About the Program of adaptation of economy of the Republic of Tajikistan in connection with membership in the World Trade Organization (WTO)

According to article 14 of the Constitutional law of the Republic of Tajikistan "About the Government of the Republic of Tajikistan" the Government of the Republic of Tajikistan decides:

1. Approve the Program of adaptation of economy of the Republic of Tajikistan in connection with membership in the World Trade Organization it (is applied).

2. To provide to the ministries and departments of the republic timely and full implementation of actions of the Program of adaptation of economy of the Republic of Tajikistan in connection with membership in the World Trade Organization.

3. To the ministries and departments of the republic to consider the course of accomplishment of the Program of adaptation of economy of the Republic of Tajikistan in connection with membership in the World Trade Organization and about results every quarter to provide information in the Ministry of Economic Development and Trade of the Republic of Tajikistan.

4. To the Ministry of economic development and trade of the Republic of Tajikistan about the course of implementation of this Program every half-year to provide information to the Government of the Republic of Tajikistan.

The program of adaptation of economy of the Republic of Tajikistan in connection with membership in the World Trade Organization

1. Introduction

The World Trade Organization (WTO) was founded on January 1, 1995 and its main objective is simplification of international trade, ensuring equality and transparency, assistance to sustainable development of economy and on this basis increase in welfare of the people. Member countries of the WTO carry out these tasks by means of control of fulfillment of requirements of multilateral agreements taking into account holding multilateral negotiations, settlement of trade in compliance with rules of the WTO, support of developing countries and general research of economic policy of all countries of members.

Agreements of the WTO cover extensive sphere and consist of the general and fundamental principles for all countries of members of this organization. Only these principles form multilateral basis of trade system of the WTO. For today 160 countries are accepted in this organization and 27 other countries are in quality of observers.

The Republic of Tajikistan is the 159th member of this organization and our country for achievement of these purposes completed the long period of negotiations. The world practice shows that process of the introduction is very difficult and the countries to observers need to bring into accord with requirements and regulations of the WTO the current legislation, with the countries members of this organization negotiations on external trade regime, conditions allowing access to commodity market and services, commercial aspects of intellectual property rights, protection of the rights of the producer and other directions shall be held.

For the purpose of need of membership in this Government of the Republic of Tajikistan organization in May, 2001 submitted the letter - the request to the Secretariat of the WTO about intention of the accession to the WTO. In July, 2001 the General council of the WTO at the meeting considered the request of the Government of the Republic of Tajikistan about creation of the Working group for consideration of question of accession of our country to the WTO and assignment to Tajikistan of the status of the country of the observer.

From its Excellency, the President of the Republic of Tajikistan, dear Emomalii Rahmon and the Government of the Republic of Tajikistan necessary conditions for acceleration of process of the entry of the Republic of Tajikistan into the WTO were created. In pursuance of orders of the President and the Government of the Republic of Tajikistan the Ministry of Economic Development and Trade together with the interested departments carried out certain work.

In particular, question of the organization and coordination of process of the entry of the Republic of Tajikistan into the WTO, and also coordination of activities of executive bodies of the government in realization of cooperation with the WTO it was assigned to the Ministry of Economic Development and Trade of the Republic of Tajikistan.

The order of the Government of the Republic of Tajikistan of September 7, 2001 created the Interdepartmental commission on preparation of process of the entry of the Republic of Tajikistan into the WTO. For the purpose of reduction of the legislation of the Republic of Tajikistan in compliance with regulations of the WTO huge work was performed. In the republic the steady regulatory framework conforming to requirements of the international rights is created.

Negotiations and meetings of representatives of the Republic of Tajikistan with the countries by members of the WTO concerning accession to the WTO were entered on two to the directions: bilateral and multilateral. In the period of 9 rounds of negotiations, representatives of the Republic of Tajikistan answered 1300 questions and requests of the countries of members of the WTO. In this process the Republic of Tajikistan held 6 bilateral negotiations on questions of access to the market of services and 13 bilateral negotiations on questions of access to commodity market, and signed the relevant protocols.

On December 10, 2012 on the General council of the WTO the Report of the Working group and document package, connected with process of the entry of the Republic of Tajikistan into the WTO was considered and approved. The protocol on the entry of our country into the WTO was signed by the President of the Republic of Tajikistan and the Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan is ratified. The Republic of Tajikistan became on March 2, 2013 the full-fledged member of the World Trade Organization.

The entry of the Republic of Tajikistan into the WTO first of all actively promotes in the course of integration with world economy, positively influences the rating of the country at world level, gives the chance to use benefits of international trade, promotes enhancement of structure of public administration and plays important role in training of highly qualified specialists in the field of economy and international trade.

Participation of the Republic of Tajikistan in the WTO is considered one of priority questions of development of national economy. Membership of Tajikistan in this organization allows to apply within the country system of transparency, predictability and it is the most important to establishment of compliance with requirements the world trade of availability of the market, and also raises competitiveness in the domestic market of the country of the made products.

2. Need of development of the Program

In present conditions, with the entry of the Republic of Tajikistan into the WTO, use of benefits of accession to this organization, preparation of national economy for healthy competition in transition period, reduction in compliance of its economy within undertaken obligations of the Republic of Tajikistan, protection of economic interests of domestic manufacturers, forward development of foreign economic relations acquiring special relevance turn into key factor of development of national economy. In these conditions further forward development of economy is also key premises the long-term economic strategy of the country and is directed to solutions of questions of updating and the organization of market competitive economy. In this regard, the relevant organization of interaction between the Republic of Tajikistan and the countries by members of the WTO, and also with the international institutes is the requirement of the present.

Reduction of the legislation of the republic in compliance to regulations and rules of the WTO is the legal basis of the entry of the Republic of Tajikistan into the WTO and it was completely performed in the period of the accession to the WTO. The Republic of Tajikistan performed the certain work connected with approval of the legislation of the republic to regulations of the WTO, elimination of discrepancy of the national legal system to requirements of national treatment and most favored nation treatment.

In the course of the accession to the WTO more than 100 regulating legal documents connected with questions of the WTO were accepted. It is necessary to emphasize that from the countries of organization members in relation to Tajikistan rationing arrangements on reducing trade in agricultural products were not taken. It should be noted that during multilateral negotiations on agricultural industry with the countries by members of the WTO, Tajikistan could support the agrarian sector at the level of 8% of GDP of industry. During negotiations Tajikistan could protect the priority directions, in particular conversion of cotton and light industry, the food industry and conversion of other selkhozproduktion.

3. Program purpose

The main objective of the Program is creation of the favorable circle for development of small and medium entrepreneurship, attraction of foreign investments, strengthening of bilateral and multilateral cooperation with the countries members of the WTO, providing benefits of membership in the WTO for broad audience business of community, by means of acceptance of the necessary measures directed to accelerations of reforms in different industries of national economy. This Program is directed to decrease in unemployment by creation of the corresponding conditions for formation of new workplaces, decrease in level of poverty and raising of welfare of the population of the country.

Emergence new the export market of goods for domestic manufacturers, strengthening of bilateral and multilateral cooperation with the WTO countries, active participation in process of forming of enhancement of trade relations, are comparative advantages of membership in the WTO. Owing to these reasons the Program of adaptation of economy of Tajikistan to requirements of the WTO, access to commodity market and services of the countries of members of the WTO, by way of ensuring fair competition was developed for domestic and foreign producers who proceed from the Report of the Working group of our country on the entry of the Republic of Tajikistan into the WTO.

This Program covers different industries of national economy and its main objective consists in the organization not of the discrimination circle, ensuring transparency, equality of subjects of external economic activity, providing single condition of access to the market of services and preparation of optimal conditions for sustainable development of national economy.

The enclosed Actions plan is integral part of this Program and consists of 9 Sections. For the purpose of execution of the Actions plan which follows from undertaken obligations of the Republic of Tajikistan within the WTO the Program considers questions of technical barriers in trade, sanitary and phytosanitary measures, services, intellectual property, industry measures, including measures in agricultural industry and the industry, increase in level of knowledge and knowledge of wide range of entrepreneurs of the WTO and education.

4. Program tasks

For the purpose of elimination of the negative phenomena in external commercial relations, the organizations of effective system of foreign economic relations, the Government of the Republic of Tajikistan were accepted by rate on step-by-step liberalization of foreign trade and the accession to the WTO is designated as one of the priority directions. Adoption of the Presidential decree of the Republic of Tajikistan of June 27, 1995, No. 261 "About the subsequent liberalization of foreign trade in the Republic of Tajikistan" is considered the first step in implementation of reforms in this sphere. Today it is possible to note with satisfaction that the chosen way of the Government of the Republic of Tajikistan in social and economic development of the country was correct and timely.

Implementation of measures of this Program is directed on simplification of customs administration; reducings document flow, for import and export; reducings number of information for customs supervision and issue of permissions; establishments of term of control in automobile check points; ensuring supervision in automobile check points; for the purpose of ensuring public safety and health of the population, smuggling non-admission; again consideration of system of carrying out supervising measures on border check points, for the purpose of transfer of supervising and investigative works from border check-points on internal terminals; providing the preliminary information in allowing Items and their use in the course of decision makings about release of goods, taking into account risk management; development of the new customs tariffs following from obligations which are assumed in the course of the accession to the WTO; development and application of protective measures (anti-dumping, countervailing, protective measures); receipt of the status of the country of the observer in the agreement on public procurements and provision of request for membership; accession to the agreement of the WTO on trade in the aircraft and civil equipment; increase in number of control laboratories; construction of the modern laboratories meeting the international requirements; providing laboratories with modern oborudovaniye; training of the employees who are making use of the best international experience on safety of foodstuff; the organizations of information centers for services which are directed to strengthenings of line items of the Republic of Tajikistan in world trade.

Strengthening of integration of national economy with world economy and creations of the favorable circle, for the purpose of ensuring the corresponding participation in distribution of the international market of work and world trade, stimulation of export and investing activities, ensuring regular participation in process of development of rules of international trade and achievement of stable development are main objectives of policy of foreign economic relations of the country and basis for forming of global partnership for the purposes of development.

5. Program priorities

The priority of this Program first of all consists in use of the existing privileges within the WTO, adjustment on optimal conditions of bilateral mutually beneficial cooperation, attraction of foreign investments, ensuring transparency and equality in the trade and economic relations which lead to improvement of image of our country before the countries by members.

In case of implementation of the Actions plan of the Program, national economy can receive also following benefits:

- use of most favored nation treatment in trade which eliminates signing separately of large number of such agreements;

- use of the principles of free trade in international trade in relation to the Republic of Tajikistan which is the basis for elimination of negative and discrimination barriers;

- raising of rating of the country on the international scene, as the reliable partner and development of trade relations between domestic and foreign entrepreneurs and attraction of foreign investments;

- possibility of use of operational system of the trade information creating favorable conditions for realization of trade and economic policy;

- possibility of use of the mechanism of decisions of trade and economic disputes by the Republic of Tajikistan which is effective within the WTO;

- participation of the Republic of Tajikistan in development of new international trade rules taking into account national interests;

- activation of participation of subjects of external economic activity of the country at world level.

6. Results of the Program

Practical implementation of the Actions plan of the Program will result in the following results:

- not discrimination access of domestic goods and produktion in the world market;

- creating favorable conditions for attraction of foreign investments;

- adaptation of the legislation of the Republic of Tajikistan to regulations of the WTO;

- creation of conditions for increase in the quality level and competitiveness of domestic production taking into account increase in import of foreign products, services and investment into the domestic market;

- entry into system of decisions of trade disputes at the international level;

- participation in development of the international trade rules, taking into account national interests;

- use of operational system of the trade information creating favorable conditions for realization of trade and economic policy.
