;

3) to request and receive in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

4) to exercise property management, transferred to Committee;

5) to observe the legislation of the Republic of Kazakhstan;

6) to perform other rights provided by the current legislation of the Republic of Kazakhstan.

3. Organization of activities of Committee

17. Management of Committee is performed of the Chairman who bears the personal responsibility for accomplishment of the tasks assigned to Committee and implementation of the functions by it.

18. The chairman of Committee is appointed to position and dismissed by the Minister for Culture and Sports of the Republic of Kazakhstan according to the procedure, established by the legislation of the Republic of Kazakhstan.

19. The chairman has deputies who are appointed to positions and are dismissed by the Responsible secretary of the Ministry according to the legislation of the Republic of Kazakhstan.

20. Powers of the Chairman of Committee:

Represents 1) to the Responsible secretary of the Ministry of the offer on structure and the staff list of Committee;

2) determines powers of the deputies, approves regulations on structural divisions of Committee, job descriptions of employees of structural divisions of Committee;

3) in the procedure established by the legislation appoints to position and dismisses employees of Committee (except for vice-chairmen of Committee);

Appoints 6) in coordination with management of the Ministry of heads of the subordinated organizations in the procedure established by the legislation;

7) within the competence signs orders, instructs, obligatory for execution by employees of Committee;

8) supervises Managements of administrative and personnel work, legal support, economy and finance of Committee;

9) is represented by Committee in state bodies and other organizations according to the current legislation;

10) takes the measures directed to anti-corruption in Committee and bears the personal responsibility for acceptance of anti-corruption measures;

11) makes decisions on other questions which are within its competence.

21. Vice-chairmen of Committee:

1) coordinate activities of Committee within the powers;

2) is performed by other functions determined by the Chairman of Committee.

22. In absence period of the Chairman of Committee one of deputies performs the common directorship behind activities of Committee and bears the personal responsibility for accomplishment of the tasks assigned to Committee and implementation of the functions by it;

23. Other questions of the organization of activities of Committee are regulated by regulatory legal acts of the Republic of Kazakhstan, orders of the Ministry and Committee.

4. Property of Committee

24. The committee has the isolated property on the right of operational management.

The property of Committee is created at the expense of the property given it by the owner and also the property (including cash incomes) acquired as a result of own activities and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

25. The property assigned to Committee belongs to republican property.

26. The committee has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation.

5. Reorganization and abolition of Committee

27. Reorganization and abolition of Committee are performed according to the legislation of the Republic of Kazakhstan.
